Mayor Gary Hinders presided over the meeting with the following Commissioners in attendance, Mayor Pro-Tem Cody Jones, Randy Ray, Paul R. Lyons and Kelsey Ward. Approval of the Minutes for the Meetings Held On: • November 1, 2021 • November 2, 2021 • November 4, 2021 Commissioner Ray moved, duly seconded by Mayor Pro-Tem Jones to approve the minutes of November 1, 2021, November 2, 2021, and November 4, 2021 as presented. Motion carried unanimously. Item 5. Public Comment – Comments from Interested Citizens. No Comments were made. Item 6. Consider and Take Appropriate Action on All Matters Incident and Related to the Issuance and Sale of “City of Canyon, Texas Tax and Waterworks and Sewer System Surplus Revenue Certificate of Obligation, Taxable Series 2021”, Including the Adoption of Ordinance No. 1148, An Ordinance of the City Commission of the City of Canyon Authorizing the Issuance of “City of Canyon, Texas, Tax and Waterworks and Sewer System Surplus Revenue Certificate of Obligation, Taxable Series 2021’; Providing for the Payment of Such Certificates of Obligation by the Levy of an Ad Valorem Tax Upon All Taxable Property Within the City and a Pledge of the Net Revenues Derived From City Commission Meeting November 10, 2021 Page 2 of 3 the Operation of the City’s Waterworks and Sewer System; Providing the Terms and Conditions of Such Certificate and Resolving Other Matters Incident and Relating to the Issuance, Payment, Security and Delivery of Such Certificate of Obligation; and Providing an Effective Date. Jason Hughes, Managing Director with Hilltop Securities presented Ordinance No. 1148 for consideration. Mr. Hughes stated the issuance of bonds for $4,150,000 would fund the purchase of property for water rights for the City of Canyon. Mr. Hughes stated the Certificates were sold through a competitive bid process with 4 bids received. Mr. Hughes said the best rate was received from Amegy Bank with a rate of 1.9000%. Mr. Hughes stated these bonds would be issued short term and could be paid off early. After discussion, Commissioner Lyons moved, duly seconded by Mayor Pro-Tem Jones to adopt Ordinance No. 1148 approving the issuance and sale of the “City of Canyon, Texas, Tax and Waterworks and Sewer System Surplus Revenue Certificates of Obligation, Taxable Series 2021” in a principle amount not to exceed $4,150,000. Motion carried unanimously at 4:45 pm. ORDINANCE NO. 1148, AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF CANYON AUTHORIZING THE ISSUANCE OF “CITY OF CANYON, TEXAS, TAX AND WATERWORKS AND SEWER SYSTEM SURPLUS REVENUE CERTIFICATE OF OBLIGATION, TAXABLE SERIES 2021”; PROVIDING FOR THE PAYMENT OF SUCH CERTIFICATES OF OBLIGATION BY THE LEVY OF AN AD VALOREM TAX UPON ALL TAXABLE PROPERTY WITHIN THE CITY AND A PLEDGE OF THE NET REVENUES DERIVED FROM THE OPERATION OF THE CITY’S WATERWORKS AND SEWER SYSTEM; PROVIDING THE TERMS AND CONDITIONS OF SUCH CERTIFICATE AND RESOLVING OTHER MATTERS INCIDENT AND RELATING TO THE ISSUANCE, PAYMENT, SECURITY AND DELIVER OF SUCH CERTIFICATE OF OBLIGATION; AND PROVIDING AN EFFECTIVE DATE. Consider and Take Appropriate Action All Matters Incident and Related to the Issuance and Sale of “City of Canyon, Texas, General Obligation Refunding Bond, Series 2021”, Including the Adoption of Ordinance No. 1149, An Ordinance of the City Commission of the City of Canyon, Texas, Authorizing the Issuance of “City of Canyon, Texas, General Obligation Refunding Bond, Series 2021”; Specifying the Terms and Features of Said Bond; Providing for the Redemption of the Obligations Being Refunded; and Resolving Other Matters Incident and Related to the Issuance, Sale, Payment and Delivery of Said Bond, Including the Approval and Execution of a Paying Agent/Register Agreement, A Purchase Letter and a Deposit Letter, and Providing an Effective Date. Jason Hughes, Managing Director with Hilltop Securities presented Ordinance No. 1149 for consideration. Mr. Hughes stated the General Obligation Refunding Bond Series 2021 would refinance the Certificates of Obligation, Series 2012 and General Obligation Bonds, Series 2013 into City Commission Meeting November 10, 2021 Page 3 of 3 one. Mr. Hughes stated the refunding bonds were also sold through a competitive bid with the best rate received from Amegy Bank at a rate of 1.4500%. Mr. Hughes pointed out with combining the 2012 and 2013 bonds into one, and refinancing for the same term, the interest rate was almost half of the current interest rates of 3.00% to 3.50% resulting in savings for the City of Canyon. After discussion, Mayor Pro-Tem Jones moved, duly seconded by Commissioner Ward to adopt Ordinance No. 1149, for the issuance and sale of the “City of Canyon, Texas, General Obligation Refunding Bond, Series 2021. Motion carried unanimously at 4:48 pm. Mr. Sumek continued the process of presenting information and questions for developing a Strategic Plan for the City of Canyon. Item 9. A summary of the Planning and Development Department activity for the 2020-2021 fiscal year is attached along with a 10-year comparison. New single-family home construction reached 131 houses compared to 147 last fiscal year. New commercial/educational construction finished at $2,500,000 with the new Panhandle Plains Student Loan Center being the only project. Permits were issued for 13 commercial remodels and additions totaling $5,631,540. The largest project being modifications to the dairy tower at Lone Star Dairy Products at 401 W Hwy 60 valued at $2,600,000. The total number of police officers working at the Parade is determined by the Canyon Police Department, and in some cases may use planning variables, including: size, location, duration, time and date, the number of streets and intersections blocked or utilized and the need to detour or preempt citizen travel and use of the streets a nd sidewa lks. Cleanliness Applicant shall return public spaces to a clean and orderly condition and replace all City property to its original location. Applicant shall pay for the cost of replacement or repair of any damage to the facility or equipment within that public space caused from the use thereof. Appliance shall refrain from applying any permanent or semi-permanent markings to roads and pedestrian pathways without prior approval. Page 2 oI 7 DamaEe or Loss of Materials When events are not operated or sponsored by the City, the City shall not be responsible for damage or loss of materials used or left in any public spaces and does not assume liability on groups or individuals attending an event within said public spaces. lnsurance No event permit shall be issued for a special event, parade, or race, until the applicant has filed a certificate of insurance, indicating that the required insurance to repair or replace any damage to publicly owned property within or adjacent to the event. lnsurance policy shall be in force and effect duringthe period of time of the event and lists the City as an Additional lnsured. Such insurance policy must be in the face amount of not less than ten thousand dollars (510,000.00), and issued by a company licensed to issue such policy in Texas. This provision may be satisfied by either a special policy issued solely for the event or, by a standing liability policy maintained by the applicant year round, so long as it meets the requirements ofthis subsection. Applicants havethe righttoshow cause when the insurance requirement should be reduced or waived, and to attach such request with the submitted permit application. The City Manager will review requests and may increase, lower, or drop the insurance requirement based upon review of the event application. An applicant may be required to furnish additional liability insurance based upon the type of event, equipment, machinery, location, alcohol related exposures, number of people involved, and other pertinent factors or risks associated with the event. Final determination of the amount of additional insurance necessary will be made by the City Manager. 1) As a condition of a Special Event Permit being issued, the applicant agrees to protect, indemnii/ and hold harmless, the City of Canyon, its officers, agents and employees, from and against suits, actions, claims, losses, liability or damage of any character, and from and against costs and expenses including attorney fees incidental to the defense of such suits, actions, claims, losses, damage or liability on account of injury, death or otherwise, to any person or damage to any property, arising from any negligent act, error or omission of the undersigned, its officers, employees or agents, arising out of, resulting from, or caused by any act occurring as a result of the exercise of the privileges granted by this permit. 2J Applicant agrees that this indemnity agreement is intended to be as broad and inclusive as is permitted by the laws of the state of Texat and that if any portion is held invalid, the remainder shall, notwithstanding, continue in full legalforce and effect. 3) This indemnity agreement contains the entire agreement of the undersigned and the City of Canyon, and may not be modified or altered without the express written consent of the City of Canyon. 4l This indemnity agreement shall be construed in accordance with Texas law and is perforable for all purposes in the County of Randall, State ofTexas. WHEREAS, the passage, promulgation, and enforcement of the provisions herein contained are determined necessary and advisable for the promotion of the general welfare of the community to carry out the governmental powers and police powers delegated to and possessed by the City of Canyon; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CANYON, TEXAS; SECTION 1.: WHEREAS; Title 7 of the Code of Ordinances is amended by adding §72.12 which shall provide as follows: “§72.12 Limitation on Parking During Parades or Special Events. (a.) The City Commission may, by resolution, designate specific dates and times for parades and special events in the City during which times motor vehicles may not be parked or allowed to stand upon or at the side of the roadway between the 1100 Block and the 3400 Block of 4th Avenue in the City. (b.) The City Commission may, by resolution, also restrict or prohibit the parking of trailers upon or at the side of the roadway between the 1100 Block and the 3400 Block of 4th Avenue during parades or special events designated as provided in §72.12(a) above. (c.) Any person who violates a limitation on parking or allowing vehicles or trailers to stand upon or at the side of the roadway imposed by resolution of the City Commission pursuant to this §72.12 shall, upon conviction, be assessed a penalty as provided in §70.99 of this code. If any provision, section, subsection, sentence, clause, or the application of same to any person or set of circumstances for any reason is held to be unconstitutional, void or invalid or for any reason unenforceable, the validity of the remaining portions of this ordinance or the application thereby shall remain in effect, it being the intent of the City Commission of the City of Canyon, Texas in adopting this ordinance, that no portion thereof or provision contained herein shall become inoperative or fail by any reasons of the unconstitutionality of any other portion or provision. The 3rd Monday in December falls on the week of Christmas, As busy as this time is for all and people planning trips out of town, we propose to meet only once the month of December on December 6, 2021. The month of January, city offices will be closed for New Year’s January 3, 2022 and Martin Luther King Day Monday January 17, 2022. We are proposing to meet only once in January, on January 10, 2022. For February, we propose to meeting only once, February 14, 2022. City offices will be close for Presidents Day Monday, February 21, 2022. March 2022 would bring us back to meeting the first and third Mondays.
