Mayor and Council reports and information sharing. 2. Council will convene in Executive Session pursuant to Texas Government Code: • Section 551.071 for private consultation with the City Attorney to seek legal advice with respect to pending and contemplated litigation and including all matters on this agenda to which the City Attorney has a duty under the Texas Rules of Discipline and Professional conduct regarding confidential communication with the City Council. · Discuss Landfill Application · Discuss 911 Services · Discuss Fire Station 8 · Discuss Hamrla Litigation • Section 551.072 to discuss certain matters regarding real property. • Section 551.074 to discuss personnel matters. · Deliberate The Appointment, Employment, Evaluation, Reassignment, Duties, Discipline Or Dismissal Of The City Attorney And City Manager • Section 551.076 to discuss security matters. • Section 551.087 to discuss Economic Development. 3. Hearing of any citizen/visitor on items not listed on the regular meeting agenda. Citizens wishing to address the Council regarding items on the posted agenda will be called to speak during the Council's consideration of such items. Citizens/visitors should complete an appearance card located on the table at the entrance to the City Council Chambers. Speakers must address their comments to the presiding officer rather than to individual Council members or staff; Stand at the podium, speak clearly into the microphone and state your name and address prior to beginning your remarks; Speakers will be allowed between 2 and 5 minutes for testimony; Speakers making personal, impertinent, profane or slanderous remarks may be removed from the room; Unauthorized remarks from the audience, stamping of feet, whistles, yells and similar demonstrations will not be permitted; No placards, banners or signs will be permitted in the Chambers or in any other room in which the council is meeting. In accordance with the State Open Meetings Act, the City Council is restricted from discussing or taking action on items not listed on the agenda. Action can only be taken at a future meeting. Consider Approval Of A Bid Award For The Planting Of Trees For Various Projects To Multiple Vendors In An Amount Not To Exceed $200,000.00. CONTRACTS & AGREEMENTS *11. Consider Authorizing The City Manager To Approve Change Order #2 With John Burns Construction Company Of Texas For Replacement Of Additional Sliplined Pipe For The Furneaux Creek Replacement Sanitary Sewer, Segment 1 Project In The Amount Of $79,026.00 For A Revised Contract Amount Of $1,394,070.00. *12. Consider Authorizing The City Manager To Approve A Professional City of Carrollton Page 3 Printed on 8/30/2013 City Council REGULAR WORKSESSION & September 3, 2013 MEETING Services Contract With Binkley & Barfield C&P, Inc. For Design Of Intersection Improvements At Hebron Parkway and Josey Lane And at Hebron Parkway and Old Denton Road In An Amount Of $45,750.00. *13. Consider Authorizing The City Manager To Approve Nine Separate Contracts With The Burlington Northern-Santa Fe (BNSF) Railway For Quiet Zone #2 Project In The Cumulative Amount Of $1,445,000. *14. Consider Authorizing The City Manager To Approve A License Agreement Between The City Of Carrollton And Dallas Area Rapid Transit (DART) For The Downtown Hike & Bike Trail. ORDINANCE *15. Consider An Ordinance Amending the Redevelopment and Rehabilitation of Aging and Underutilized Retail Facilities Program To Create An Historic Downtown Performance-Based Matching Grant Policy. RESOLUTIONS *16. Consider A Resolution Of The City Council Of The City Of Carrollton, Texas, Expressing The Intent To Withdraw From Participation In The Denton County Area 9-1-1 Emergency Communication District (“Denco”) Effective The First Calendar Quarter of 2015, Expressing The Intent To Enter Into Inter-Local Agreements With Other Public Entities To Improve The Dispatch Of Emergency Services In The City And Its Neighboring Communities Through A Regional Dispatch Center, Directing The City Staff To Work Cooperatively With Denco To Develop A Plan for The City’s Withdrawal That Is Reasonable And Equitable To The City And To Denco, And Instructing The City Staff To Provide Periodic Progress Reports To Council. *17. Consider A Resolution Appointing A Member To The Property Standards Board To Fill Vacancy. *18. Consider A Resolution Adopting a Sales Tax Incentive Policy for Data Centers. Hold A Public Hearing And Consider A Resolution For An Amendment To The Future Land Use Map To Change The Use Designation From High Intensity Commercial Uses To Multi-Family Residential Uses; Amending Accordingly The Official Land Use Map. The Approximately 3.355-Acre Site Is Located On The North Side Of Trinity Mills Road (President George Bush Turnpike) Between Carter Drive And Dickerson Parkway. Hold A Public Hearing And Consider An Ordinance To Rezone, To Repeal And Re-establish Planned Development 182 For The (SF-TH) Single-Family Townhouse Residential District With Modified Development Standards And To Allow The Additional Use Of A Continuing Care Retirement Community And/Or An Assisted Living Facility For The Elderly. The Approximately 4.39-Acre Site Is Located In The Vicinity Of The Northwest Corner Of Marsh Lane And Keller Springs Road, And Is Currently Zoned PD-182 For The (SF-TH) Single-Family Townhouse Residential District. Case No. 07-13Z1, Glen Carr House of Carrollton. *21. Hold A Public Hearing And Consider An Ordinance To Rezone, To Repeal And Re-establish A Special Use Permit For A Private School To Increase The Number Of Students From 75 To 150. The Approximately 4-Acre Tract Is Located At 2030 Denton Drive, And Is Zoned (SF-7/14) Single-Family Residential District With SUP-263 For A Private School. PUBLIC HEARING - INDIVIDUAL CONSIDERATION 22. Hold A Public Hearing And Consider An Ordinance Amending PD-45 To Change The Base Zoning Of An Approximately 3.355-Acre Tract From The (LR-2) Local Retail District To The (MF-18) Multi-Family Residential District With Modified Development Standards And To Allow The Additional Use Of Local Retail And To Change The Base Zoning Of A Second Approximately 2.0776-Acre Tract From The (O-2) Office District, To The (O-2) Office District Allowing Multi-Family Development As An Additional Use, With Modified Development Standards; Amending Accordingly The Official Zoning Map.
