MINUTES OF THE CENTENNIAL CITY COUNCIL Regular City Council Meeting 7:00 PM Monday, October 05, 2015 A Regular Meeting of the City Council was held on this date in the City Council Chambers at 13133 E. Arapahoe Road, Centennial, Colorado. A full and timely notice of this meeting had been posted and a quorum was present. 1. Call to Order Mayor Noon called the meeting to order at 7:15 PM. 2. With Mayor Noon, Council Member Gardner, Council Member Moon, Council Member Piko, Council Member Lucas, Council Member Turley, Council Member Truhlar, Council Member Gotto, Council Member Whelan voting AYE, and (None) voting NAY; Absent: 0. RESOLUTION NO. 2015-R-62 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CENTENNIAL, COLORADO, APPROVING A VARIANCE TO SECTION 12-3-906(D) OF THE LAND DEVELOPMENT CODE CONCERNING DEVELOPMENT PROPOSED WITHIN THE RESTRICTED DEVELOPMENT AREA OF THE CENTENNIAL AIRPORT INFLUENCE AREA (CASE NUMBER LU-15-00203 – VILLAGE AT CENTENNIAL AIA VARIANCE REQUEST) Council Member Gardner recused himself from the Public Hearing due to his involvement with the Airport Noise Roundtable, and left the dais. Derek Holcomb, Principal Planner, presented; 7:35 PM. Jon Griffis, Linda Purdy and Jason Pock from Richmond Homes, representing the applicant, made a brief presentation. Mayor Noon opened the Public Hearing. John Dubue’, 6483 S. Abilene, a neighbor of the proposed development, stated he supported the approval of the variance. Seeing no one else present wishing to speak, the Public Hearing was closed. Minutes – Regular City Council Meeting October 05, 2015 Page 4 Council Member Lucas moved approval of RESOLUTION NO. 2015-R-62 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CENTENNIAL, COLORADO, APPROVING A VARIANCE TO SECTION 12-3-906(D) OF THE LAND DEVELOPMENT CODE CONCERNING DEVELOPMENT PROPOSED WITHIN THE RESTRICTED DEVELOPMENT AREA OF THE CENTENNIAL AIRPORT INFLUENCE AREA (CASE NUMBER LU-15-00203 – VILLAGE AT CENTENNIAL AIA VARIANCE REQUEST) BASED ON STAFF’S FINDINGS IN THE STAFF REPORT. Council Member Gotto seconded the motion. With Council Member Moon, Council Member Piko, Council Member Lucas, Council Member Turley, Council Member Truhlar, Council Member Gotto voting AYE, and Mayor Noon, Council Member Whelan voting NAY; Abstain: 0. RESOLUTION NO. 2015-R-61 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CENTENNIAL, COLORADO, APPROVING THE FIRST AMENDMENT TO THE SERVICE PLAN FOR THE VERONA ESTATES METROPOLITAN DISTRICT NOS. 1 AND 2, AND CONSENTING TO THE DISSOLUTION OF DISTRICT NO. 2 Marcus McAskin, Deputy City Attorney, presented; 8:29 PM. Mary Jo Dougherty, attorney with McGeady Sisneros, and Lisa Albers, Century Communities, representing the applicant, answered questions from Council. Mayor Noon opened the Public Hearing; seeing no one present wishing to speak, the Public Hearing was closed. The meeting was recessed at 9:15 PM and reconvened at 9:30 PM. Council Member Gardner moved to conditionally approval of RESOLUTION NO. 2015-R-61 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CENTENNIAL, COLORADO, APPROVING THE FIRST AMENDMENT TO THE SERVICE PLAN FOR THE VERONA ESTATES METROPOLITAN DISTRICT NOS. 1 AND 2, AND CONSENTING TO THE DISSOLUTION OF DISTRICT NO. 2, ON THE CONDIDTION THAT THE SERVICE PLAN AMENDMENT BE REVISED TO INSERT AN OPERATING MILL LEVY CAP OF WHATEVER MILL LEVY GENERATES A MAXIMUM OF ONE MINLLION DOLLARS ($1,000,000.00) IN ANY ONE CALEDAR YEAR, AND THAT THE CITY ATTORNEY’S OFFICE REVIEW AND APPROVE THE REVISED SERVICE PLAN AMENDMENT PRIOR TO THE SAME BEING FILED OF RECORD WITH THE ARAPAHOE COUNTY DISTRICT COURT. Council Member Truhlar seconded the motion. The Centennial City Council Meetings are audio streamed live on the City’s website. Public Comment The Public Comment section offers an opportunity for any citizen to express opinions or ask questions regarding City services, policies or other matters of community concern, and any agenda items that are not a part of a scheduled public hearing. Citizens will have three minutes for comments if they are speaking as an individual, or five minutes if speaking on behalf of a group or organization. These time limits were established to provide efficiency in the conduct of the meeting and to allow equal opportunity for everyone wishing to speak. An immediate response should not be expected, as issues are typically referred to City staff for follow-up or research and are then reported back to Council and the individual who initiated the comment or inquiry. Written materials for presentation to Council may be submitted to the City Clerk as the speaker approaches the podium. The City’s computer presentation equipment is not available for general public use, although applicants are permitted to display relevant illustrations and material useful in informing the Council and public of a project.
