1. ACCEPT the LA84 Foundation grant of $10,000 to augment
the existing Learn-to-Swim and the beginning competitive
swimming programs at three (3) pools.
2. INCREASE the current fiscal year projected revenues by
$4,010 in General Fund account number 01-000-999-606-4620.
The remaining $4,010 shall be included in revenue estimates for
fiscal year 2016/17.
3. Direct staff to include $8,020 in expenditures in the
appropriate accounts for proposed fiscal year 2016/2017
budget.

Item No. 37. 2016-588 REPORT ON FRAUD HOTLINE INVESTIGATION AND
OPTIONS FOR UPDATING THE FRAUD HOTLINE
AND DEVELOPING A FRAUD, WASTE, AND ABUSE
POLICY (CITY COUNCIL)
Recommendation: A. Provide Ms. Cooper with a copy of Mr. Vanacek's
Investigative Report and set a public hearing during the next City
Council meeting to give Ms. Cooper an opportunity to respond to
the conclusions of the investigative report, and then take
responsive action including a possible censure, relieving Ms .
Cooper of her supervision of the fraud hotline, or any other
action the Council deems appropriate.
B. Instruct City staff to prepare a Fraud, Waste, and Abuse
policy, incorporating the policies recommended by staff or other
policies that Council deems appropriate, and to present the
proposed policy for City Council approval at a later date to
effectuate a more effective Fraud Hotline.
C. Direct staff to review the City's website - specifically, the
pages concerning the Fraud Hotline - and to prepare to make
updates that will implement the changes in the revised policy,
improve the visibility of the hotline, and help potential reporters
to file appropriate reports.

Recommendation: TAKE the following actions:
1. APPROVE the First Amendment to the Professional Services
Agreement with RKA Consulting Group Inc. in the amount of
$244,693.00, resulting in a total contract sum of not to exceed
$432,293.00.
2. AUTHORIZE the Mayor to execute the First Amendment to
the Professional Services Agreement with RKA Consulting
Group Inc. following approval as to form by the City Attorney.

Item No. 42. 2016-585 CONSIDER ENGAGING SEPARATE COUNSEL IN
PENDING LITIGATION FOR MAYOR ALBERT

Recommendation: TAKE the following actions:
1. APPROVE the tender, at City expense, of a legal defense
and indemnity of Mayor Albert Robles in the above-referenced
litigation, under a reservation of rights, and DIRECT the City
Attorney to issue such a qualified tender in writing; and
2. APPROVE selection of separate counsel to represent Mayor
Albert Robles in the above-referenced litigation, at City expense
and at an hourly rate not to exceed $325.00 per hour, following
completion of interviews of such counsel by the Mayor, and his
selection of the same; and
3. AUTHORIZE the Mayor Pro Tem to execute such a retainer
agreement with separate counsel for Mayor Robles, following
approval of the same as to form by the City Attorney.
