CITY HALL CEDAR FALLS, IOWA, OCTOBER 6, 2025 REGULAR MEETING, CITY COUNCIL MAYOR DANIEL LAUDICK PRESIDING The City Council of the City of Cedar Falls, Iowa, met in Regular Session, pursuant to law, the rules of said Council and prior notice given each member thereof, at 7:00 P.M. on the above date. Members present: Schultz, Latta, Kruse, Hawbaker (via electronic), Ganfield, Crisman, Dunn. Absent: None. Mayor Laudick led the Pledge of Allegiance. 55611 - It was moved by Ganfield and seconded by Dunn that the minutes of the Regular Meeting of September 15, 2025, be approved as presented and ordered of record. Motion carried unanimously. 55612 - It was moved by Ganfield and seconded by Latta that the minutes of the Special Meeting of September 29, 2025, be approved as presented and ordered of record. Motion carried unanimously. 55613 - Kim Jordan, Cedar Falls, expressed concerns on road construction expenses and commented on the West 1st Street and Union Road intersection. Mayor Laudick, Director of Finance & Business Operations Rodenbeck and Director of Public Works Schrage commented. 55614 - Director of Public Safety Berte noted the Open House on Wednesday, October 8, 2025 from 4PM - 6PM at the Public Safety Center for Fire Prevention Week. 55615 - Mayor Laudick announced that in accordance with the public notice of September 18, 2025, this was the time and place for a public hearing on proposed amendments to Chapter 26, Zoning, of the Code of Ordinances relative to the requirement to obtain a land use permit to be clarified in a new Section 26-26 Application of Provisions and a retitled Section 26-29 land use permit. It was then moved by Ganfield and seconded by Crisman that the proof of publication of notice of hearing be received and placed on file. Motion carried unanimously. 55616 - The Mayor then asked if there were any written communications filed to the proposed amendments. Upon being advised that there were no written communications on file, the Mayor then called for oral comments. Planner II Sevy provided an overview of the amendments. Following questions by Craig Fairbanks, Cedar Falls, the Mayor declared the hearing closed and passed to the next order of business. 55617 - It was moved by Dunn and seconded by Latta that Ordinance #3125, amending Chapter 26, Zoning, of the Code of Ordinances relative to the requirement to obtain a land use permit to be clarified in a new Section 26-26 Application of Provisions and a retitled Section 26-29 land use permit, be passed upon its first consideration. Following comments by Planner II Sevy and Mayor Laudick, questions by Councilmembers Ganfield, Schultz, Kruse, and Dunn, and responses by Sevy, Mayor Laudick, and Planning & Community Services Manager Howard, it was moved by Crisman and seconded by Dunn to call the question. Motion carried 5-2, with Kruse and Ganfield voting Nay. The Mayor then put the question on the original motion and upon call of the roll, the following named Councilmembers voted. Aye: Latta, Hawbaker, Crisman, Dunn. Nay: Schultz, Kruse, Ganfield. Motion Carried. 55618 - Mayor Laudick announced that in accordance with the public notice of September 18, 2025, this was the time and place for a public hearing on proposed amendments to Chapter 26, Zoning, of the Code of Ordinances relative to regulations governing -2- the allowance of Accessory Dwelling Units as outlined in Section 26-142 Accessory uses, Section 26-193.1 General provisions, Section 26-193.4 Neighborhood medium frontage, Section 26-197 Building functions, and Section 26-126 Detached accessory structures. It was then moved by Ganfield and seconded by Crisman that the proof of publication of notice of hearing be received and placed on file. Motion carried unanimously. 55619 - The Mayor then asked if there were any written communications filed to the proposed amendments. It was then moved by Crisman and seconded by Ganfield that the proof of publication of notice of hearing be received and placed on file. Motion carried unanimously. 55622 - The Mayor then asked if there were any written communications filed to the proposed amendments. Following comments and questions by Councilmembers Latta, Kruse, Dunn, Crisman, and Schultz, and responses by Mayor Laudick and City Attorney Rogers, the Mayor put the question on the motion and upon call of the roll, the following named Councilmembers voted. Aye: Schultz, Latta, Hawbaker, Ganfield, Crisman, Dunn. Nay: Kruse. Motion -3- Carried. 55624 - It was moved by Latta and seconded by Crisman to further continue the public hearing to October 20, 2025 on proposed amendments to Chapter 7, Buildings and Building Regulations, of the Code of Ordinances relative to amendments, National Electrical Code adoption, and National Electrical Code amendments. Following due consideration by the Council, the Mayor put the question on the motion, and upon call of the roll, the following named Councilmembers voted. Aye: Schultz, Latta, Kruse, Hawbaker, Ganfield, Crisman, Dunn. Nay: None. Motion carried. 55625 - It was moved by Crisman and seconded by Dunn that Ordinance #3123, amending Chapter 15, Nuisances, of the Code of Ordinances relative to nuisance defined; certain acts, conditions declared as nuisances and responsibility for abatement; abatement defined, be passed upon its third & final consideration. Following due consideration by the Council, the Mayor put the question on the motion, and upon call of the roll, the following named Councilmembers voted. Aye: Schultz, Latta, Kruse, Hawbaker, Crisman, Dunn. Nay: Ganfield. Motion carried. The Mayor then declared Ordinance #3123 duly passed and adopted. 55626 - It was moved by Ganfield and seconded by Schultz that Ordinance #3124, amending Chapter 17, of the Code of Ordinances, relative to traffic regulations and Chapter 23, of the Code of Ordinances, relative to definitions, all-terrain vehicles and off-road utility vehicles; street or highway operation, and operation of off-road utility vehicles (UTV's) on designated streets, be passed upon its third & final consideration. Following due consideration by the Council, the Mayor put the question on the motion, and upon call of the roll, the following named Councilmembers voted. Aye: Schultz, Latta, Kruse, Hawbaker, Ganfield, Crisman, Dunn. Nay: None. Motion carried. The Mayor then declared Ordinance #3124 duly passed and adopted. 55627 - It was moved by Ganfield and seconded by Crisman that the following items on the Consent Calendar be received, filed, and approved: Receive and file the City Council Committee of the Whole minutes of September 15, 2025 relative to the following item: a) RP Zoning Discussion. Approve the application of J & M Displays, Inc. (Holiday Hoopla) for a fireworks display permit for November 28, 2025. Approve a request for a temporary sign at 110 Main Street with removal on October 6, 2026. Approve the application of Thunder Ridge Ampride, 2425 Whitetail Drive, for a device retailer permit. Following comments by Councilmember Dunn and Mayor Laudick, Dee Dee Benton, UNI Student Liaison, the Mayor put the question on the motion and upon call of the roll, the following named Councilmembers voted. Aye: Schultz, Latta, Kruse, Hawbaker, Ganfield, Crisman, Dunn. Nay: None. Motion Carried. The Mayor then declared Resolution #24,294 duly passed and adopted. 55630 - It was moved by Kruse and seconded by Schultz that the bills and claims of October 6, 2025, be allowed as presented, and that the Controller/City Treasurer be authorized to issue City checks in the proper amounts and on the proper funds in payment of the same.
