LAW DIRECTOR BATES AYLWARD: And for clarification, this is the rezone for Harvard Avenue, if anyone would like to speak. PRESIDENT SHERER: And if anybody does want to speak, whether you’re for or against this… against this Ordinance, you do have three minutes. So could you please state your name and residential address, please. PETE SCHWIEGERAHT: Yes, good evening everyone, Council Members. Pete Schwiegeraht with MVAH Partners… uh, located at 9100 Center Point Drive, West Chester, Ohio 45069. And if I would, before we get going here, I understand everyone wants to keep this efficient, but we have had a very long effort here. We’ve been to seven public meetings, two neighborhood meetings. I would request you indulge us with a little more time than three minutes so that we can properly present our case to you and explain to you what we’ve done to date. PRESIDENT SHERER: Out of respect, you have three minutes. Out of respect for everybody that’s in the audience tonight. PETE SCHWIEGERAHT: Okay. Well, thank you very much for your time. This should be really a much more joyous opportunity here. Um, we did just receive word from the State of Ohio that our scoring held, and we have a score that would be successful in receiving funding for a $15 million new investment in your community that would serve fifty senior households with high quality independent living. This process started back in November… I’m sorry, in September when we came to the Planning Department and said we want to help build senior housing in your community. Help us find the right site. We looked at many sites. We ended on this site based off of good guidance from the Planning Commission, and first and foremost I must say thank you to Planning Commish… or to the Planning staff who did a great job, a proper job in their effort. And thank you to Councilman Mariol for helping us see through a real community engagement that was all sabotaged in the end. I should be talking to you about use. What are we here for? We’re here for zoning. Zoning is use based. Is this the right use for the property? It got turned into something completely different. We expressed that we are developing affordable housing. We are using tax credits through the state. They do focus on 80% AMI and under, and we said that from the get-go. We’ve explained that. Uh, Planning Commission made a recommendation. It was a recommendation for approval. Uh, we went to COUNCIL PROCEEDINGS JOURNAL 110 JOURNAL PAGE 221 MINUTES OF THE MEETING APRIL 25, 2022 Planning Commission. Planning Commission gave us a recommendation for approval. Problem, a clause was put in there that’s inappropriate. The clause said well, you can’t have Section 8, and we said in the meetings, we don’t have Section 8. Section 8, there’s two types. There’s a project based voucher, which is in our… in development, meaning that the project is government subsidized. And then there’s a choice voucher, which means a resident has it and they can take it wherever they want in your community. We clearly said we don’t have a project based Section 8 contract. That was true. When that clause went in though, we had to go back to the City. We e-mailed them the next day and said thank you giving us a recommendation for approval, but what you put in there was actually a violation of the Fair Housing. Typically, that would have just went on to Council, Council could have considered it, amended that recommendation, off we go. We were requested to go back to the neighborhoods, clarify and further the dialogue. Consensus build. Find a happy medium. Find a way that this can work. And that’s what we did. PRESIDENT SHERER: Sir, could you please bring your remarks to a close, please. PETE SCHWIEGERAHT: Yes, I will. We went back to the Ridgewood neighborhood. The city attorney was there. I would have thought for sure that the conversation would have been, understand folks, you can ask questions about affordability, but zoning is a decision of land use. It does not apply whether it’s affordable or not. Instead this is Section 8. They lied to you that it’s not 80% AMI, it’s 60% AMI. And oh, by the way, we have 30% AMI too. We were supposed to then go to the… to the Market Heights neighborhood and have a similar conversation. Somehow or another, we got etched out of that meeting. We’re not there now. City… city attorney is. PRESIDENT SHERER: Sir… PETE SCHWIEGERAHT: And then they come up with this decision… PRESIDENT SHERER: Sir, excuse me. We’re out of time. PETE SCHWIEGERAHT: Okay. Adjacent to us is senior housing, senior assisted living. On the other side of us is student housing… PRESIDENT SHERER: Hey, it’s… wait, let’s just stop right now. Okay? You have every right to have your three minutes, but out of respect for everybody that’s in this room, we’re gonna continue to move on, okay? PETE SCHWIEGERAHT: We were just in another meeting the other day and this was perfectly acceptable. PRESIDENT SHERER: Well, uh… PETE SCHWIEGERAHT: I mean, is there a reason you’re trying to keep us from talking? PRESIDENT SHERER: I… look, these are the rules for Council and I’m in charge of running this meeting, so your, you know, your speech is done, and I really appreciate your coming down this evening. PETE SCHWIEGERAHT: Okay. I just feel it’s a shame… MEMBER HALL: Mr. President, can I ask a question? PRESIDENT SHERER: No. Kevin. MEMBER HALL: I just want to know first, are you guys the owners of the property? DAVE THOMAS: I am. MEMBER HALL: Okay. As the property owner, from what I heard, in some meetings they gave you this zone change back in ’17 or ’18 or whatever? DAVE THOMAS: Two thousand seventeen, and they handed us nine numbers that City Council voted in favor of them. MEMBER HALL: Thank you. PRESIDENT SHERER: Out of respect for all the Council Members, now… here, hold up. If you guys… since he’s already spoke on the issue, you are not permitted to speak on the issue. DAVE THOMAS: What? (Inaudible background voices) PRESIDENT SHERER: No, are you? Okay. DAVE THOMAS: That’s alright. You know, I’m gonna be quick. PRESIDENT SHERER: Alright, but just… let me… let me… let’s get everything straight right now. So could you please state your name and residential address, please. DAVE THOMAS: I will. PRESIDENT SHERER: And you do have three minutes. DAVE THOMAS: My name is Dave Thomas. I’m here on behalf of the owner, Nickelplate Realty Trust LLC, 6610 Chatsworth Street, Canton 44718. I have a lot to say. Three minutes is not enough time to say it. The Law Director and the Law Department has tried to shut us up and shut us down by this nonsense about zoning. There’s no way I can go through it. Uh… which is kinda good. You guys want to shut us up and shut us down, three minutes isn’t enough. So, I’m done. If The Repository is here and they would like me to speak to them in detail, I would be glad to do it. Thank you. PRESIDENT SHERER: Is there anyone else in the audience wishing to speak… can you please state your name and residential address, please. WILL DENT: Uh… Will Dent, 701 Stone Crossing Street, Canton, Ohio. I’ve served for… as Chief Executive Officer for ABCD for more than 48 years. Uh, ABCD is located at 1225 Gross Avenue NE, and during the past several years we’ve developed 225 single family houses and three elderly complexes known as Wilson Pointe in downtown Canton, Bradley Place in downtown Massillon and Queen Ester Village in southeast Canton. We worked with property developers on all eleven partnerships which developed these units using low income housing tax credits. Most of these developers that we worked with were good, but the most outstanding of all of these developers was MVA Partners in developing Queen Ester Village in 2007. It is our hope that if this particular site is not approved, that MVA Partners will find another site to develop desperately needed housing for our elderly people for all ages in our community. Thank you. PRESIDENT SHERER: Thank you. Is there anyone else in the audience? Could you please state your name and residential address, please. JIM MOORE: Yes, Jim Moore M-O-O-R-E. I’m the director of facilities at 2631 Harvard Avenue, which used to be the Jewish… Canton Jewish Community Center. We have been there about five years. We have done a lot of work to the building and so forth, and we hope to get it back into the order of where it was years ago. Years ago there was sports events held there and so forth. We have a gym, we have a pool and so forth, and we’ve invested at least $250,000.00 on record into that building. We would love to see this housing come to pass. We could get members… the church, Deliverance Christian Church is also stationed… has their home base there, and we also have another unit, our Outreach Center, over at 1358 Cleveland Avenue NW across from the funeral home there. But anyway, we’d love to see this take place so that we can grow and get people into the community center that we’re developing there. It’s called Kingdom Center now. Thank you. PRESIDENT SHERER: Thank you. Could you please state your… CYNTHIA HOFACRE: I’m Cynthia Hofacre and I reside at 335 36th Street NW in Canton. Uh, I’m in COUNCIL PROCEEDINGS JOURNAL 110 JOURNAL PAGE 224 MINUTES OF THE MEETING APRIL 25, 2022 opposition of spot zoning, and I… I guess what I would like everybody to look at is you can… you only have to go in every quadrant of the city to see evidence of our history in Canton where we’ve done a lot of spot zoning. And at the time it seemed like it was a good thing to do and it passed and we had parcels broken up and just different things done, and then we’re left with years later it no longer fits and it no longer works and we’re left with an eyesore. Rec… of recent years, we had a Master Plan that was done at a great expense to taxpayers, and I’m wondering if anybody is really looking at the Master Plan because I guess in my recollection, I don’t recall in looking at the Master Plan and moving the city forward and keeping our stable neighborhoods and keeping everything moving along, if there was any evidence in there that they recommended that we do and continue spot zoning. Thank you. PRESIDENT SHERER: Thank you. Is there anyone… anyone else in the audience? Thank you. MARTY HURLEY: My name is Marty Hurley. I live at 3405 Market Avenue North. I’ve lived for 41 years in Market Heights. Basically, I have three concerns about changing the zoning to accommodate the construction of two three-story apartment buildings in the northwest area of Canton. First is the serious zoning issue that sets a precedent for future zoning changes in the city and affects two of the most stable neighborhoods in the city. Those of us who live in these neighborhoods value green space, we value parks, libraries, churches, community centers that provide healthy and attractive places to walk, gather, play games and breathe. Building apartment buildings to house at least 100 people would change everything. Even without the spot zoning issue, making a drastic change in zoning is not wise and healthy for the city of Canton. Number two, marketing the development as addressing the housing needs for seniors who live on fixed incomes, housing subsidies or live with disabilities may sound worthwhile but doesn’t address the larger issues of housing problems throughout Stark County. All over the city and county there are existing apartment buildings, schools, churches and homes that could be rehabbed to provide better housing options, better than new structures, three story buildings where residents’ safety and well being would be dependent on elevators, stairs, careful management and security. Seniors are not a commodity that developers should take advantage of as a business venture. They deserve to live in a healthy environment that communicate… that encourages community relationships, exercise, support and a healthy lifestyle. Ask these seniors what they want. We need to put their needs first, not businessmen with the opportunities for profit. Housing issues should be addressed by our city leaders with vision and research before jumping into a business proposal like this that could well become a safety hazard and extra expense for the city. Finally, City Council Members represent the city… citizens of Canton and we expect for you to make good thoughtful decisions. We have decided to live and stay in Canton City because we love our homes, we love our neighborhoods, we value the services that the city provides. We participate in our elections because we care about the decisions that are made to keep our neighborhoods safe, to encourage good planning and to protect the well being of all our citizens regardless of economic status and age. Could you please state your name and residential address, please. JOE RYAN: Yes, my name is Joe Ryan. Um, I reside at 3718 Arnold Avenue NW in Canton. Um, I’m here and representing the House of Loretto. Uh, Sister (inaudible) prepared this letter she’d like me to read. Um… The Congregation of the Desi… of the Devine Spirit owns and operates the nursing home, House of Loretto, located on Harvard Avenue across from the property being considered for zoning from community COUNCIL PROCEEDINGS JOURNAL 110 JOURNAL PAGE 225 MINUTES OF THE MEETING APRIL 25, 2022 service to planned multi-family residential. The Sisters are not able to come this evening. They have asked me to read the following statement. We have several issues regarding the proposed rezoning which the Law Department has already ruled as an illegal spot zoning change. Historically, Canton set apart the property of the old county farm specifically for community service. It is a beautif… it is a beautiful and worth preserving testimony to the multi-cultural nature of our city that the Jewish community, the Greek and Romanian Orthodox communities, the Christian denomination, the Assembly of God and the Church of the Nazarene, as well as the Christian Scientists, the Kingdom Center and Malone University, and of course our nursing home all share the same neighborhood. There is a matter of precedent so that a change in this one parcel could more easily open the door to the rest of the property. Nickelplate Realty owns the property in question and they own the remaining parcels to the north up to Route 62, and since they share the same statutory agent which holds the parcels directly to the south, we do have reason to be concerned. Safety is a major issue, the proposed buildings will have open parking and no security. Catalytic converter theft is already an issue in our neighborhood and Market Heights. Uh… an opening parking lot unwatched is an invitation to more crime. Um… and that includes St. Haralambos and Malone University, of course, lots of cars over there. Uh, the developer stated at a previous meeting that the residents can watch out their windows. Okay, that’s… that’s a real secure… security plan there, but that’s just my own opinion of course. Um, subsidized housing by any… any other name is subsidized housing. From the plans the developer shared, there will be very little within the development to serve the needs of the residents. There may be a part time manager and another employee that services the units, but where is the nearest grocery store? I really don’t think it’s walking distance. Gas stations, drug stores. While we cannot judge, we have a strong sense that the four profits corporations plan to plan a housing development in the middle of a non-profit community service zone is not totally altruistic. There is no objectively measured benefit to the city of Canton itself. There are other areas of the city with already suitable zoning where the senior population can be served. And that concludes the letter from the Sisters. PRESIDENT SHERER: Could you please bring your remarks to a close, please. JOE RYAN: Uh, they are closed. PRESIDENT SHERER: Thank you. PRESIDENT SHERER: No, I’m talking to the gentleman up front. PETE SCHWIEGERAHT: I didn’t say a thing. PRESIDENT SHERER: So, is there anybody else in the audience wishing to speak for or against this Ordinance, please step forward. JONATHAN LALEWICZ: My name is Jonathan Lalewicz. I live at 327 30th Street NW, Canton. So, I can see proposed development from my house so I’m probably closer to it than probably anybody here, I don’t know. But, um… I… I think this is a clear case. We’ve seen the maps and the pictures of a spot zoning COUNCIL PROCEEDINGS JOURNAL 110 JOURNAL PAGE 226 MINUTES OF THE MEETING APRIL 25, 2022 change. We know the primary beneficiary of the zoning change will be the developer and the land owner. The city of Canton seeks to gain two probably low paying jobs from this entire development. Uh… if anybody here, if you are not in favor of the zoning change, could you please stand up. So, these are, you know, the neighbors of Canton. These are the people who have chosen to live in the city. Many of these people could live elsewhere. So we are here by choice because we want to support the city. We like our neighborhoods and we like our homes. I would like you to respectfully consider to deny the zoning change. Thank you. PRESIDENT SHERER: Thank you. KIM PEREZ: I’d just like… I’d like to talk about some memory. I used to be a councilman in a downtown ward back years ago. And those areas, the senior high rises were a place that you wanted to move. They had activities, they had dinners, you can go entertain, you could do things. (Brief pause while sound system is checked) So we had the Canton Towers, we had the Downtowner, we had Metropolitan Arms, we had Mayfield Center. Many of you remember Mayfield Center where you used to be able to go in and talk to people and converse and… when it was under the Steelworkers and it was a private firm it was a good place to be. People enjoyed being there. Congress somehow changed the rules that now does not let a senior center remain a senior center. Anybody that’s on SSI or SSD is qualified for vouchers that can move in. And Metropolitan Arms or Cherrie Turner Towers, as it’s called today, there is a picture of nine people. These nine people are not welcome in the building. So I’m thinking that’s probably not a safe building when they have to put a picture up of nine different individuals to go into the building. So I think for the best interests of the city is look for something where there’s a bang for the buck. I mean, doctor’s office, dentists, stuff like that I think works, but I’m not quite sure that this housing project works for our neighborhood. Well, I… I personally am sure, but I’m not quite sure the city needs to add to already crime ridden problems that we’re having currently. PRESIDENT SHERER: Thank you. PRESIDENT SHERER: Thank you. MARY MERTES: This is my first time at a City Council meeting. And I would tell you… PRESIDENT SHERER: Can… can you speak into the mic just a little bit. MARY MERTES: This is my first time at a City Council meeting, and I would tell you my concern is for tax dollars. I have recently in the last several years watched business owners, lawyers and well paying job people move out of our neighborhoods because of the crime, because of different things that are going on. We are choosing to live here and you get our tax dollars for that reason. People want to move to Green, they want to move to North Canton, and we are choosing to stay here and you’re getting our tax dollars. This first ordinance is an ordinance which upholds the Planning Commission’s recommendation and denies the zone change. If you wish to deny the zone change, you will vote yes. PRESIDENT SHERER: Member Giavasis. MEMBER GIAVASIS: Mr. President, I have a question for the Law Director. Madam Law Director, there’s been some discussion about the existing multi-family use around this proposed facility. It’s my understanding that those are zoning exempt because they’re non-profit or they’re some type of form or religious or Christian use? LAW DIRECTOR BATES AYLWARD: Um, the (inaudible, mic cuts out)… the dormitories and the nursing home are permissible uses in a community service designation. PRESIDENT SHERER: Are there any additional remarks? MEMBER MORRIS: Mr. President. PRESIDENT SHERER: Member Morris. MEMBER MORRIS: Two words, Diplomat, Embassy. Both in Ward 9, both started out senior high rise. They are now owned by slum lords. I have trouble getting code enforcement in these buildings, police can’t get up on the upper floors, they gotta be buzzed in. I get hit with numerous, numerous complaints. So let’s go to the Comprehensive Plan. How do we keep our senior citizens in their homes longer? Okay, it was also in there about spot zoning. So, Market Heights, it’s getting older. Yeah, they’re protective of their neighborhood. But we should be looking at programs to address the larger housing problems that we face in the city by keeping our seniors in their homes longer. I… I don’t see this as a benefit to the comp… the community, another high rise right at the entrance of what I call a gem of a park. Weis Park is the best park in the city. Member Mariol may disagree because he has some pretty nice parks over by the Hall of Fame, but you will not find a park with as much for families and recreation as you will at Weis Park. So I am going to stay fed… us… stand with my constituents in Ward 9 and I would ask that you would support me, and I am voting against this zone change and would strongly encourage the rest of you to do so. Our police can be better with better training and understanding that not everyone they encounter in their duty are bad people, but are good people making bad decis… decisions and choices. Perhap… perhaps police should be selected from our local area rather than outsiders who have never seen or encountered people from different cultures or skin tones. Police are afraid and really don’t know what to expect. Our local government should be meeting with the community to see how to make these encounters better for all concerned. Um, I do understand that there has been some money poured into some of the summer camps, and if the children between those ages, they’re credit deficit and they’re required to go to summer school, that they’re also eligible for those job programs. But in my niece and my nephew’s case, who are 15 and 16, they go to school, they get good grades, they don’t have to go to summer school, they can’t find a job. There’s no summer job program for them because they don’t go to summer school. Now, I have reached out to the two programs that were listed in The Repository and they also solidified that if they are not in summer school, they do not qualify for a summer job. Um, also reached out to McKinley High School. They also solidified the same thing. So what message are we sending to these kids ages 15 through 18 who need these jobs, and also need something to do with their summer instead of just having all this free time. So, that’s my question. Fifteen and sixteen year olds can’t find a summer job unless their credit deficit, not doing what they’re supposed to do in school, we’re sending the wrong message. We cannot cater to one group and not to the other. We have to invest in our kids all the way around. So my question tonight is, where are the summer job programs for these kids between the ages of 15 and 18? Thank you. So while we were sitting here, I just want to let everybody know Andy Roth is working after hours and he literally posted, I got on my e-mail, the Canton City Hall assessment which of course will involve a total assessment of our HVAC systems and what we can do differently. So while we are here, Andy is solving our issue. So I wanted to give Andy props and let everybody know that. Better days are coming. PRESIDENT SHERER: Yeah. Thank you, Service Director. Is there any other Miscellaneous Business? …Hearing none, Leader. MEMBER SMUCKLER: Mr. President, as I’ve been doing as we go along here… most people will think the zone change was the main thing that happened here this evening, but I think being able to take care of the streets 52 weeks a year is the main thing that happened to the neighborhoods this evening. And I’m excited that no longer will we throw cold patch that gets eaten out within hours and we’ll be using hot patch to patch streets. Also maybe we can get rid of Mr. Mariol’s Canton South pebbles too. (Inaudible voices) And I also want to thank everybody here in Council, as I talked to you this evening and the vote on the Hall of Fame Village.
