CHICOPEE CITY COUNCIL LICENSE COMMITTEE ACCEPTED License Committee Members Dino Brunetti, Chairman Donald Demers, Vice Chairman Frank Laflamme Robert J. Zygarowski Fred Krampits MINUTES February 25, 2013 The following are the minutes of a public hearing held Monday, February 25, 2013 at 6:30 PM in the City Council Chambers, Fourth Floor, City Hall Annex, 274 Front Street, Chicopee, MA 01013. Members Present Brunetti, Demers, Laflamme, Krampits, Zygarowski Also Present Kate Brown (Planning Director), Lonny Dakin (Police Captain), Thomas Charette (Acting Police Chief), Councilor Tillotson, Dan Garvey (Associate City Solicitor) The meeting was called to order at 6:31 PM. ITEM #1 ORDERED THAT the following license holders appear before the License Committee regarding the recently adopted ordinance Chapter 188-25 Records Retention:  Kane’s Scrap Metal  Willamansett Waste  Money Stop  Polgold  Game Stop  Hollister Jewelers  Broadway Coin  Furnari Jewelers  KNT Computers  Video Game Castle  Sayegh Jewelers  Ryan Jewelers 1  The restrictions on the Licenses of the above named License Holders shall include the requirements of 188-25  Effective date May 7, 2013 Dan Garvey stated several months ago the City Council passed an Ordinance 188-25. The reason why we took that up is to try and curb some thefts and stolen property issues that the City was having. What 188-25 does is that any License the City deems appropriate has to install a program that’s going to be offered to them and installed to them by a member of the Chicopee Police Department. The program will require you to keep the name of the person that’s pawning the item and a detailed description of what has been pawned. Once the information is installed it will be available to the Chicopee Police Department and all other Police Departments that are involved in this particular type program. Councilor Laflamme stated are we asking these little companies to record everything such as every truck that brings in a little scrap metal, they back up four trucks at a time and that is impossible. Dan Garvey stated it’s the Council’s prevue to deem which one if any is appropriate; if you deem salvage yards that accepts scrap metal not appropriate then they’re not subject to this particular ordinance or you can mandate such items as mufflers. Ralph of Video Game Castle was concerned about how safe this system is in regards to customer’s identities. Dan Garvey answered when Captain Muse was here that was brought up and he assured us that this is in fact a secured line and the only parties that have access to this are Law Enforcement Officials. Councilor Brunetti stated I’ve been on the License Committee for eight years now and can honestly say that we haven’t had any serious issues with the businesses that we have in the City of Chicopee. Chris of the Game Stop stated that most of these stores are individually owned and Game Stop is Corporate. We do have a system in place, is this something additional that we have to communicate to corporate. Acting Police Chief Charette answered no it does not have to go to anyone else. When you load your information into this software that you’re going to be provided with it will go straight to our link. It will be a separate piece of software installed into your system. Richard of the Money Stop stated our software will interact with NESPIN’s program so do we have to go through the Police Department at this particular point. Acting Police Chief Charette answered if you are already uploaded to NESPIN they will probably just come out and check it. Bruce of Willamansett Waste stated that we have five customers at a time with a pick-up truck full of assorted stuff, how do we log that in. Acting Police Chief Charette answered we’re looking for something that’s describable like three air conditioners. Robert of Kane Scrap Metal asked is this separate invoice software. Councilor Krampits answered I think what’s going to happen as this rolls out is it’s going to be looking at individual point of sales software. Councilor Tillotson stated if anyone of you feel that this does not apply to your business and you would like to have your license reviewed just make a request to the License Chairman to schedule an appointment. Our intent is to make it easier for the public who have stolen merchandise to get it back if possible. When you try to make an Ordinance to fit everyone it’s difficult, that’s why they have the discretion of making exceptions. I think the process will be fair and everyone will be happy in the end. Motion to approve – motion passed Committee vote 5 -0 favorable. 2 ITEM #2 Application for an Auto Repair for RPM Auto Repair, 920A Meadow Street, Chicopee, MA 01013 Applicant Jose Agustin Medina 16 Joanne Road Springfield, MA 01119 Applicant was present with translator The following reports were read: Planning Looks fine. Business A zone. Use is by right subject to license. Engineering Approval Conditions Good Housekeeping No outside storage No junk cars No outside repairs Total Number of vehicles 9 Inside 4 Outside 5 Employee 2 Customer 3 Hours of operation: Mon. – Fri. 8:00am – 6:00 pm Sat. 8:00 am – 2:00 pm No Sundays Motion to approve License with existing restrictions. Motion to approve – motion passed Committee vote 5 – 0 favorable. ITEM #3 Application for an alteration on a Class II and Auto Repair Licenses for change of corporate officers for Two Guys Auto Sales, 926 Front Street. 3 License Holder: Yolanda Evan 42 Franklin Street, #2 Westfield, MA 01085 Applicant was present she stated that we are changing the names and I will be listed as Treasurer so the names will be accurate on the license.  Yolanda Evan will be the Treasurer. Motion to approve – motion passed. Committee vote 5– 0 favorable. ITEM #4 Minutes – January 30, 2013. Motion made to accept. Motion passed. Meeting adjourned at 7:31 PM. 4
