Got 190 signatures against the project Half are homeowners. Worry about peace and serenity of the neighborhood. Property values will drop, better use for this project Clinical social worker, usually at a bigger campus. Better uses for Willimansett Nursing Home. Les Bowler, 20 State Street, retired health care executive. Intimately familiar, worked with practices of addiction and pain management. Must be monitored with strict guidelines. Patterns, problematic. Brother was an addict, became a quadriplegic driving impaired. Location is ill advised for the project. Three points, would you vote yes if it was next to your house? Will people seek abatements? Never purchased a building for this unless all the l's were dotted and the t's were crossed. Find out how many section 35 people will be housed there. Don Lamothe, 164 Meadow Street, spoke at the Planning and sub-committee levels, will put a special restriction on them. There are 190 people that signed this petition. Have office hours once a month, worried about the bus stop being moved from in front of Walmart to Panera. Difficult if not impossible for people with disabilities to navigate. Councilor Bala kier absent. MO-7 Be it Ordered, in accordance with Sections 14, 15, and 15A of the Massachusetts General Laws and the City Charter, the City be authorized to relocate a sewer easement located at 1601 Westover Road to reconcile the physical location of a sewer line with the necessary legal interest of the City in the property by releasing its existing easement recorded in Book 18133 and Page 549, at the Hampden County Registry of Deeds, and accept a new easement from the owner of record in a location reflected on a plan attached to this Order and recorded at the Hampden County Registry of Deeds in Book of Plans 358, Page 99. Be it Further Ordered that the Mayor be authorized to execute any release, easement, agreement, written instrument, or other required formalities reasonably expected to legally relocate this easement. --Motion made by Councilor Wagner to receive and pass. Councilor Balakier absent. 21 A favorable Water Resource Committee report: Be it Ordered that the Water Resource Committee meet to discuss the status of water rates. --Motion made by Councilor Arriaga to receive and placed on file. Councilor Arriaga stated thank Liz Batista held a wonderful meeting. How they get rates. Won't do sewer and water in the same year. Easy as possible on households. Councilor Pniak-Costello stated very informative, resident had questions. Questions could be asked through the internet. Don't know if their questions got answered. Councilor Balakier absent. 22 A favorable Zoning Committee report: Special Permit application under Chapter 275-53 (B) (14) for the purpose of kennel license for 4 pet French Bulldogs located at 25 Mayflower Ave. Applicant-Brittany Morse, 25 Mayflower Ave., Chicopee, MA 01013. --Motion made by Councilor Labrie to receive and the Special Permit approved. Councilor Labrie stated inspected by TJO, Health and Planning approved. No neighborhood opposition. Motion passed through all stages by a unanimous roll call vote. 23 An unfavorable Zoning Committee report: Special Permit application under Chapter 275- 52 (B) (13) for the purpose of a dog kennel license for our nine Yorkies to comply with the MA law of having 4 or more in our home and yard located at 55 Paul Ave. Applicant - Antonieta Wilson Mathieson, 55 Paul Ave., Chicopee, MA 01020. --Motion made by Councilor Labrie to receive and deny the Special Permit. Councilor Labrie stated the four bullet points on committee report. Inspected by Health and TJO, at least 9 dogs, 2 not vaccinated. Motion to deny passed by a unanimous roll call vote. 24 A favorable Zoning Committee report: Zone Change application from Residential A to Residential B for 22.034 square feet of property located at 100 Beaumont Avenue for the purpose of construction of two single family residences. Applicant: Andrew Crane, 44 Sandtrap Way, Chicopee, MA 01020.  --Motion made by Councilor Labrie to approve the Zone Change with a 2°d by Councilor Kram pits. Councilor Labrie stated no neighbor opposition. Planning Director was in favor. Motion passed through all stages by a roll call vote of 11 yes, 1 out of chair. Councilor Laflamme out of chair. 25 A favorable Zoning Committee report: Zone Change application from Business A to Residential B for .7775 acres of property located at 11 St. Anthony Street for the purpose of allowing for the most appropriate use of the existing structures by aligning with the zoning code's definition of "Hospital." This change will support the provision of essential health and recovery services for the community. Applicant: John Murphy, 16 Bay Road, Hamilton, MA 01982. --Motion made by Councilor Labrie to approve the Zone change. Councilor Labrie stated Definition would be a hospital. Planning recommended approval. Councilor Courchesne stated no Section 35. Ask the Council to deny the Zone Change. Will only accommodate a rehab center. Constituents came out against this. Not about stigma, not in a good spot. Location is not appropriate. Councilor Pniak-Costello stated the meeting was informative. May not be the right area for this. Area and the neighborhood is concerned. Councilor Goff stated also ask to deny, not the right spot for it. Should be consistent for the neighborhood. Type of care they need don't believe the facility would fit. Don't know how many beds they would have. Not a court order facility. Staffing shortages. Residents can scan out and scan back in. Area has restaurants, bars and children. High probability something could happen. How many ambulances? How many police? Councilor Krampits stated was able to listen to the meeting. See the need, don't think it's the right location Councilor Wagner stated we like to say no a lot in this city. We don't know what the plan will be. We have the second highest rate of overdose deaths in Chicopee. No win for anything in Chicopee. House after house, fixed, static we have no space for anything. Lead to prevalence of no. There will never be a right place or a right time. Residents/citizens have needs. Healthcare industry is responsible for many problems. Hear the ideas. Want to hear the proposal out. Vacant for several years, no interest in housing there. Mentality is outdated. Want to hear yes. Councilor Shumsky stated agree with some of Council Wagner, this is a Zone Change preliminary. No solid plans put in front of us. Interested in hearing them out. Councilor Courchesne stated chair allowed questions to be asked and answered. We've already heard them out. Very specific. Motion denied by a roll call vote of 3 yes, 8 no. Councilors Wagner, Arriaga, and Shumsky voting yes. Councilor Balakier absent. 26 A Zoning Committee report: Zone Change application from Business A to Residential B for .284 acres of property located at 0 Chicopee Street (Parcel ID 0500-00051) for the purpose of allowing for the most appropriate use of the existing structures by aligning with the zoning code's definition of "Hospital." This change will support the provision of  essential health and recovery services for the community. Applicant: John Murphy, 16 Bay Road, Hamilton, MA 01982. --Motion made by Councilor Labrie to approve the Zone Change. Councilor Labrie stated would be defined as a hospital. Planning Board voted for approval. Motion denied by a roll call vote of 2 yes, 9 no. Councilors Wagner and Shumsky voting yes. Councilor Bala kier absent. 27 A Zoning Committee report: Zone change application from Business A to Residential B for .9926 acres of property located at 546 Chicopee Street for the purpose of allowing for the most appropriate use of the existing structures by aligning with the zoning code's definition of "Hospital." This change will support the provision of essential health and recovery services for the community. Applicant: John Murphy, 16 Bay Road, Hamilton, MA 01982. --Motion made by Councilor Labrie to approve the Zone Change. Councilor Labrie stated would change the definition to hospital. Planning recommended approval. Motion denied by a roll call vote of 2 yes, 9 no. Councilors Wagner and Shumsky voting yes. Councilor Balakier absent. 28 A proposed Ordinance adding to Chapter 260-37.1 Engine Brakes Prohibited. Add Griffith Road-at the intersection of Griffith Road and James Street to the end of Griffith Road. --Motion made by Councilor Pniak-Costello to receive, 1st reading and refer to the Ordinance Committee. Councilor Pniak-Costello stated self-explanatory. Councilor Shumsky stated did some homework on this. Discussed the topography of the area. Residents have never complained. Issue doesn't exist. Councilor Pniak-Costello stated borders her ward, have had complaints. People are complaining about the noise. Without residential concern I would not bring this forward. Councilor Shumsky stated all the businesses that are back there it is private property. Not much we can do. Councilor Pniak-Costello stated did not say on private property. Should be discussed in committee. --Motion made by Councilor Shumsky to allow Councilor Laflamme to speak. Motion passed by a roll call vote of 10 yes, 1 abstained. Councilor Laflamme abstained. Councilor Bala kier absent. Councilor Laflamme stated just listened to the whole conversation between the two councilors, do your homework first. Not going to support this. Add James Street-James Street starting at the Memorial Drive intersection to the end of James Street at the Westover Gate.  --Motion made by Councilor Pniak-Costello to receive, 1st reading and refer to the Ordinance Committee. Councilor Pniak-Costello stated basically the same type of issue. Councilor Shumsky stated is it the same resident? Councilor Pniak-Costello stated yes. Councilor Bala kier absent. 30 Be it Ordered that the City Council meet with the State Delegation to discuss Memorial Drive Revitalization Plan dated 10-1-2014. --Motion made by Councilor Shumsky to receive and refer to the Committee of the Whole. Councilor Shumsky stated brought attention to the issues on Memorial Drive. Corridor needs revitalization. Mayor Kos had UMass come in and do a study. Covered traffic design, zoning overlays, worth a discussion. Been 11 years. Interesting study, will send to all members. Very comprehensive. Councilor Pniak-Costello stated great idea to discuss, extremely old study. Why wasn't this implemented? Do we need a new study? What happened/why wasn't it implemented? Happy that you'll meet with the delegation. Happy Representative Arriaga and team will be involved. Councilor Arriaga stated questions, because it is so outdated. History of why? Better with some game plan/idea. New study will need to be done, business is different. Councilor Courchesne stated anything after 5 years needs to be redone. Wasted money on the previous study. Definitely need to have it done again. Could never use a study that is 11 years old. Councilor Shumsky stated did do homework. Meeting with Lee Pouliot, actual data itself needs to be updated. Agnes will be sending out information. A lot to it, beneficial for all. Work together as one team Chicopee. Councilor Arriaga stated like the idea a lot, like to see. Live off Memorial Drive. Love Chicopee, like this idea. For it. Councilor Pniak-Costello stated like the idea but want more updated information re: traffic patterns. Councilor Balakier absent. 31 A proposed Ordinance: Delete Chapter 188-17 0(2) And Insert in Place Thereof 2. Qualification of licensee. In addition to the requirements of Section G of this Ordinance, each salesperson must submit an application signed under the penalties of perjury to the Chief of Police or designee. No fee is required for applications made under paragraph D of this Ordinance. Subject to the provisions of the Massachusetts Criminal Records Offender Statute, MGL c. 6, § 167 et seq., and regulations promulgated thereunder, the Chicopee Police Department shall conduct a criminal record check of each applicant aged 15 or older for a door-to-door sales License to determine the applicant's fitness and suitability to conduct door-to-door sales. If a person is supervising a group of people under the age of 15, that  supervising person shall undergo a criminal record check pursuant to this section and shall be issued a group number to be used by said group members. The Chief of Police or their designee shall have authority to grant one such license to any person of good repute for morals and integrity who is a citizen of the United States or permanent resident. --Motion made by Councilor Goff to receive, pt reading and refer to the Ordinance Committee.
