Thursday, January 27, 2022
Opening: The meeting of the City of Cape May Zoning Board of Adjustment was called to
order by Chairperson Diane Hutchinson at 6:00 PM in the City Hall Auditorium.
In compliance with the Open Public Meetings Act, adequate notice was provided.

Reorganization
Oaths of Office:
Oaths of Office: Members with expiring terms and new member Maureen McDade took the
Oath of Office.
Mrs. McDade was welcomed to the Board by Chairperson Hutchinson and the members.
Chairperson:
Motion made by Mr. Murray to nominate Diane Hutchinson for Chairperson, seconded by
Mrs. Notch and carried 6-0. Those in favor: Mrs. Werner, Mr. Ledwin, Mrs. Notch, Mr. Walsh,
Mrs. McDade, Mr. Murray. Those opposed: None. Those abstaining: Mrs. Hutchinson.
Vice Chairperson:
Motion made by Mrs. Hutchinson to nominate William Murray as Vice Chairperson,
seconded by Mrs. Werner and carried 6-0. Those in favor: Mrs. Werner, Mr. Ledwin, Mrs.
Notch, Mr. Walsh, Mrs. McDade, Mrs. Hutchinson. Those opposed: None. Those abstaining: Mr.
Murray.

Motion made by Mr. Ledwin to appoint Richard King, Esquire, as Board Attorney,
seconded by Mr. Murray and carried 7-0. Those in favor: Mrs. Werner, Mr. Ledwin, Mrs. Notch,
Mr. Walsh, Mrs. McDade, Mr. Murray, Mrs. Hutchinson. Those opposed: None. Those
abstaining: None.
Solicitor King thanked the Board for the appointment.
Board Engineer:
Motion made by Mrs. Hutchinson to appoint Craig R. Hurless, PE, PP, CME of Polistina &
Associates as Board Engineer, seconded Mrs. Notch and carried 7-0. Those in favor: Mrs.
Werner, Mr. Ledwin, Mrs. Notch, Mr. Walsh, Mrs. McDade, Mr. Murray, Mrs. Hutchinson.
Those opposed: None. Those abstaining: None.
Engineer Hurless thanked the Board for the appointment.
Meeting Dates and Time:
Motion made by Mr. Ledwin to adopt the meeting dates and time for the 2022 Zoning Board
of Adjustment, with no change to the meeting time, seconded by Mr. Walsh and carried 7-0.
Those in favor: Mrs. Werner, Mr. Ledwin, Mrs. Notch, Mr. Walsh, Mrs. McDade, Mr. Murray,
Mrs. Hutchinson. Those opposed: None. Those abstaining: None.
Official Newspapers:
Motion made by Mrs. Hutchinson to designate Cape May County Herald and the Press of
Atlantic City as official newspapers for public noticing purposes, seconded by Mr. Murray
and carried 7-0. Those in favor: Mrs. Werner, Mr. Ledwin, Mrs. Notch, Mr. Walsh, Mrs.
McDade, Mr. Murray, Mrs. Hutchinson. Those opposed: None. Those abstaining: None.
Resolutions:
Motion made by Mr. Ledwin to adopt Resolution number 01-27-2022: 1, Accepting Board
Attorney contract, seconded by Mrs. Werner and carried 7-0. Those in favor: Mrs. Werner,
Mr. Ledwin, Mrs. Notch, Mr. Walsh, Mrs. McDade, Mr. Murray, Mrs. Hutchinson. Those
opposed: None. Those abstaining: None.
Motion made by Mr. Ledwin to adopt Resolution number 01-27-2022: 2, accepting the
Zoning Board Engineer contract, seconded by Mrs. Werner and carried 7-0. Those in favor:
Mrs. Werner, Mr. Ledwin, Mrs. Notch, Mr. Walsh, Mrs. McDade, Mr. Murray, Mrs. Hutchinson.
Those opposed: None. Those abstaining: None.

Street, seconded by Mr. Walsh and carried 5-0. Those in favor: Mr. Ledwin, Mrs. Notch, Mr.
Walsh, Mr. Murray, Mrs. Hutchinson. Those opposed: None. Those abstaining: Mrs. Werner,
Mrs. McDade.
Motion made by Mr. Walsh to adopt Resolution number 01-27-2022: 4, Ritz, 1603 New
Jersey Avenue, seconded by Mr. Murray and carried 5-0. Those in favor: Mr. Ledwin, Mrs.
Notch, Mr. Walsh, Mr. Murray, Mrs. Hutchinson. Those opposed: None. Those abstaining: Mrs.
Werner, Mrs. McDade.
Minutes:
Motion was made by Mr. Ledwin to adopt the meeting minutes of December 16, 2021,
seconded by Mrs. Werner and carried 5-0. Those in favor: Mr. Ledwin, Mrs. Notch, Mr. Walsh,
Mr. Murray, Mrs. Hutchinson. Those opposed: None. Those abstaining: Mrs. Werner, Mrs.
McDade.
Motion made by Mr. Murray to adjourn the meeting at 6:12 PM with all in favor.

scheduled meeting in-person to make your public comment.
Further notice is given that this notice and relevant meeting documents are posted with
each Planning Board, and Zoning Board of Adjustment agenda via the Meeting Agendas tab on
the left-hand side of the Cape May City website, www.capemaycity.com, and also posted on the
municipal bulletin board and transmitted to the Cape May Star and Wave, the Cape May County
Herald, and the Press of Atlantic City, as required.
