Mayor Gary Hinders presided over the meeting with the following Commissioners in attendance, Mayor Pro-Tem Justin Richardson, Cordell Jones, and Paul R. Lyons. Commissioner Roger Remlinger was unable to attend. Also present were the following City Staff: City Manager Randy Criswell, Assistant City Manager Chris Sharp, City Secretary Gretchen Mercer, Director of Public Works Dan Reese, Police Chief Dale Davis, Business and Community Development Director Evelyn Ecker, Assistant City Manager for Special Projects Jon Behrens, Safety Director Tony Lawson, Code Enforcement Director Danny Cornelius, and City Attorney Chuck Hester. The Pledge of Allegiance was led by Boy Scouts from Troop 3 and students from Canyon Intermediate School. Item 4. Approval of Minutes of the Meeting of November 6, 2017. Mayor Pro-Tem Richardson moved, duly seconded by Commissioner Jones, to approve the minutes of November 6, 2017 as presented. Motion carried unanimously. Item 5. Public Comment – Comments From Interested Citizens. No comments were made. Item 6. Consider and Take Appropriate Action on Presentation from WTAMU Pertaining to Schematic Design for Future of Russell Long Boulevard. City Manager Randy Criswell introduced WTAMU Vice President for Business and Finance, Randy Rikel and WTAMU President Dr. Wendler. Mr. Rikel gave a presentation of plans for Russell Long Boulevard that included a pedestrian mall creating crossings and pathways around the sports complex including the proposed football stadium. Dr. Wendler and Mr. Rikel stated they had visited with TxDOT and the A&M property managers and all felt it would be better for the City of Canyon to take over management of Russell Long Blvd. due to the working relationship between WTAMU and the City of Canyon. Item 7. Consider and Take Appropriate Action on Award Bid for East Elevated Tank Painting. City Commission Meeting November 20, 2017 Page 2 of 4 Director of Public Works Dan Reese presented bids for the painting of the East Elevated Tank. Mr. Reese stated bids for repainting the East City of Canyon water tank were received and opened November 9, 2017 with 4 bids received. After discussion, Commissioner Lyons moved, duly seconded by Commissioner Jones to award the base bid of $493,053.00 and alternate bid of $10,950.00 to the low bidder, Tank Pro, for a total of $504,003.00 as recommended. Motion carried unanimously. Item 8. Conduct a Public Hearing and Consider and Take Appropriate Action on Ordinance No. 1074, An Ordinance Amending Chapter 156, zoning Code of the City of Canyon Code of Ordinances, Table 1-1, Summary Use Chart, to add Smoke Lounges/Retail Stores as an Allowed Use by Specific Use Permit in the RC-1, RC-2, I-1, and I-2 Zoning Districts; Amending Section A.02 Terms to Add Terms for Smoke Lounges/Retail Stores. Director of Public Works Danny Cornelius presented Ordinance No. 1074 for consideration. Mr. Cornelius stated the City of Canyon had received an inquiry regarding a Hookah Lounge in Canyon. Mr. Cornelius said the current Summary Use Chart in the Zoning Code does not list Hookah Lounge or anything similar. Mr. Cornelius stated the request was taken to the Canyon Planning and Zoning Commission for interpretation as to the zoning classification it should be placed. Mr. Cornelius stated the Planning and Zoning Commission agreed unanimously to recommend combining “Hookah/Smoke Lounges, Retail Electronic Cigarette/Vaporizer Stores” allowed by a Specific Use Permit in RC-1, RC-2, I-1, and I-2 Zoning Districts. Mayor Hinders opened the Public Hearing. There being no comment, Mayor Hinders closed the Public Hearing. City of Canyon REGARDING ITEM 7a AGENDA To: Mayor and City Commission From: Casey Renner and John Haun Date: November 27, 2017 Re: Palo Duro Creek 2017 Report 2017 was a busy year for Palo Duro Creek Golf Course. The golf course itself was in wonderful shape. John and his crew worked hard all year to make sure it looked it’s’ best. PDC hosted 43 outside events, 20 Thursday Night Scrambles, 9 junior and high school events and 10 Jr. PGA matches. In those 43 outside events, over $150,000 was raised for charities or other non-profit entities. We are extremely proud of our Jr. PGA program. This year, we had 45 players participate in a 10 week program. This number is up from 31 last year. Because of our large group, we were able to create our own league and not have to play in the Amarillo league this year. We also created our own All Star team and they got to participate in Lubbock (which we ended up losing our first match, but it was a great experience!). We believe this Jr. League program will continue to grow the game for Canyon and PDC. As you can see, in the “playing months” of West Texas, Palo Duro Creek is a very busy place. Rounds were down slightly from last year but due to our $5.00 increase in green fees for 2017, our revenues increased. We are looking at 2018 being a busy year and if the weather stays favorable, we will see in an increase in rounds for the next year. The August rainfall was the second most rainfall in history and August temperatures were cool, ranging in the 80’s with a few low 90’s. There were a number of days in August that we didn’t even run the irrigation system. The total rainfall/moisture for the year was around 28.5”. This is a fact: there was 2.15” more rain at #13 green than at #2 green. We still have adequate subsoil moisture but we have been dry the past 6 weeks and are in need of some moisture. Tree trimming continues again this fall/winter. We currently have trimmed 28 Siberian elm trees with the expectation of trimming 25 more after the first of the year. With over 800 large elm trees on the course this is a never ending project. We have planted more new trees on the course with the majority being conifers. We planted 15 Pinyon pine trees and 8 deciduous trees. I hope to continue this in the future. There were no new major irrigation additions done this year. The main emphasis was on continued repair of existing irrigation system and a new 3” main installed across the walk bridge at #6 green. This was done to allow us to have a “loop” system for the area of #2/#6 green area. This results in increased water volume and pressure. We also had to do it so we could water during the construction/installation of the new overflow drain in the creek dam located at #2 hole. A new overflow drain was installed in the creek dam at hole #2. This was done in January/February so as to not disrupt play. We had to divert carts and walkers back south around the creek to route them to #2 green after teeing off on #2 tee. I am extremely happy with the new overflow drain because it keeps the water level in the creek at a constant level. No leaking. It also eliminates the chance of a cave-in with possible injury and loss of carts. All greens are in great shape except #8 green, which I would categorize as in good shape. We continue to have percolation issues with this green. It requires very judicious watering and the use of a special fertilizer. This is caused by the location of the green being “tucked” back in a corner with housing in close proximity causing more morning shade and less daily air flow across the green. In November of 2016 we purchased a trained “goose” dog to haze the geese. Lass has done a very good job of goose control this past year. As of November 27, there are no new geese that have come back to the course. There are only 4 geese on the course right now. Two of the geese are Canada City of Canyon  AGENDA geese that have broken wings that can’t fly and the other two geese are Russian geese that belong to Spanky Assiter. Lass just had her yearly checkup and is in excellent condition. She also is “chipped” for identification and is current on all her shots. This is a great investment for the golf course. The irrigation system continues to be the biggest maintenance issue each year. Once again, we have repaired numerous leaks and replaced many heads/valves this past year. This will only continue to get worse each year. We have just received our new equipment from Toro and Vermeer. This new equipment will allow us to maintain the entire golf course much more efficiently and effectively. The mowing procedures and patterns will change next year due to this new equipment. I have been a superintendent for 24 years and the current staff and summer crew that I had this year has been one of the best. I am encouraged that this will continue and we will forge on to make PDC the best public course in the area. Here is a main list of the continued capital needs at the golf course. A new irrigation system, a master plan, expansion/renovation of the club house, continued parking lot improvements, new bridges, new cart storage building, new bathroom on the front nine, a wash area for equipment. In summary, we continue to increase our turf grass cover and improve playability and aesthetics. Thank you and we look forward to 2018. City of Canyon REGARDING ITEM 8 AGENDA To: Mayor and City Commission From: Chuck Hester, City Attorney Date: November 21, 2017 Re: Consider and Take Appropriate Action on Ordinance No. 1075 Repealing Section 70.07 of the Code of Ordinances Prohibiting Electronic Messaging While Driving. ________________________________________________________________________ As you may recall, Judge Splawn, Sheila Seymour Roach and I recently updated some highlights of legislation affecting municipal courts. Among those legislative changes, HB 62 was adopted with an effective date of September 1, 2017 preempting the municipal regulation of wireless communication devices by operators of motor vehicles. Our police department began to enforce the state law instead of our ordinance on the effective date of the new amendments to the Transportation Code. It is my recommendation to adopt Ordinance No. 1075 repealing our Code section 70.07 to avoid possible confusion and because it is no longer necessary. City of Canyon  1 ORDINANCE NO. 1075 AN ORDINANCE OF THE CITY OF CANYON, TEXAS, REPEALING §70.07 OF THE CODE OF ORDINANCES PROHIBITING ELECTRONIC MESSAGING WHILE DRIVING THROUGH THE USE OF ELECTRONIC WIRELESS COMMUNICATION DEVICES; AND, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Commission of the City of Canyon previously adopted Ordinance 960 prohibiting the use of electronic messaging through wireless communication devices while driving on the streets and public rights of way; and, WHEREAS, the Texas Legislature has now preempted municipal regulation of the use of electronic wireless communication devices by adoption of HB 62 effective September 1, 2017 amending Texas Transportation Code §521.161, §545.424, §545.425, §545.4251, §545.4252 and §708.052; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CANYON, TEXAS; SECTION 1: The Code of the Ordinances of the City of Canyon is hereby amended by repealing section 70.07 entitled “Prohibition of Electronic Communication While Driving”. SECTION 2: In lieu of prosecution under the former code section 70.07 violators will be prosecuted under Texas Transportation Code Sections 545.424, 545.425, 545.4251, and 545.4252. Upon conviction, the municipal court shall assess the operator a fine of not less than $25 and not more than $99 for the first offense. If the evidence shows at trial of the offense the operator has been previously convicted at least one time of an offense under one or more of the above-enumerated sections, the Defendant shall be assessed a fine of not less than $100 and not more than $200. City of Canyon  ORDINANCE NO. 1073 ANNEXING TERRITORY TO THE CITY OF CANYON KUHLMAN AND SONS, LP, a Texas Limited Partnership CANYON EAST UNIT 6 AN ORDINANCE OF THE CITY OF CANYON, TEXAS, ANNEXING THE TERRITORY HEREIN DESCRIBED TO THE CITY OF CANYON IN RANDALL COUNTY, TEXAS, EXTENDING THE BOUNDARY LIMITS OF THE CITY OF CANYON TO INCLUDE THE PROPERTY HEREIN DESCRIBED WITHIN THE SAID CITY LIMITS, AND GRANTING TO ALL THE INHABITANTS OF SAID PROPERTY ALL THE RIGHTS AND PRIVILEGES OF OTHER CITIZENS AND BINDING SAID INHABITANTS BY ALL OF THE ACTS, ORDINANCES, RESOLUTIONS, AND REGULATIONS OF SAID CITY. WHEREAS, the TEXAS LOCAL GOVERNMENT CODE and the municipal charter of the City of Canyon authorizes the annexation of the territory described in this Ordinance subject to the laws of the State of Texas; and, WHEREAS, the procedures prescribed by the TEXAS LOCAL GOVERNMENT CODE and the municipal charter of the City of Canyon and the other laws of the State of Texas have been duly complied with and followed with respect to the annexation of the following described territory, to wit: METES AND BOUNDS DESCRIPTION 15.21+ ACRES TRACT #1: A 15.21 acre± tract of land in Section 111, Block 6, I. & G.N. R.R. Co. Survey and being a portion of a tract of land as described in that certain instrument of conveyance recorded in Volume 1966, Page 265 of the Deed Records of Randall County, Texas, said 15.21 acre± tract of land having been surveyed on the ground by Furman Land Surveyors, Inc. on June 26, 2017 and being more particularly described by metes and bounds as follows: COMMENCING at a 5/8 inch iron rod with cap stamped “TITUS” found as called for at the most Easterly Southeast corner of Canyon East Unit No. 3, an addition to the City of Canyon, Randall County, Texas, according to the map or plat thereof, recorded under Clerk’s File No. 2014003357 of the Official Public Records of Randall County, Texas, from whence a 1/2 inch iron rod found at the Southeast corner of said Section 111 bears South 00° 00’ 48” West, 2613.82 feet; THENCE North 89° 39’ 17” West along a Southerly line of said Canyon East Unit No. 3, a distance of 5.33 feet to the Northeast and BEGINNING CORNER of the herein described tract of land; THENCE South 00° 09’ 08” West, 407.16 feet to the Southeast corner of this tract of land; 1  THENCE South 44° 19’ 54” West, at 330.00 feet from and parallel with the most Southeasterly line of said Canyon East Unit No. 3, a total distance of 1844.55 feet to the Southwest corner of this tract of land; THENCE North 45° 40’ 06” West, 330.00 feet to a 5/8 inch iron rod found at the most Southerly Southeast corner of said Canyon East Unit No. 3, same point being the most Westerly Northwest corner of this tract of land; THENCE North 44° 19’ 54” East along the said most Southeasterly line of Canyon East Unit No. 3, a total distance of 2071.91 feet to a 5/8 inch iron rod with cap stamped “TITUS” found as called for at a jog corner of said Canyon East Unit No. 3, same point being a Northwesterly corner of this tract of land; THENCE North 67° 20’ 19” East, 36.82 feet to a 5/8 inch iron rod with cap stamped “TITUS” found as called for at a jog corner of said Canyon East Unit No. 3, same point being the most Northerly Northeast corner of this tract of land; THENCE South 89° 39’ 17” East, 44.28 feet to the PLACE OF BEGINNING and containing a computed area of 15.21 acres of land, more or less. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CANYON, TEXAS; SECTION 1.: That the property hereinabove described is hereby annexed to the City of Canyon, a home rule municipal corporation in Randall County, Texas, and that the boundary limits of the City of Canyon be and the same are hereby extended to include the above-described territory within the city limits of the City of Canyon and the same shall hereafter be included within the territorial limits of said City and the inhabitants thereof shall hereafter be entitled to all the rights and privileges of other citizens the City of Canyon and shall be bound by the acts, ordinances, resolutions and regulations of the City of Canyon. The City Secretary of the City of Canyon is hereby directed to file with the County Clerk of Randall County, Texas, a certified copy of this Ordinance to evidence the annexation of the territory herein described and the extension of the city limits of the City to include all such property. If it pleases the Commission, I think we can skip the second meeting in December. Unless something time sensitive comes up, I would recommend we don’t meet again in December. The first Monday in January is New Year’s Day, so we won’t meet then. Also, the 15th is Martin Luther King Day holiday, which could be a holiday for some of you. I would recommend we move meeting dates for January 2018 to January 8 and 22. February 19th is President’s Day, which is a bank holiday and may be a holiday for some other entities as well. The first meeting in February would be February 5, so the second meeting date should be discussed.
