CHICOPEE CITY COUNCIL CLAIMS & ACCOUNTS COMMITTEE APPROVED 12-12-2017 MEMBERS Frank Laflamme, Chairman Gary Labrie, Vice Chairman Fred Krampits Stan Walczak William Zaskey MINUTES April 10, 2017 The following are the minutes of a public hearing held Monday, April 10, 2017 at 6:30 PM in the City Council Chambers, Fourth Floor, City Hall Annex, 274 Front Street, Chicopee, MA 01013. Members Present Laflamme, Labrie, Krampits, Walczak, Zaskey Also Present Daniel Garvey (Associate City Solicitor), Sharyn Riley (Auditor), Jeff Neece (DPW Superintendent), Elle Soja (DPW Assistant), Councilor Courchesne, The meeting was called to order at 6:30 PM. In compliance with the Open Meeting Law the Chairman asked if anyone in the audience was recording the meeting. Councilor Zaskey motion to take Claim 17-15 out of order – Councilor Walczak second the motion – motion passed Claim #17-15 Helen Billeter 1133 Burnett Road Type of Damage – Mailbox Damage Restitution Sought – 88.97 Helen Billeter was present she stated that the snow plow hit her mailbox in February but she didn’t put in a claim and then they hit it again in March on a Sunday during a storm and this is the claim she’s putting in for. Motion made by Councilor Labrie to pay pending a receipt – Councilor Krampits 2nd the motion – motion passed 1 Councilor Krampits motion to postpone until the end of the meeting – Councilor Walczak 2nd the motion – motion passed Councilor Krampits motion to remove from postponement – Councilor Labrie 2nd the motion – motion passed Councilor Krampits motion to postpone to our next meeting – Councilor Laflamme 2nd the motion – motion passed Roland Destromp 423 Springfield Street Type of Damage – Towing Restitution Sought - $130.00 Claimant was not preset Claim #17-1 Jeremy Brown 173 Mayflower Avenue Type of Damage – Vehicle Damage (pothole) Restitution Sought - $300.00 Jeremy Brown was present he stated that he received a flat tire two times in the same week from the same pothole. He notified the DPW when he hit the pothole the first time. Councilor Labrie motion to pay – Councilor Zaskey 2nd the motion – motion passed Claim #17-2 Isabelo Martinez 64 Artisan Street Type of Damage – Towing Restitution Sought - $130.05 Isabelo Martinez was present he stated that he had a stroke and was in the hospital for a week. He had no one to move his vehicle and it was towed. Councilor Zaskey motion to pay – Councilor Walczak 2nd the motion – motion passed Claim #17-3 William Bourgeoise 27 Palmer Avenue Type of Damage – Towing Restitution Sought - $281.80 William Bourgeoise was present he stated that he works for BG Mechanical and his commercial vehicle was towed from in front of his house. My street is not on the parking band list of streets and it’s posted on the even side but my truck was towed from the odd side. Councilor Zaskey stated this is the second time this has happened to this gentleman. Dan Garvey stated that according to the ordinance a person must make a claim within thirty days. Councilor Krampits motion to deny – Councilor Laflamme 2nd the motion – motion passed. 2 Claim #17-4 Cesar Valentin 1153 Grattan Street, 1st floor Type of Damage – Vehicle damage (pothole) Restitution Sought - $75.00 Claimant was not present. Sharon Riley stated he called and said he could not make tonight’s meeting. Councilor Zaskey motion to pay – Councilor Krampits 2nd the motion – motion passed Claim #17-5 Karen Gendron Claim Withdrawn – Location of incident was on a State Road Sharon Riley stated that she contacted Karen Gendron to let her know it was a State Road not a City Road. This claim was automatically denied and referred to the State. Claim #17-6 Nataliia Zgerya 151 Narragansett Blvd Type of Damage – Vehicle Damage (pothole) Restitution Sought - $218.88 Nataliia Zgerya was present she stated that she was driving to work to Holyoke through Chicopee Street and hit a pot hole and damaged both tires. Both tires were too damaged to repair so she had to buy new ones. Councilor Walczak motion to pay – Councilor Krampits 2nd the motion – motion passed Claim #17-7 Marisari Rosario 357 Chicopee Street Type of Damage – Vehicle Damage (pothole) Restitution Sought - $134.83 Marisari Rosario was present she stated that as she turned down McKinstry and Dale Street, It was raining and dark and she hit a huge pot hole. Councilor Walczak motion to pay – Councilor Labrie 2nd the motion – motion passed Claim #17-8 Mark Cross 52 Downey Drive Type of Damage – Mailbox Restitution Sought - $67.94 Mark Cross was present he stated that his mailbox and post were hit on the night of February 9th and on February 13th we submitted photo’s. As a result we went out and bought a new mailbox and post and installed it. Councilor Labrie motion to pay – Councilor Laflamme 2nd the motion – motion passed 3 Claim #17-9 Steve Feather 18 Atwater Street Type of Damage – Towing Restitution Sought - $183.89 Claimant was not present Councilor Labrie motion to postpone – Councilor Krampits 2nd the motion – motion passed Claim #17-10 Aimee Ludwin 65 West Street #202 Type of Damage – Vehicle Damage (pothole) Restitution Sought - $261.00 Sharon Riley said Aimee Ludwin called and could not make it. Councilor Labrie motion to postpone – Councilor Krampits 2nd the motion – motion passed Claim #17-11 Sylvia Collins 63 Coakley Drive Type of Damage – Mailbox Restitution Sought - $70.00 Claimant was not present Councilor Labrie motion to postpone – Councilor Krampits 2nd the motion – motion passed Claim #17-12 Renata Talmont 20 Donlyn Drive Type of Damage – Vehicle Damage (pothole) Restitution Sought - $152.75 Renata Talmont was present she stated that she was picking up her son from her parents house on Dresser Avenue which is a dead end and they have a cut through which is connected to their driveway that is connected to Grant Street. There was a car parked on the left side and I moved over and as I went to go onto Fairview I hit a pothole. She stated when she got home my husband noticed a gouge in the tire. Councilor Labrie motion to pay $132.75– Councilor Walczak 2nd the motion – motion passed Claim #17-13 Deborah Batalha 68 Coakley Drive Type of Damage – Mailbox Restitution Sought - $60.00 4 Deborah Batalha was not preset. Councilor Laflamme motion to postpone – Councilor Laflamme 2nd the motion – motion passed Claim #17-14 Roberto Ramos 35 St. Anthony Street Type of Damage – Vehicle Damage (pothole) Restitution Sought - $300.00 Claimant was not present Councilor Zaskey motion to postpone – Councilor Krampits 2nd the motion – motion passed Claim #17-16 Jose Comchina 109 Blanchwood Avenue Type of Damage – Vehicle Damage (pothole) Restitution Sought - $153.63 Sharon Riley stated that Jose Comchina called and could not make it.
