City Commission Meeting May 1, 2023 The City Commission of the City of Canyon met at 4:30 pm in the City Commission Chambers of the Civic Complex. Mayor Gary Hinders presided over the meeting with the following Commissioners in attendance, Mayor Pro-Tem Cody Jones, Kelsey Ward, Paul Lyons and Randy Ray. Also present were the following City Staff: City Manager Joe Price, Assistant City Manager Jon Behrens, City Secretary Gretchen Mercer, Director of Public Works Dan Reese, Assistant Public Works Director Chris Enriquez, Water Superintendent Eric Whitten, HR Director Hector Mendoza, Planning and Development Director Lucas Raley, Assistant Planning and Development Director Craig Brown, Planning and Development Building Inspector Stan Barnard, Communications Director Megan Nelson, Fire Chief Dennis Gwyn, Assistant Fire Chief Vince Whitfill, Library Director Carlene Harguess, Economic Development Director Stephanie Tucker, Business and Community Development Admin Assistant Brittney Bates, City Engineer Adolfo Garcia and City Attorney Chuck Hester. Item 1. Call to Order. Mayor Hinders called the meeting to order at 4:35 pm. Item 2. Invocation. Commissioner Ray gave the invocation. Item 3. Pledge of Allegiance. The Pledge of Allegiance was led by Commissioner Lyons. Item 4. Approval of the Minutes of the Meeting of April 17, 2023. Commissioner Ward moved, duly seconded by Commissioner Ray to approve the minutes of April 17, 2023 as presented. Motion carried unanimously. Mayor Hinders presented outgoing Commissioners Kelsey Ward and Randy Ray with an appreciation gift from the City of Canyon in honor of their service as a City of Canyon Commissioner. Item 5. Public Comment – Comments from Interested Citizens No comments were made. Item 6. Consider and Take Appropriate Action on Second and Final Reading of Resolution No. 18-2023, A Resolution of the City Commission of the City of Canyon Approving a Project Funding Agreement Between City of Canyon and Canyon Economic Development Corporation Relating to Direct Financial Assistance for Additional Funding for Kylie Hiner Memorial Playground Project. Director of Economic Development Stephanie Tucker presented Resolution No.18-2023 for the second of two required readings. Ms. Tucker said the Canyon Economic Development Corporation approved project funding for the City of Canyon for additional funding for the Kylie Hiner Memorial City Commission Meeting May 1, 2023 Page 2 of 10 Playground Project for a total funding of $50,000. Ms. Tucker said a public hearing was held at the CEDC meeting April 6, 2023 with no opposition. After discussion, Commissioner Ward moved, duly seconded by Commissioner Ray to approve the adoption of Resolution No. 18-2023 as presented. Motion carried unanimously. RESOLUTION NO. 18-2023 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CANYON APPROVING PROJECT FUNDING AGREEMENT BETWEEN CITY OF CANYON AND CANYON ECONOMIC DEVELOPMENT CORPORATION RELATING TO DIRECT FINANCIAL ASSISTANCE FOR ADDITIONAL FUNDING FOR KYLIE HINER MEMORIAL PLAYGROUND PROJECT. Item 7. Consider and Take Appropriate Action on Second and Final Reading of Resolution No. 19-2023, A Resolution of the City Commission of the City of Canyon Approving a Project Funding Agreement Between Canyon Main Street and Canyon Economic Development Corporation Relating to Direct Financial Assistance for CMS Marketing Campaign. Director of Economic Development Stephanie Tucker presented Resolution No.19-2023 for the second of two required readings. Ms. Tucker said the Canyon Economic Development Corporation approved project funding Canyon Main Street direct financial assistance for a CMS Marketing Campaign for a total funding of $28,000. Ms. Tucker said a public hearing was held at the CEDC meeting April 6, 2023 with no opposition. After discussion, Commissioner Ray moved, duly seconded by Commissioner Ward to approve the adoption of Resolution No. 19-2023 as presented. Motion carried unanimously. RESOLUTION NO. 19-2023 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CANYON APPROVING PROJECT FUNDING AGREEMENT BETWEEN CANYON MAIN STREET AND CANYON ECONOMIC DEVELOPMENT CORPORATION RELATING TO DIRECT FINANCIAL ASSISTANCE FOR CMS MARKETING CAMPAIGN. Item 8. Consider and Take Appropriate Action on Second and Final Reading of Resolution No. 20-2023, A Resolution of the City Commission of the City of Canyon Approving a Project Funding Agreement Between TEXAS Outdoor Musical and Canyon Economic Development Corporation Relating to Direct Financial Assistance for New Audio Equipment and Infrastructure for the Pioneer Amphitheatre in Palo Duro Canyon State Park. Director of Economic Development Stephanie Tucker presented Resolution No.20-2023 for the second of two required readings. Ms. Tucker said the Canyon Economic Development Corporation approved project funding for TEXAS Outdoor Musical for direct financial assistance for new audio equipment and infrastructure for the Pioneer Amphitheatre in Palo Duro Canyon State for a total City Commission Meeting May 1, 2023 Page 3 of 10 funding of $55,000. Ms. Tucker said a public hearing was held at the CEDC meeting April 6, 2023 with no opposition. After discussion, Commissioner Ward moved, duly seconded by Commission Ray to approve the adoption of Resolution No. 20-2023 as presented. Motion carried unanimously. RESOLUTION NO. 20-2023 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CANYON APPROVING PROJECT FUNDING AGREEMENT BETWEEN TEXAS OUTDOOR MUSICAL AND CANYON ECONOMIC DEVELOPMENT CORPORATION RELATING TO DIRECT FINANCIAL ASSISTANCE FOR AUDIO EQUIPMENT AND INFRASTRUCTURE IN THE PIONEER AMPHITHEATRE IN PALO DURO CANYON STATE PARK. Item 9. Consider and Take Appropriate Action on Second and Final Reading of Resolution No. 21-2023, A Resolution of the City Commission of the City of Canyon Approving a Project Funding Agreement Between Canyon Chamber of Commerce and Canyon Economic Development Corporation Relating to Direct Financial Assistance for Annual Independence Day Celebration an Christmas in Canyon Fireworks Displays. Director of Economic Development Stephanie Tucker presented Resolution No.21-2023 for the second of two required readings. Ms. Tucker said the Canyon Economic Development Corporation approved project funding for the Canyon Chamber of Commerce for direct financial assistance for the annual Independence Day Celebration and Christmas in Canyon Fireworks displays for a total funding of $23,000. Ms. Tucker said a public hearing was held at the CEDC meeting April 6, 2023 with no opposition. After discussion, Commissioner Ward moved, duly seconded by Commissioner Ray to approve the adoption of Resolution No. 21-2023 as presented. Motion carried unanimously. RESOLUTION NO. 21-2023 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CANYON APPROVING PROJECT FUNDING AGREEMENT BETWEEN CANYON CHAMBER OF COMMERCE AND CANYON ECONOMIC DEVELOPMENT CORPORATION RELATING TO DIRECT FINANCIAL ASSISTANCE FOR ANNUAL INDEPENDENCE DAY CELEBRATION AND CHRISTMAS IN CANYON FIREWORKS DISPLAYS Item 10. Presentation from City Engineer Updating Status of Current Public Works Projects. City Engineer Adolpho Garcia updated the Commission on the status of current projects within the City of Canyon. Consider and Take Appropriate Action on Ordinance No. 1172, 2023 City of Canyon Subdivision Regulations, An Ordinance of the City Commission of the City of Canyon, Texas, Repealing Ordinance No. 347 as Amended by Ordinance 746, 1084, and 1100 as Well as All Other Ordinances in Conflict Herewith and Adding Updated and Revised Subdivision Regulations of the City of Canyon, Texas; Amending Chapter 9.02 of the code of Ordinances of the City of Canyon, Texas; Providing a Severability Clause, Establishing an Effective Date; and Providing a Penalty for Violation. Director of Planning and Development Lucas Raley presented Ordinance No. 1172 for consideration. Mr. Raley stated with the adoption of the City of Canyon Subdivision Regulations at the April 17, 2023 meeting, the adoption of Ordinance No. 1172 would officially replace the old regulations originally adopted in 1970 in the City of Canyon Code of Ordinances. After discussion Commissioner Ward moved, duly seconded by Commissioner Ray to adopt Ordinance No. 1172 amending the code of ordinances to establish the new subdivision regulations as presented. Motion carried with Commissioner Lyons abstaining. ORDINANCE NO. 1172 2023 City of Canyon Subdivision Regulations AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF CANYON, TEXAS, REPEALING ORDINANCE NO. 347 AS AMENDED BY ORDINANCE 746, 1084, AND 1100 AS WELL AS ALL OTHER ORDINANCES IN CONFLICT HEREWITH AND ADDING UPDATED AND REVISED SUBDIVISION REGULATIONS OF THE CITY OF CANYON, TEXAS; AMENDING CHAPTER 9.02 OF THE CODE OF ORDINANCES OF THE CITY OF CANYON, TEXAS; PROVIDING A SEVERABILITY CLAUSE; ESTABLISHING AN EFFECTIVE DATE; AND PROVIDING A PENALTY FOR VIOLATION. Item 12. Consider and Take Appropriate Action on Ordinance No. 1173, 2021 International Building Code, An Ordinance of the City Commission of the City of Canyon, Texas: Amending the Code of Ordinances of the City of Canyon, Chapter 4, Article 4.02, Division 2 Building Code, 4.02.031 ~4.02.060, to Rescind the 2015 International Building Code; Adopting the 2021 International Building Code Along with Certain Appendix Chapters; Making Certain Amendments Thereto; Providing for Severability; Providing for Repealer; Providing a Penalty; Providing for Publication and Effective Date. Director of Planning and Development Lucas Raley presented Ordinances No’s 1173-1182 for consideration. Mr. Raley stated the City of Canyon traditionally updates the Building Codes as the City of Amarillo does to ensure continuity for contractors working in both communities. Mr. Raley said last year the ISO Building representative for the City of Canyon worked with the Director of Planning and Development and the Building Official to update the questionnaire that determines the rating given to Canyon. Mr. Raley said there was a risk of being significantly demoted in that rating due to the age of the current fire and building safety codes. Mr. Raley stated in order to maintain the City of Canyon ISO rating Canyon could no longer wait on Amarillo. City Commission Meeting May 1, 2023 Page 5 of 10 Mr. Raley said he would present 10 codes for consideration and that the adoption of the codes would put the City of Canyon in good standing with the necessary practices in place ensuring the safety and welfare of Canyon and its citizens through building safety. Mr. Raley said the effective date of all ordinances would be May 16, 2023 allowing for 2 publications in the local newspaper. Mr. Raley the presented Ordinance No. 1173 for consideration. Commissioner Ward moved, duly seconded by Commissioner Ray to adopt Ordinance No. 1173 as presented. Motion carried with Commission Lyons abstaining. Commissioner Ray moved, duly seconded by Commissioner Ward to adopt Ordinance No. 1182 as presented. Motion carried with Commission Lyons abstaining.
