RECORD OF PROCEEDINGS Minutes of the City Council of the City of Cherry Hills Village, Colorado held on Monday, August 26, 2024 at 6:30 PM at City Hall, 2450 East Quincy Avenue, Cherry Hills Village, Colorado 80113 The City Council held a study session at 6:00 PM CALL TO ORDER Mayor Brown called the meeting to order at 6:32 PM. ROLL CALL Mayor Katy Brown, Mayor Pro Tem Randy Weil, Councilors Earl Hoellen, Susan Maguire, and Robert Eber were present on roll call. Also present were City Manager Chirs Cramer, Deputy City Manager/Director Jay Goldie, City Attorney Kathie Guckenberger, Police Chief Jason Lyons, Community Development Director Paul Workman, Finance Director Doug Farmen, Human Resources Manager Kathryn Ducharme, and City Clerk Laura Gillespie. Absent: Councilors Dan Sheldon and Al Blum PLEDGE OF ALLEGIANCE The Council conducted the pledge of allegiance. EXECUTIVE SESSION Mayor Pro Tem Weil moved, seconded by Council Hoellen, to enter into executive session pursuant to Section 24-6-402(4)(b), Colorado Revised Statutes, to receive legal advice concerning a citizen-initiated petition and a Council-referred ballot measure to amend Section 3.9 of the Cherry Hills Village Home Rule Charter and publication of related election notices. The following votes were recorded: Eber yes Hoellen yes Weil yes Maguire yes The vote on the Executive Session was 4 ayes and 0 nays. The motion carried. The Council entered into Executive Session at 6:34 PM. The Council returned to open session at 7:28 PM. AUDIENCE PARTICIPATION PERIOD Josh Behr, 19 Huntwick Lane, discussed a meeting with the executive of T-Mobile regarding technologies for cell coverage and expressed support for a citizens committee. REPORTS FROM CITY BOARDS, COMMISSIONS, AND COMMITTEES None. Approval of August 6, 2024 Minutes b. Professional Services Agreement with Mountain State Construction c. Resolution 15, Series 2024; Approving an Intergovernmental Agreement with Arapahoe County for the November 5, 2024 Election The motion passed unanimously. ITEMS REMOVED FROM CONSENT AGENDA None UNFINISHED BUSINESS None NEW BUSINESS Council Bill 6, Series 2024; An Emergency Ordinance of the City of Cherry Hills Village, Colorado Submitting to the Registered Electors of the City a Measure Amending the Home Rule Charter Regarding the Management and Protection of Quincy Farm in Accordance with Applicable Law and the Conservation Easement at the Coordinated Election to be Held November 5, 2024 City Clerk Gillespie presented Council Bill 6, Series 2024 for Council consideration. Councilor Hoellen moved, seconded by Mayor Pro Tern Weil, to approve Council Bill 6, Series 2024; an emergency ordinance of the City of Cherry Hills Village, Colorado submitting to the registered electors of the City a measure amending the Home Rule Charter regarding the management and protection of Quincy Farm in accordance with applicable law and the conservation easement at the coordinated election to be held November 5, 2024. The following votes were recorded: Eber yes Hoellen yes Weil yes Maguire yes The vote on Council Bill 6, Series 2024 was 4 ayes and 0 nays. The motion carried. Possible motion to direct staff to take action consistent with discussion in executive session regarding publication of related election notices Mayor Pro Tern Weil moved, seconded by Councilor Maguire, to direct staff to take action consistent with discussion in executive session regarding publication of related election notices. August 26. 2024 City Council Minutes Page 2 of 4  RECORD OF PROCEEDINGS REPORTS Mayor’s Report Mayor Brown reported the City would host the Colorado Municipal League district meeting at the Village Club on September 12th Members of City Council Councilor Maguire had no report. Mayor Pro Tern Weil had no report. Councilor Hoellen had no report. Councilor Eber had no report. City Staff Chief Lyons reminded everyone to drive carefully in school zones now that school was back in session. Councilor Maguire asked about attempted break-ins last night. Chief Lyons replied the investigation was ongoing but it was a great example of collaboration between the community and the Police Department; through the vigilance of some of the homeowners the Police Department was able to identify suspects for the crimes that occurred in Councilor Maguire’s and Councilor Eber’s neighborhoods and an arrest had been made this afternoon. Deputy City Manager/Director Goldie reported Movie Night had been a success with the largest attendance to date; staff would bring the contract for the renovation of the Quincy Farm Big Barn to Council for consideration at the September 3rd meeting. City Clerk Gillespie reported the candidate nomination petition period was over and there were no contested races; the deadline to certify ballot content to the County was September 6th Director Farmen reported work continued on the 2025 proposed budget and staff would be setting up appointments with Council liaisons in the coming weeks. Mayor Brown noted the special session of the state legislature to address property taxes. City Attorney City Attorney Guckenberger had no report. City Manager City Manager Cramer reported the Arapahoe County Open Space shareback ceremony would be held September 18th• Councilor Hoellen noted the proposed legislation regarding property tax did not appear to be negative for Cherry Hills Village.
