MINUTES OF THE CENTENNIAL CITY COUNCIL Regular City Council Meeting 7:00 PM Monday, October 06, 2014 A Regular Meeting of the City Council was held on this date in the City Council Chambers at 13133 E. Arapahoe Road, Centennial, Colorado. A full and timely notice of this meeting had been posted and a quorum was present. 1. Call to Order Mayor Noon called the meeting to order at 7:05 PM. 2. Roll Call Those present were: Mayor Noon Council Member Gardner Council Member Moon Council Member Piko Council Member Lucas Council Member Turley Council Member Truhlar Council Member Gotto Council Member Whelan Those absent were: None Also present were: John Danielson, City Manager Bob Widner, City Attorney Wayne Reed, Deputy City Manager Andy Firestine, Director of Community Development Sherri Chadwick, Director of Communications Lisa Bigelow, Financial Analyst II Marcus McAskin, Deputy City Attorney Travis Greiman, Engineering Manager Craig Faessler, Public Works Program Director Barbara Setterlind, City Clerk 3. Pledge of Allegiance The Pledge of Allegiance was led by Webelos Pack 664. 4. Public Comment Eric Darst, 19814 E. Caley Drive, made a formal request for an ad-hoc committee to be formed to discuss safety concerns on the Arapahoe Road – Waco to Himalaya project. Warren Williamson, 19142 E. Euclid Drive, discussed the request for an ad-hoc committee regarding safety concerns on the Arapahoe Road – Waco to Himalaya project. Minutes – Regular City Council Meeting October 06, 2014 Page 2 Tom Johnson, 6666 S. Fundy Court, discussed accidents occurring on Arapahoe Road that affect his property. Andrea Suhaka, 6864 S. Ulster Circle, thanked Council for supporting funds to South Suburban Parks and Recreation District for rebuilding of tennis courts. 5. Scheduled Presentations a. Update from Emergency Services Group and Law Enforcement Chief Glen Thompson, Arapahoe County Sheriff’s Office, made a brief report. Chief Jerry Rhodes, Cunningham Fire District, made a brief report. 6. Consideration of Communications, Proclamations and Appointments CONSENT AGENDA Council Member Lucas moved approval of the Consent Agenda. Council Member Gotto seconded the motion. With Mayor Noon, Council Member Gardner, Council Member Moon, Council Member Piko, Council Member Lucas, Council Member Turley, Council Member Truhlar, Council Member Gotto, Council Member Whelan voting AYE, and (None) voting NAY; Absent: 0. RESOLUTION NO. 2014-R-62 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CENTENNIAL, COLORADO, APPROVING THE THIRD AMENDMENT TO THE AMENDED AND RESTATED PROFESSIONAL SERVICES AGREEMENT FOR PUBLIC WORKS SERVICES BETWEEN THE CITY AND CH2M HILL ENGINEERS, INC., AND AUTHORIZING THE MAYOR TO EXECUTE THE SAME 9. ORDINANCE NO. 2014-O-42 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CENTENNIAL, COLORADO, AMENDING SECTIONS OF ARTICLE 4 OF CHAPTER 6 OF THE MUNICIPAL CODE CONCERNING LIQUOR LICENSES Barbara Setterlind, City Clerk, presented. Mayor Noon opened the Public Hearing; seeing no one present wishing to speak, the Public Hearing was closed. Council Member Gardner moved approval of ORDINANCE NO. 2014-O-42 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CENTENNIAL, COLORADO, AMENDING SECTIONS OF ARTICLE 4 OF CHAPTER 6 OF THE MUNICIPAL CODE CONCERNING LIQUOR LICNSES. Council Member Whelan seconded the motion. With Mayor Noon, Council Member Gardner, Council Member Moon, Council Member Piko, Council Member Lucas, Council Member Turley, Council Member Truhlar, Council Member Gotto, Council Member Whelan voting AYE, and (None) voting NAY; Absent: 0. THE MOTION Passed. 12. Consideration of Resolutions (None) 13. Consideration of Other Items (None) GENERAL BUSINESS 14. Other Matters as May Come Before Council Council Member Gotto discussed the proposed ad-hoc committee request from Mr. Darst regarding safety concerns on Arapahoe Road, Waco to Himalaya. Consensus was unanimous not to go forward with an ad-hoc committee as proposed. Council Member Gotto proposed an alternative committee to the one proposed by Mr. Darst. Consensus was not to go forward with any type of citizens committee at this time. 15. Reports a. City Manager (None) b. City Attorney (None) c. City Clerk (None) d. Executive Session Pursuant to C.R.S. 24-6-402(4)(b) and 24-6-402(4)(e) for the Purposes of Receiving Legal Advice on Specific Legal Questions Related to Annexation and to Instruct Negotiators Regarding the City Response to Economic Incentive Requested by a Landowner in Conjunction with the Landowner's Future Voluntary Annexation of Certain Property to the City of Centennial. b. Executive Session Pursuant to C.R.S. 24-6-402(4)(b) and 24-6-402(4)(e) for the Purposes of Receiving Legal Advice on the Procedure to Exclude Property from a Metropolitan District Pursuant to the Provisions of C.R.S. Section 32-1-502(1)(a) and to Instruct Negotiators Regarding the City's Response to a Request to have the City Participate in Exclusion Proceedings. Council Member Lucas moved to go into Executive Session Pursuant to C.R.S. 24-6-402(4)(b) and 24-6-402(4)(e) for the Purposes of Receiving Legal Advice on Specific Legal Questions Related to Annexation and to Instruct Negotiators Regarding the City Response to Economic Incentive Requested by a Landowner in Conjunction with the Landowner's Future Voluntary Annexation of Certain Property to the City of Centennial and Pursuant to C.R.S. 24-6-402(4)(b) and 24-6-402(4)(e) for the Purposes of Receiving Legal Advice on the Procedure to Exclude Property from a Metropolitan District Pursuant to the Provisions of C.R.S. Section 32-1-502(1)(a) and to Instruct Negotiators Regarding the City's Response to a Request to have the City Participate in Exclusion Proceedings. Council Member Gotto seconded the motion. The Centennial City Council Meetings are audio streamed live on the City’s website. Public Comment The Public Comment section offers an opportunity for any citizen to express opinions or ask questions regarding City services, policies or other matters of community concern, and any agenda items that are not a part of a scheduled public hearing. Citizens will have three minutes for comments if they are speaking as an individual, or five minutes if speaking on behalf of a group or organization. These time limits were established to provide efficiency in the conduct of the meeting and to allow equal opportunity for everyone wishing to speak. An immediate response should not be expected, as issues are typically referred to City staff for follow-up or research and are then reported back to Council and the individual who initiated the comment or inquiry. Written materials for presentation to Council may be submitted to the City Clerk as the speaker approaches the podium. The City’s computer presentation equipment is not available for general public use, although applicants are permitted to display relevant illustrations and material useful in informing the Council and public of a project.
