Meeting Minutes Historic and Architectural Review Board (HARB) August 3, 2023 Public Safety Operations Center ROLL CALL HARB Members Present: Vice Chair Marilee Peterson, Gerald Martin, David Walski, Ervin Young, Ellsworth Spicher, and Frank Lilley Staff: Adam Lantz, City Attorney – City Attorney’s Office; Carlos Rodriguez, Code Enforcement Officer – Developments and Permits; Nat McCormick, Community Design Manger – Planning Department, Marvin Hodges, Senior Planner – Planning Department, and Kevin Finn, Recording Secretary – Planning Department. Vice Chair M. Peterson called the meeting to order at 5:30 p.m. MINUTES Approval of July 6, 2023 regular meeting minutes, motion to accept minutes made by E. Spicher and seconded by F. Lilley, all members present voting for. COMMITTEE REPORTS None ADMINISTRATIVE APPROVALS K. Finn reported nine (9) administrative approval. ZONING REPORT None OLD AND NEW BUSINESS 1. Special Meeting on August 24th to Discuss Design Guideline Update • N. McCormick gave a brief update on the Special meeting that will be held on August 24th for the Historic and Architectural Review Board to discuss their desired updates to the design and procedural guidelines. The Board confirmed that the Portlock Galleries at 5:30 PM would be an acceptable time and location. CONSENT AGENDA None REGULAR AGENDA 1219 Jackson Avenue (PLN-CAPP-2023-063) Original Request • Replace two wooden windows on the north side of the house with wooden windows, shortened to 46”; remove non-contributing front awning; replace front door with four-panel craftsman-style fiberglass door with 6-lite window, to be painted Hawthorne Yellow HC-4; replace rear door with two-panel steel door with 9-lite window; paint front porch Chelsea Gray HC-168. • Motion to approve application with the modification for the replaced windows to be 50” made by M. Peterson and seconded by E. Spicher, all members present voting for. 1100 Jackson Avenue (PLN-CAPP-2023-086) Original Request 1 • Install 12’ by 20’ full slab concrete driveway on Guerriere Street side. • Motion to approve the application as presented made by M. Peterson and seconded by G. Martin with five (5) members voting for and one (1) member voting against. 1101 Chesapeake Avenue (PLN-CAPP-2023-080) Original Request • Reissue PLN-CAPP-2022-153 to fill in removed door with matching brick, brick to be recessed one (1) inch from front face of the building. • Motion to approve the application as presented made by M. Peterson and seconded by E. Spicher with five (5) members voting for and one (1) member voting against. 1408 Jackson Avenue (PLN-CAPP-2023-082) Original Request • Reissue PLN-CAPP-2023-074 to install Victorian, turned spindles, 4” by 4”, with a top cap and bottom cap, 3” by 5”, to be painted white. • Motion to approve the application as presented with the modification of the top and bottom cap being approximately 3” by 5” made by M. Peterson and seconded by E. Spicher with four (4) members voting for and two (2) members voting against. 1101 Jackson Avenue (PLN-CAPP-2023-091) Original Request • Install 12 solar panels on rear roof. • Motion to approve the application made by M. Peterson and seconded by E. Spicher with all members voting against. 1109/1111 Rodgers Street (PLN-CAPP-2023-093) Original Request • After-the-fact replacement of metal roof, to be replaced with architectural shingle roof in charcoal. • Motion to approve the application as submitted made by M. Peterson and seconded by E. Spicher with four (4) members voting for and two (2) members voting against. 1211 Hull Street (PLN-CAPP-2023-096) Original Request • Replace 13 wooden windows to be replaced with vinyl windows. • Motion to approve the application as submitted made by M. Peterson and seconded by E. Spicher, with four (4) members voting for and two (2) members voting against. 1409 Jackson Avenue (PLN-CAPP-2023-097) Original Request • After-the-fact replacement of front porch with: tapered wooden columns painted white; 4-piece hand rail with 1- 13/16” pickets and 4” top rail, to be painted white; tongue and groove floor boards, to be painted Charcoal Gray, HC-178; wooden stairs; deck fascia board, to be painted white; wrought iron railing as depicted; porch skirt to be brick similar to that of house; all to be built as depicted on site plan submitted on 7/25/2023. • Motion to approve the application as submitted with the modification to remove the wrought iron railing and install a wooden handrail in style similar to that proposed for porch handrail made by E. Spicher and seconded by G. Martin with all members present voting for. PUBLIC INPUT None LEGAL GUIDANCE A. Lantz informed the Board that applicants must provide verbal consent to their application being continued, in accordance with CZO §12-708(c) which states that final action must be taken within seventy (70) days of the initial filing unless the applicant agrees to an extension. K. Finn stated that if an applicant does not consent to their application being continued, the Board will then motion to either approve or deny the application, allowing the applicant the opportunity to appeal the decision by the Board to City Council, if they so wish. F. Lilley requested the City Attorney explore whether drones could be used to inspect whether elements on homes within the Historic District are beyond responsible repair. F. Lilley also discussed the consistency of the Board’s decisions on various types of applications. A. Lantz reminded the Board that being consistent in their decisions is important and that the discussions on applications, both during the review and after, are public record and can be requested by other future 2 and past applicants. M. Peterson stated that each property and application reviewed by the Board are unique and while consistency is important, the Board has the flexibility to take additional factors into consideration when rendering a final decision.
