City of Cape May Planning Board Meeting Minutes Tuesday, May 25, 2021 Opening: The virtual meeting of the City of Cape May Planning Board was called to order by Board Solicitor Richard King at 6:32 PM. In compliance with the Open Public Meetings Act, adequate notice was provided. Roll Call: Mr. Bezaire, Chairperson Absent Mr. Jones, Vice Chairperson Absent Mr. Belasco Absent Mr. Elwell Absent Mayor Mullock Present Deputy Mayor Sheehan Present Mr. Shuler Present Dr. Wolf Present Vacant --------- Mr. Gorgone Alt # 1 Present Mrs. Reed Alt # 2 Present Also Present: Richard King, Esquire, Board Solicitor Craig Hurless, Board Engineer and Planner Karen Keenan, Board Secretary Minutes: Motion made by Mr. Gorgone to approve the meeting minutes of March 23, 2021, seconded by Mayor Mullock and carried 5-0. Those in favor: Mayor Mullock, Mr. Shuler, Dr. Wolf, Mr. Gorgone, Mrs. Reed. Those opposing: None. Those abstaining: Deputy Mayor Sheehan. Discussion: Master Plan Consistency Review of Ordinance No. 424-2021 – An Ordinance Amending Section 525 of the Zoning Code to Prohibit the Operation of All Classes of Cannabis Establishments and Cannabis Distributors Within All Zoning Districts in the City of Cape May Board Engineer and Planner Hurless reviewed his memorandum dated May 20, 2021 and explained that every municipality is dealing with the state act, as they have 180 days to act on prohibiting operations or permitting the operations for a period of five years. Planner Hurless said that City Council’s proposed ordinance is to prohibit operation of all classes of establishments and distributors. He advised the Board that he reviewed the 2019 Master Plan Reexamination and found the proposed ordinance to be consistent with the Master Plan. ------------------------------------------------------------------------------------------------------------------------------------------ City of Cape May Planning Board Minutes, May 25, 2021 1 Members were allotted time for questions and comments. Members agreed with the ordinance’s consistency with the Master Plan. Mayor Mullock shared City Council’s concern that the reaction time of 180 days was not enough time and the default of five years in which a change could not be made is not good for the City right now. Discussion was opened to the public at 6:43 PM and closed to the public at 6:45 PM with no public coming forward to comment. Resolution(s): Motion made by Mr. Shuler to adopt Resolution number, 05-25-2021: 1 Amendment of Section 525 of the Zoning Code to Prohibit the Operation of All Classes of Cannabis Establishments and Cannabis Distributors Within All Zoning Districts in the City of Cape May Set Forth in City Council Ordinance 424-2021, seconded by Mr. Gorgone and carried 6- 0. Those in favor: Mayor Mullock, Deputy Mayor Sheehan, Mr. Shuler, Dr. Wolf, Mr. Gorgone, Mrs. Reed. Those opposing: None. Those abstaining: None. Motion made to adjourn by Dr. Wolf at 6:48 PM with all in favor.
