Gretchen Mercer, City Clerk City of Canyon City Commission Meeting May 1, 2017 The City Commission of the City of Canyon met in regular session at 5:30 p.m. in the City Commission Chambers of the Civic Complex. Mayor Quinn Alexander presided over the meeting with the following Commissioners in attendance, David Logan, Joseph Shehan and Justin Richardson. Mayor Pro-Tem Gary Hinders was unable to attend. Also present were the following City Staff: City Manager Randy Criswell, Assistant City Manager Chris Sharp, Assistant City Manager for Special Projects Jon Behrens, Director of Code Enforcement Danny Cornelius, Public Works Director Dan Reese, Chief of Police Dale Davis, and Parks and Recreation Director Brian Noel. Item 1. Call to Order. Mayor Alexander called the meeting to order at 5:30 p.m. Item 2. Invocation. Commissioner Richardson gave the invocation. Item 3. Pledge of Allegiance. The Pledge of Allegiance was led by Corporal Ricky Cash of the Canyon Police Department. Item 4. Public Comment – Comments from Interested Citizens. No Public Comments were made. Item 5. Approval of Minutes of the Meeting of April 17, 2017. Commissioner Logan moved, duly seconded by Commissioner Richardson, to approve the minutes of April 17, 2017 as presented. Motion carried unanimously. Item 6. Proclamation Honoring Canyon Lady Eagles Basketball Team for 4-Peat. Mayor Alexander presented a proclamation honoring the Canyon Lady Eagles on their 4th Consecutive State Championship. Coach Lombard and team members were present to accept the proclamation. Item 7. Consent Agenda: It is recommended that the consent agenda be approved with one motion. A. Second and Final Reading of Resolution No. 06-2017, A Resolution of the City of Canyon Commission of the City of Canyon Approving Funding Allocation of $16,000. The Funding will Upgrade Public Spaces in the Canyon Area Library. The Project Benefits the Community and is Considered Enhancement of the Quality of Life in Canyon. City Commission Meeting May 1, 2017 Page 2 of 3 B. Second and Final Reading of Resolution No. 07-2017, A Resolution of the City Commission of the City of Canyon Approving Project Funding Agreement Between Ruthette’s LLC and Canyon Economic Development Corporation Regarding Direct Financial Assistance for a Project Located at 1512 5th Avenue, Suite 202, Canyon, Texas. The Funding is Based on New Business Development. C. Second and Final Reading of Resolution No. 08-2017, A Resolution of the City Commission of the City of Canyon Approving Additional Funding in the Amount of $50,000 for the Small Business Assistance Fund. The Fund Was Established October 4. 2010, (RESOLUTION NO. 13-10) As Part of the Canyon Economic Development Corporation. After discussion, Commissioner Shehan moved, duly seconded by Commissioner Logan to approve the consent agenda as presented. Motion carried unanimously. RESOLUTION NO. 06-2017 RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CANYON APPROVING FUNDING ALLOCATION OF $16,000. THE FUNDING WILL UPGRADE PUBLIC SPACES IN THE CANYON AREA LIBRARY. THE PROJECT BENEFITS THE COMMUNITY AND IS CONSIDERED ENHANCEMENT OF THE QUALITY OF LIFE IN CANYON. RESOLUTION NO. 07-2017 RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CANYON APPROVING PROJECT FUNDING AGREEMENT BETWEEN RUTHETTE’S LLC AND CANYON ECONOMIC DEVELOPMENT CORPORATION REGARDING DIRECT FINANCIAL ASSISTANCE FOR A PROJECT LOCATED AT 1512 5TH AVENUE, SUITE 202, CANYON, TEXAS. THE FUNDING IS BASED ON NEW BUSINESS DEVELOPMENT. RESOLUTION NO. 08-2017 RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CANYON APPROVING ADDITIONAL FUNDING IN THE AMOUNT OF $50,000 FOR THE SMALL BUSINESS ASSISTANCE FUND. THE FUND WAS ESTABLISHED OCTOBER 4, 2010 (RESOLUTION NO. 13-10) AS PART OF THE CANYON ECONOMIC DEVELOPMENT CORPORATION. Item 8. Report and Presentation from WTAMU Criminal Justice Students on Police Department Assessment and Analysis. The WTAMU Criminal Justice class and Professor Dr. Harry Heuston presented an analysis evaluating multiple aspects of the Canyon Police Department. This was a presentation only with no action needed. Item 9. Recycling Update as Per Commission Goals. City Commission Meeting May 1, 2017 Page 3 of 3 Assistant City Manager for Special Projects Jon Behrens gave a report on recycling possibilities as a result of goals adopted by the City of Canyon Commission for 2017. After discussion, the Commission directed staff to further pursue the possibility of recycling cardboard in the city. Item 10. Consider and Take Appropriate Action on Adoption of Resolution No. 10-2017, A Resolution of the City Commission of the City of Canyon Adopting a Municipal Policy Relating to Community Gardens and Use of the Public Water Supply on Privately Owned Community Gardens and Rental of Garden Plots on City Owned Land. City Manager Randy Criswell presented Resolution No. 10-2017 for consideration. Mr. Criswell said as directed at the April 17, 2017 meeting, City Attorney Chuck Hester prepared Resolution No. 10-2017 to officially establish guidelines in regard to Community Gardens and City Garden Plot Rentals. Mr. Criswell stated that the question had come up regarding the free tap that will be made at the Community Garden(s). He stated that in the event that the Community Garden ceases to be such, and the tap becomes used for any purpose other than a Community Garden, whoever sets up service for the use of that tap will be charged the full cost of the tap at that time. After Discussion, Commissioner Shehan moved, duly seconded by Commissioner Richardson to adopt Resolution No. 10-2017 as presented. Motion carried unanimously. RESOLUTION NO. 10-2017 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CANYON ADOPTING A MUNICIPAL POLICY RELATING TO COMMUNITY GARDENS AND USE OF THE PUBLIC WATER SUPPLY ON PRIVATELY OWNED COMMUNITY GARDENS AND RENTAL OF GARDEN PLOTS ON CITY OWNED LAND. We contracted with the Randall County Election Administration for our May 6, 2017 General Election. They did a great job and are to be commended on the efficiency of their staff. The canvass is the official tabulation of the election results that includes early voting, votes cast on election day and Absentee Ballots (if any are submitted). Resolution No. 12-2017 for the Official Canvas of the May 6, 2017 General Election and the Unofficial Cumulative Report provided by the Randall County Election Administration is provided. Please let me know if you have any questions on the report and I’ll be happy to answer them and provide your question with the answer to all. It is Staff’s Recommendation that Resolution No. 12‐2017 be adopted accepting the Results of the May 6, 2017 General Election. City of Canyon  RESOLUTION NO. 12-2017 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CANYON, TEXAS CANVASSING THE RETURNS AND DECLARING THE RESULTS OF A GENERAL ELECTION HELD MAY 6, 2017 FOR THE PURPOSE OF ELECTING MAYOR PLACE 1, AND COMMISSIONER PLACES 2, 3, 4, AND 5. Congratulations and welcome to our new Commissioners; Cody Jones, Paul Lyons and Roger Remlinger. Thank you to Gary Hinders, our new Mayor and Justin Richardson for continuing to serve Canyon. I also want to thank Joe Shehan and David Logan for their willingness to serve another term and for running a great campaign. We appreciate all you have done for the City of Canyon. I have completed the Certificate of Unopposed Candidates for Mayor Place 1 and Commissioner Places 4 and 5. The Mayor and Each Commissioner will be presented a Certificate of Election as prescribed by the Secretary of State. You may keep this or I can keep it with my files. As per the City of Canyon Charter; “The Commission shall elect a Mayor Pro-Tem who shall act as Mayor during the absence or disability of the Mayor, and if a vacancy should occur, shall become Mayor until the next regular election”. We will have a piece at paper at your place and you can write down your nomination. We will go with majority. In the case of a tie, we will go with a show of hands. Misty Rueda is leading an effort to get out a Community Survey to get feedback about Higher Education in the Area. A printed copy is attached. Misty is wanting to get out the word about this survey, and I suggested that one good way would be to show it to the City Commission in a public meeting. I also felt like we could link it on our website and Facebook page as well. She’ll be here at the meeting to present and discuss the Survey with you. The objective of this planning process is to involve the community in a process which will result in a document that will guide the growth and development of Canyon over the next 10 to 20 years. Through this process a variety of issues will be examined, including regulatory controls, land uses, housing, parks, community character, urban design, transportation, environmental factors, and public facilities. Freese & Nichols (F&N) has been selected to lead Canyon through this planning process. F&N will work with the City in an effort to develop a process which will be centered on community engagement. This plan will reflect the characteristics and values that Canyon citizens want reflected in their community. One of the cornerstones of this process is the Comprehensive Plan Advisory Committee (CPAC). The CPAC will meet with F&N, City leaders and staff throughout the planning process. The CPAC is the small group that will assist F&N as they identify the key ideas that surface from community engagement activities, interviews with City leaders and staff members. The CPAC will represent Canyon citizens throughout the process. We anticipate the CPAC meeting at least four times. Members will also be encouraged to participate in as many of the community engagement activities as they can. Based on conversations with other cities, F&N suggestions, and research, I would like to make the following suggestions related to the composition of the CPAC:  1 - City Commissioner – Appointed by City Commission  2 - P&Z members – Nominated by the P&Z Commission  1 - Parks Committee member – Nominated by the Parks Committee  1 - CEDC Board member – Nominated by CEDC Board  1 - Chamber of Commerce member – Nominated by Chamber Board  1 - CISD representative – Nominated by the Superintendent  1 - WTAMU representative - Nominated by the President  5 to 7- Citizens from various backgrounds – Appointed by City Commission Example: Banker, Realtor, Builder, New Resident, Retired, Younger Generation, Business Person, Pastor, Stay at Home Parent This group will play a significant role as they will be the group that will assist F&N in sorting through the comments/suggestions/dreams that come out of the public meetings. This group should be City of Canyon  AGENDA representative of the community and it should have no more than 15 members. These committee meetings will be led by F&N staff and will cover a great deal of information at each meeting. In order to keep the initial stages of the Comprehensive Plan process moving forward it is important that the selection of this committee be made in a timely manner. At this time it is staff’s recommendation that:  Staff be instructed to immediately begin working with all of the necessary groups/committees to seek their nominations and be prepared to present the slate of nominations to the City Commission on June 5  City Commission develop a plan for the appointment of the citizens from various backgrounds  CPAC is appointed at the June 5 City Commission meeting With appointments at the June 5 meeting preparations can begin for the first round of meetings with F&N later in June. The first visit from F&N will include a Kick-off meeting, Stakeholder interviews, Initial CPAC meeting, and the first Public meeting.
