MINUTES CITY OF CHEROKEE VILLAGE, ARKANSAS CITY COUNCIL MEETING 6: 30 P. M., THURSDAY January 19, 2023 CHEROKEE VILLAGE CITY HALL Meetings are video recorded) Oath of Office - Mayor Rose gave the Oath of Office to elected Council Members Steve Thompson and Andrew Hefley. Elected officials, whom have taken the oath in 2023, Steven R. Rose- Mayor, Penny Trumpy— City Clerk and Peter Martin— Council Member. Steven R. Rose, Mayor called the meeting of the City Council to order at 6: 30 p.m. on January 19, 2023. Mayor Rose led the Pledge of Allegiance, followed by a moment of silent. Roll was called by City Clerk, Penny Trumpy. Council Members present: Pam Rowland, Jeff Tatum, Andrew Hefley, Eddie Ishmael, Steve Thompson, Rob Smith, Peter Martin. City Attorney Jon Abele Quorum established. APPROVAL OF THE AGENDA: Mayor Rose asked for approval of the agenda. Council Member Martin moved that the Highland School Proclamation to be removed from the agenda. No second by Council Members. Motion failed due to lack of second. Council Member Martin moved to approve the agenda, seconded by Council Member Hefley. Roll Call Vote to approve Agenda: Rowland Yes, Tatum Yes, Hefley yes, Ishmael Yes, Thompson Yes, Smith Yes, and Martin Yes, Agenda approved. PUBLIC COMMENTS ON AGENDA ITEMS: None APPROVAL OF MINUTES: Council Member Martin moved to accept December 15, 2023 minutes and Seconded by Council Member Smith. ( 7 yea' s) Motion passed Correspondence: None Financial Report: After much discussion on the financial reports and procedures Council Member Rowland moved to table approving financials until an amended financial packet was compiled until a Special Meeting February 6, 2023 at 6: 00 PM., seconded by Council Member Tatum. Roll Call Vote: Tatum Yes, Hefley yes, Ishmael Yes, Thompson Yes, Smith Yes, and Martin Yes, Rowland Yes. ( 7 yea' s) Motion passed. Mayors Report: Mayor Rose stated his first month has been a whirlwind. This included meeting with Roy Echols on Tohi Trial, Reviewing Budgets, Worked with Joey on Street Dept, Working on computer in setting up, Act 833 Fire Dept account filed with the State, Several meetings with Department Heads working on what is needed or issues, working with the Treasurer and working with Fidelity on phone serves. Mayor, Treasurer and City Clerk attended the Municipal Leagues Winter Conference where we learned a lot. One thing discussed at conference was city emails vs personal emails. This is being set up and working through the glitches. The State Holiday Calendar is what the City follows. Juneteenth( June 19) will be observed by the City of Cherokee Village. Motion passed( 7 yea' s) Old Business: 1. Mayor and Clerks Salary — continued from last month. Council Member Tatum stressed City needs to pay positions a fair pay. Council Member Martin suggested we accept the salaries as is, then in 2 months to review this. Council Member Tatum suggested this be included in the Special Meeting when dealing with the budget. Council Member Thompson agreed this should be included in the Special meeting. Council Member Rowland asks if this should be separate from the financial meeting. Council Member Martin stated this is included in financing. Council Member Tatum moved to address Mayors and Clerks Salary to the Special Financial Meeting in February, seconded by Council Member Thompson. Motion passed ( 7 yea' s) New Business: 1. Council Protocol for 2023— Steven Rose This does not have to be a resolution as long as it voted on by City Council. Council Martin moved to put on the floor for discussion, seconded by Council Member Hefley. Motion passed( 5 yea' s)( 2 nay' s Council Member Thompson,& Tatum) Council Member Martin dislikes# 5 and would like it removed. Council Member Thompson counter acted the statement stating this was set up to stop beating a subject to death. This is designed to follow procedure and limit a subject to be a discussion month after month. More discussion on procedures and clarification continued. Council Member Rowland stated that Council does suspend the 3 reading rule. Council Member Martin moved to accept Council Protocols for 2023 with the removal of#5, seconded by Council Member Rowland. Roll Call Vote: Martin yes, Rowland yes, Tatum no, Hefley yes, Ishmael no, Thompson no, Smith yes, Vote was 4 to 3— Mayor Rose vote is required to meet the required votes of 2/ 3 majority of Council as a whole. Mayor Yes. This can be revisited if needed. 2. Election of Mayor Pro- Tempore Council Member Martin asked Attorney Jon Abele, to clarify the duties of a Mayor Pro- Tempore. Attorney Able explained the Mayor Pro- Tempore duties are to preside over council meetings in the absent of the Mayor. If the Mayor is out of pocket then it is the City Clerk or a City of Cherokee Village Council Meeting 2  dually appointed representative picked by the Mayor. Council Member Smith moved that Council Member Tatum be appointed Mayor Pro- Tempore, seconded by Council Member Hefley. Motion passed( 7 yea' s). Mayor Pro- Tempore does not lose his vote on Council. 3. Resolution No 2023- 01 A Resolution Amending Administration General Fund 2022 Municipal Budget 4. Resolution No 2023- 02 A Resolution Amending Planning and Zoning General Fund 2022 Municipal Budget 5. Resolution No 2023- 03 A Resolution Amending Building and Grounds General Fund 2022 Municipal Budget 6. Resolution No 2023- 04 A Resolution Amending the City of Cherokee Village General Fire Fund 2022 Municipal Budget 7. Resolution No. 2023- 05 A Resolution Amending Act 833 Fund 2022 Municipal Budget Council Member Smith moved to accept New Business items# 2-# 7 as written, seconded by Council Member Ishmael. Council Member Thompson asked Fire Chief Dienst about reconciling the 833 Fund, which Chief stated he reconciles through the state, same question to Police, and Street. Council Member Smith moved to accept the amended resolutions, seconded by Council Member Hefley. Roll Call Vote: Rowland yes, Tatum yes, Hefley yes, Ishmael yes, Thompson yes, Smith yes, Martin Abstained. Motion passed( 6 yea' s 1 abstained). 8. Proclamation— Highland Rebels— Received from Arkansas School Boards Association. Mayor Rose stated this was from the Arkansas School Board Association and read the proclamation. 9. New Facility Lights for City Hall and Sharp County Senior Center Building— Andrew Hefley. Council Member Hefley presented concern of the lighting in both the Senior Center and the Council Room. Council Member Hefley is working with Building and Grounds Department Head Charlie Akers in updating the lighting to improve the lighting in both places. Council Member Hefley reviewed the report and contractors estimate to complete this task. Council Member Hefley asked Council/ Budget Committee to find the money in the budget to replace the current lighting with LED lighting, seconded by Council Member Martin. Motion passed( 7 yea' s). Council Member Rowland asked if this company is local and did we get quotes from a local company. Building& Grounds Supervisor stated that he tried to get local quotes but did not receive them. 10. Jeff Tatum— addressing Complaint Letter. Council Member Tatum to add this to Executive Session for Disciplinary action. Council Member Tatum withdrew his motion. After discussion Council Member Thompson moved to address this in Executive Session, seconded by Council Member Smith. Roll Call Vote: Hefley yes, Ishmael no, Thompson yes, Smith yes, Martin no, Rowland no, Tatum yes, Motion passed( 4 yea' s)( 3 ney' s) Motion passed. 11. Council Vacancy Seat— Interview Candidates Each candidate was asked the same 4 questions by the Mayor and any questions from the Council. a. Marianne Quick b. Anthony Arthur Wilburn c. ( Brenda) Heather Harrison— goes by Heather. d. John Dillon Adams— petition was invalid due to# of signatures needed once verified. e. Matthew E. Meyers Mayor Rose thanked everyone who filed. 12. Executive Session— to fill Council Vacancy and discuss Disciplinary action Complaint letter Mayor Rose called Council Meeting back to order after Executive Session. Council Member Smith complemented the candidates on their willingness to serve and sincerely want you to serve the City in any way in the future. The Council decided that no disciplinary action was required from the complaint letter. Council Member Smith moved to appoint Brenda Heather Harrison as Ward 1 position 2 Council Seat, seconded by Council Member Rowland. Roll Call Vote: Martin yes, Rowland yes, Tatum yes, Hefley yes, Ishmael yes, Thompson yes, Smith yes. Motion passed( 7 yea' s) City of Cherokee Village Council Meeting 3 COMMENTS/ QUESTIONS ON CITY RELATED BUSINESS: ( limit 3 minutes per person) 1. Michelle Peterson — Citizens for Highland School Dist. Accountability. Mrs. Peterson expressed concerns on building of a new high school in Highland. There was a question the and answer time from the public for Mrs. Peterson. 2. Sheila Heean Jones — Townshouses — Mrs. Jones welcomed the newer Council Members. Wards 3 & 4 have townhouses in their Mrs. Jones feels orphaned from the city for wards. living in the townhouses. Mrs. Jones asked Council to check out the roads. ADJOURNMENT: Council Member Smith moved to adjourn the meeting at 9: 27 p.m., seconded by Council Member Hefley and passed unanimously.
