CHICOPEE CITY COUNCIL CLAIMS & ACCOUNTS COMMITTEE MEMBERS Frank Laflamme, Chairman Gary Labrie, Vice Chairman Fred Krampits Stan Walczak William Zaskey MINUTES March 14, 2016 The following are the minutes of a public hearing held Monday, March 14, 2016 at 6:30 PM in the City Council Chambers, Fourth Floor, City Hall Annex, 274 Front Street, Chicopee, MA 01013. Members Present Laflamme, Labrie, Krampits, Walczak, Zaskey Also Present Daniel Garvey (Associate City Solicitor), Sharyn Riley (Auditor), Harold (Lefty) Thompson (Insurance Claim Officer), Amy Rivera (Assistant DPW Superintendent) The meeting was called to order at 6:30 PM. In compliance with the Open Meeting Law the Chairman asked if anyone in the audience was recording the meeting. Claim 16-1 David Griffith – stated that he was driving on Narragansett Boulevard toward Chicopee Street. He noticed a wet area and there was a car turning into Narragansett Boulevard so he could not swerve to avoid the area. This resulted in a damaged tire and rim. It cost him $90 to repair. Amy Rivera stated that at the October 29th Water Commission meeting this claim was on the agenda and at that meeting Mr. Pinciak said that this claims should go through the Claims & Accounts Committee. Motion made by Councilor Labrie and second by Councilor Walczak to refer to the Water Commission as they have their own Claims and Account funding. Also a letter be sent to the Water Commission. Motion passed. Claim 16-2 Roberto Ramos – Forwarded to Sewer Commission CSO project. Claim 16-3 Alice Garzynski – Her neighbor came in to represent her. She is 86 and has difficulty walking. Ms. Garzynski’s mailbox was damaged during an ice storm. It’s currently being held up by a stick. Councilor Laflamme stated that Ms. Garzynski called him and he went and tried to fix the mailbox because she is elderly and needs the mailbox to receive her medication. Amy Rivera stated that it was the ice that hit the mailbox not the plow. Lefty stated that he priced the mailbox at Home 1 Depot at $64.51. Motion made by Councilor Walczak and second by Councilor Labrie to approve $64.51. Claim 16-4 Carol Labrie - Forwarded to Sewer Commission CSO project. Claim 16-5 Doris Dietrichsen – Her mailbox was hit when there was an ice storm. Amy Rivera stated that Mike Cerra was plowing at the time and he did say three mailboxes went down when the ice from the plow hit them. Motion made by Councilor Labrie and second by Councilor Krampits to approve $37.16. Motion passed. Claim 16-6 Annmarie Wilson – Her husband was driving her car on Chicopee Street and hit a pothole. Paid $321 for the repair. Amy Rivera couldn’t find any work orders for this pothole. Lefty stated that he called Curry the repairs were done and that the car was damaged. Motion made by Councilor Krampits and second by Councilor Labrie to pay $150.00 because DPW could not verify work order. Motion passed. Claim 16-7 Joanie Hebert – On December 28th her mailbox was hit when the plow was going down her street. The receipts that Ms. Hebert produced looked as if anyone could have written them up and the claim was filed beyond the 30 days. Motion made by Councilor Zaskey and second by Councilor Krampits to deny. Motion passed. Claim 16-8 Dawn Cantin - Forwarded to Sewer Commission CSO project. Claim 15-37 Joseph Sepulveda – Mr. Sepulveda was not present. Motion made by Councilor Labrie and second by Councilor Krampits to table to end of meeting. Motion passed. Motion made by Councilor Labrie and second by Councilor Walczak to deny. Motion passed. Claim 15-41 Daniel Jaracz – Mr. Jaracz was not present. Motion made by Councilor Labrie and second by Councilor Krampits to table to end of meeting. Motion passed. Motion made by Councilor Krampits and second by Councilor Walczak to deny. Motion passed. Claim 15-45 Patrick Divine - Mr. Devine stated that he was traveling on Burnett Road and in front of McDonald’s he hit a large pothole that had a drain sticking out. He damaged his tire. Amy Rivera stated that she investigated the area and the only patch with a drain was close to the curb. She stated that if Mr. Devine hit that drain he would have gone over the curb. She found no work order for a pothole in that area. Motion made by Councilor Labrie and second by Councilor Walczak to pay $300.00. Motion passed. Claim 15-47 Jenny Cortez - Ms. Cortez stated that Volpe Drive was full of potholes. She hit one and damaged her muffler pipe, converter box, gas tank, and tire. She spent over $1,500.00 to repair the vehicle. The committee was concerned that the receipts presented didn’t match the vehicle in question. Lefty Thompson stated that the gas tank was bent. Amy stated that Volpe Drive is not a City street. Motion made by Councilor Walczak and second by Councilor Krampits to deny and refer to the Housing Authority since this is Housing Authority property. Motion passed. Claim 15-49 Michael Tarrant – Mr. Tarrant stated that his trash barrel was either placed into the recycling bin or on top and when the recycling was picked up his trash barrel was also disposed of. He did not know where he purchased the barrel nor how much he paid for it. Motion made by Councilor Labrie and second by Councilor Krampits to postpone to the next meeting and for Mr. Tarrant to provide a receipt. Motion passed. 2 Minutes – October 22, 2015. Motion made by Councilor Labrie and second by Councilor Walczak to approve. Motion passed. Meeting adjourned at 7:28 PM. 3
