Shade Tree Commission Meeting Minutes Tuesday, October 10, 2023 Chairman Schatz announced that in compliance with the Open Public Meetings Act of 1975, adequate notice of this meeting has been provided. Pledge of Allegiance Roll Call: Jay Schatz Present George Ator Excused Barbara Preminger Present Robert Craft Absent Carole Sick Present James van Pelt Present George Werner Present Carol York Excused Shaine Meier – Council Representative Present Guest: City Solicitor, Christopher Gillin-Schwartz and his assistant, Carrie Freed 1. A motion to approve the minutes of the September 12, 2023 meeting was made by George Werner and seconded by Barbara Preminger. All approved the motion. 2. 1210 New York Ave: David Fronheiser, homeowner, attended the meeting to appeal the denied tree removal request. Mr. Fronheiser brought pictures of the tree which showed signs of it being half dead, half alive. Agreement was made to approve the request if payment of $75.00 was made and the owner planted 5 new trees along the back yard fence perimeter. Motion was made by Barbara Preminger and seconded by James VanPelt. Motion was approved by majority vote. The owner agreed. 3. The Shade Tree Ordinance was discussed with the City Solicitor. Emailed recommendations/changes from the commissioners to the Solicitor prior to the meeting were made. Discussion of a non refundable $75.00 application fee for the tree removal request was agreed upon in addition to $75.00 per tree if approved. The City Solicitor will make all the changes and resubmit a corrected copy to the Shade Tree to review. He will attend the next meeting to finalize the Ordinace and answer any additional questions the Commission may have. A motion to adjourn was made by George Werner and seconded by Barbara Preminger.
