Item No. 6. 2015-578 CONFERENCE WITH LEGAL COUNSEL - EXISTING LITIGATION (CITY COUNCIL) Recommendation: A closed session will be held, pursuant to Government Code �54956.9(d)(1), to confer with legal counsel regarding pending litigation to which the City is a party. The title of such litigation is as follows: Alexy C. Rafael vs. City of Carson , Case No. BC582875, L.A. Superior Court. Item No. 7. 2015-568 CONFERENCE WITH REAL PROPERTY NEGOTIATOR (CITY COUNCIL) Recommendation: A closed session will be held, pursuant to Government Code � 54956.8, to enable the City Council to consider negotiations with Hani Nassif Win Chevrolet, with whom City is negotiating, and to give direction to its negotiator(s) Ken Farfsing Interim City Manager, Cecil Rhambo, Assistant City Manager and John Raymond, Director of Community Development, regarding that certain real property known as 2403 E 223rd Street (APN 7315-012-900). (CITY COUNCIL) Recommendation: TAKE the following actions: 1. OPEN the Public Hearing, TAKE public comment regarding entering into an Energy Services Contract with Opterra Energy Services, CLOSE the Public Hearing, and CONTINUE the Public Hearing until September 1, 2015. 2. Open "majority protest" public hearing as required by Proposition 218. Residential property owners have the right to submit written protests and may do so per the protest guidelines adopted on June 3, 2015, made part of the mailed Notice to refuse service ratepayers. The majority protest would require more than 50% of the total _________ (__) properties of record. B. At the conclusion of the public hearing and after hearing any testimony, should sufficient protests be submitted in opposition to the new rates, the City must stop further proceedings on the new refuse rates and deny them as a result of the successful majority protest. C. If insufficient protests have been submitted by the conclusion of the public hearing, it is recommended the City Council may adopt the proposed refuse rate as they were noticed to all residential ratepayers. This may be done by simple majority vote of the Council. The ultimate decision to grant WM's residential rate proposal remains within the City Council's discretion.
