Twelve members were in attendance at the start of the meeting. Strada and Schuler were subsequently excused prior to hearing New Business items, as the ten member maximum for the Board was reached. Petitions Approval of Minutes 1. December 5, 2019 Meeting Minutes [19-1060] A motion was made by Godfrey, seconded by Bartow, to approve the minutes. The motion carried unanimously. Page 1 of 3 Board of Adjustment Meeting Minutes January 9, 2020 Old Business 2. Board Priorities [19-1061] The Board discussed their top goals and priorities. New Business 3. 313 E Franklin St: Appeal of Historic District Commission [19-1062] Decision Sam Slater, attorney, presented the applicant's appeal of the Historic District Commission's decision to deny an after-the-fact concrete paver walkway. Brian Ferrell, counsel to the Historic District Commission, presented a defense. The Board discussed issues including due process rights and the merits of the Historic District Commission's discussion of the texture, color, and pattern of bricks and pavers. A motion was made by Wortman, seconded by Morse, to adopt Resolution B, a resolution to deny the appeal and uphold the Historic District Commission's decision. The motion carried by the following vote: Aye: 9 - Chair Parrish, Vice-Chair Murphy, Bartow, Godfrey, Hatley, Lyons, Morse, Murphy, and Wortman Nay: 1 - Hito Excused: 2 - Schuler, and Strada Adjournment Next Meeting - February 6, 2020 Page 2 of 3 Board of Adjustment Meeting Minutes January 9, 2020 Order of Consideration of Agenda Items: 1. Staff Presentation 2. Applicant’s Presentation 3. Public Comment 4. Board Discussion 5. Motion 6. Restatement of Motion by Chair 7. Vote 8. Announcement of Vote by Chair Public Charge: The Advisory Body pledges its respect to the public. The Body asks the public to conduct themselves in a respectful, courteous manner, both with the Body and with fellow members of the public. Should any member of the Body or any member of the public fail to observe this charge at any time, the Chair will ask the offending person to leave the meeting until that individual regains personal control. Should decorum fail to be restored, the Chair will recess the meeting until a genuine commitment to this public charge is observed.
