City Commission Meeting May 20, 2024 The City Commission of the City of Canyon met in regular session at 4:30 p.m. in the City Commission Chambers of the Civic Complex. Mayor Gary Hinders presided over the meeting with the following Commissioners in attendance: Mayor Pro-Tem Cody Jones, Robyn Cranmer, Danny Potter and Paul Lyons. Also present were the following City Staff: City Manager Joe Price, Assistant City Manager Jon Behrens, City Secretary Gretchen Mercer, Director of Finance Joel Wright, Canyon Economic Development Director Stephanie Tucker, Director of Public Works Chris Enriquez, Fire Chief Dennis Gwyn, Assistant Fire Chief Vince Whitfill, Director of Planning and Development Lucas Raley, Assistant Director of Planning and Development Craig Brown, Planning and Development Inspector Stan Barnard, Purchasing Manager Beau Boyer, Police Chief Steve Brush, Police Captain Matt Coggins, Water Superintendent Eric Whitten, and City Attorney Chuck Hester. Item 1. Call to Order. Mayor Hinders called the meeting to order at 4:41 pm. Item 2. Invocation. Commissioner Potter gave the invocation. Item 3. Pledge of Allegiance. The Pledge of Allegiance was led by Commissioner Lyons. Item 4. Approval of the Minutes of the Meeting of May 6, 2024. Commissioner Cranmer moved, duly seconded by Mayor Pro-Tem Jones to approve the minutes of April 15, 2024 as presented. Motion carried unanimously. Item 5. Public Comment – Comments from Interested Citizens. No comments were made. Item 6. First Reading of Resolution No. 09-2024, A Resolution of the City Commission of the City of Canyon Approving Project Funding Agreement Between G&P Kahlich Industries, LLC DBA Tireworks Tire Pros and Canyon Economic Development Corporation Relating to Direct Financial Assistance and Job Incentives for New Business in Canyon. Mayor Hinders presented a Proclamation declaring May 5-11, 2024 as Public Service Recognition Week. Mayor Hinders thanked all for their service to Canyon. RESOLUTION NO. 09-2024 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CANYON APPROVING PROJECT FUNDING AGREEMENT BETWEEN G&P KAHLICH INDUSTRIES, LLC DBA TIREWORKS TIRE PROS AND CANYON ECONOMIC DEVELOPMENT City Commission Meeting May 6, 2024 Page 2 of 5 CORPORATION RELATING TO DIRECT FINANCIAL ASSISTANCE AND JOB INCENTIVES FOR NEW BUSINESS IN CANYON. Item 7. First Reading of Resolution No. 10-2024, A Resolution of the City Commission of the City of Canyon Approving Project Funding Agreement Between Canyon Chamber of Commerce and Canyon Economic Development Corporation Relating to Direct Financial Assistance for Fireworks Display for Annual Independence Day Celebration in Canyon. City Attorney Chuck Hester presented information for the proposed creation of an Ordinance allowing the use of Golf Carts within the city limits of Canyon. Mr. Hester stated the information was being provided to gauge the level of interest from the Commission on allowing Golf Carts operation and if so, any restrictions with said operation. Mayor Hinders gave the floor to Jamie Moore – 500 Taylor Lane, Canyon, Texas. Ms. Moore stated her and her husband owned a golf cart and drove it all over town. She expressed the need of an ordinance allowing operation of golf carts legally and strongly suggested school zones be restricted from the use of a golf cart due to visibility issues. Police Chief Steve Brush spoke to the enforcement of any laws associated with golf cart use in Canyon and said an ordinance laying out the rules is needed if any restrictions are wanted that go above Transportation Code requirements and restrictions. Commissioner Lyons stated he felt adoption of an ordinance would just create problems. Mayor Pro-Tem Jones stated there are already rules in place for the legal use of golf carts, Canyon should just pass an ordinance allowing golf carts in Canyon and enforce the laws of the Transportation Code and DMV. After discussion, City Manager Joe Price suggested adopting an ordinance allowing golf carts in the city limits with Police Officers using discretion of misuse using laws already in place, and restrict the use of golf carts in school zones. Mr. Hester said he would bring a proposed ordinance for consideration at a later date. RESOLUTION NO. 10-2024 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CANYON APPROVING PROJECT FUNDING AGREEMENT BETWEEN CANYON CHAMBER OF COMMERCE AND CANYON ECONOMIC DEVELOPMENT CORPORATION RELATING TO DIRECT FINANCIAL ASSISTANCE FOR FIREWORKS DISPLAY FOR ANNUAL INDEPENDENCE DAY CELEBRATION IN CANYON. City Commission Meeting May 6, 2024 Page 3 of 5 Item 8. Consider and Take Appropriate Action on Ordinance No. 1208, An Ordinance of the Canyon City Commission Amending Ordinance No. 1172 as Well as All Other Ordinances in Conflict Herewith Revising the Subdivision Regulations of the City of Canyon, Texas; Amending Chapter 9.02 of the Code of Ordinances of the City of Canyon, Texas; Providing a Severability Clause; Establishing an Effective Date. Purchasing Manager Beau Boyer gave a presentation of the Capital Improvement Plan covering projects that are completed, in progress, upcoming and planned. No action, informational only. ORDINANCE NO. 1208 AN ORDINANCE OF THE CANYON CITY COMMISSION AMENDING ORDINANCE NO. 1172 AS WELL AS ALL OTHER ORDINANCES IN CONFLICT HEREWITH REVISING THE SUBDIVISION REGULATIONS OF THE CITY OF CANYON, TEXAS; AMENDING CHAPTER 9.02 OF THE CODE OF ORDINANCES OF THE CITY OF CANYON, TEXAS; PROVIDING A SEVERABILITY CLAUSE; ESTABLISHING AN EFFECTIVE DATE. Item 9. Presentation of Potential Changes to the Zoning Regulations Map. Planning and Development Director Lucas Raley presented Ordinance No. 1204 for consideration. Mr. Raley stated when the land for Mayra Park Subdivision was annexed, it was found there were two small parcels of land that were deeded to Allen Ebenkamp that is surrounded on three sides by the development and he was assured he would not be required to annex into the city limits as annexation nis voluntary only in Texas. It has been discovered the parcels of land were annexed prior to them being deeded to him. Mr. Raley said Ordinance No. 1204 would clear up the error and disannex the parcels totaling just over a quarter-acre and allow Mr. Ebenkamp’s property to be re- platted as one rectangular lot in Randall County. After discussion, Commissioner Cranmer moved, duly seconded by Mayor Pro-Tem Jones to adopt Ordinance No. 1204 removing real property from the Corporate Limit of the City of Canyon. Motion carried unanimously. Item 10. Consider and Take Appropriate Action on Replacement of Canyon Area Library Roof. Planning and Development Director Lucas Raley presented Ordinance No. 1205 for consideration. Mr. Raley stated the recently adopted backflow prevention program aligns with the 2021 ICC plumbing code. Mr. Raley said the adoption of Ordinance No. 1205 would mandate the regulatory process for backflow prevention of landscape irrigation systems, ensuring the safety of Canyon’s water supply system through testing of residential and commercial irrigation double-check valves every three years. Mr. Raley said this would also provide an alternative enforcement to shutting off water service at addresses of non-compliance due to public health and safety risks. Mr. Raley said Code Enforcement is already testing and seeing many failures. Mr. Raley said the enforcement City Commission Meeting May 6, 2024 Page 4 of 5 process would include getting notices out through mail, social media and other outlets over the course of 24 months. Commissioners ask who would perform the testing and how much would it cost. Mr. Raley stated their department would provide testing providers and each test would run around $120. Mayor Hinders and Commissioners expressed concern of adding more cost to citizens. Mr. Raley reiterated this was to provide an alternative to shutting off the citizens water when a failure occurred during random testing due to creating a public health and safety concern. After discussion Commissioner Cranmer moved to adopt Ordinance No. 1205 as presented. Motion died due to lack of a second. Mayor Hinders suggested the situation is looked into and possibly bring back, but it is too much of a cost to the citizens as presented. Item 11. Consider and Take Appropriate Action Related to City of Canyon Facilities Expansion, Renovations, and Bond Election. Planning and Development Director Lucas Raley presented Ordinance No. 1206 for consideration. Mr. Raley stated this was the 4th petition the City of Canyon has received for release from the Extraterritorial Jurisdiction pursuant to Section 42.102 of Texas Local Government Code. Mr. Raley stated the petition included two tracts owned by RBJ Real Estate, LLC. After discussion, Mayor Pro-Tem Jones moved, duly seconded by Commissioner Cranmer to adopt Ordinance No. 1206, removing real property from the Extraterritorial Jurisdiction of the City of Canyon pursuant to Section 42.023 of the Texas Local Government Code. Motion carried unanimously. Item 12. Consider and Take Appropriate Action on 380 Agreement with The Lumber Yard. Director of Planning and Development Lucas Raley presented an MOU (Memorandum of Understanding) between the City of Canyon and N&B Properties Inc. Mr. Raley stated this agreement formalizes conversations between N&B Properties and the City on agreed responsibilities. After discussion, Commissioner Cranmer moved, duly seconded by Mayor Pro-Tem Jones to authorize the City Manager to sign the MOU with N&B Properties on behalf of the City of Canyon. Motion carried unanimously. Item 13. Consider and Take Appropriate Action on Ordinance No. 1207, An Ordinance of the City of Canyon, Texas, Amending City Commission Meeting Dates From the First and Third Mondays of Each Month to the First and Third Tuesdays of Each Month, Beginning on the Third Day of September, 2024 as the Regular Meeting Time of the Commission of the City of Canyon. City Commission Meeting May 6, 2024 Page 5 of 5 Director of Planning and Development Lucas Raley presented a Draft MOU (Memorandum of Understanding) between the City of Canyon and Brown Construction Services PLLC. Mr. Raley stated Dave Brown, owner of Brown Construction Services, submitted a request for annexation to the City of Canyon for his property at 6701 W. Country Club Rd. Mr. Raley said the property needs access to city water as it will serve as the site of a concrete batch plant and headquarters for the contractor hired to complete the I-27 widening project. Mr. Raley stated it was the recommendation of staff that the agreement be approved so that the landowner can begin the process of extending water service while going through the annexation process as there is a short timeline to set everything up for the highway widening project that will begin very soon. After discussion, Commissioner Cranmer moved, duly seconded by Commissioner Potter authorize the City Manager to sign the MOU between Brown Construction Services PLLC and the City of Canyon. Motion carried unanimously. ORDINANCE NO. 1207 AN ORDINANCE OF THE CITY OF CANYON, TEXAS, AMENDING CITY COMMISSION MEETING DATES FROM THE FIRST AND THIRD MONDAYS OF EACH MONTH TO THE FIRST AND THIRD TUESDAYS OF EACH MONTH, BEGINNING ON THE THIRD DAY OF SEPTEMBER, 2024 AS THE REGULAR MEETING TIME OF THE COMMISSION OF THE CITY OF CANYON. Item 14. Executive Session Pursuant to §551.071 Consultation with Attorney. Mayor Hinders indicated the City Commission would adjourn into Executive Session at 6:44 pm. Item 18. Consider and Take Appropriate Action on Items Discussed in Executive Session. Upon Returning from Executive Session at 7:19 pm, no action was taken. Item 19. Adjourn.
