CHICOPEE CITY COUNCIL LICENSE COMMITTEE DRAFT License Committee Members Dino Brunetti, Chairman Donald Demers, Vice Chairman Frank Laflamme Robert J. Zygarowski Fred Krampits MINUTES April 29 , 2013 The following are the minutes of a public hearing held Monday, April 29, 2013 at 6:30 PM in the City Council Chambers, Fourth Floor, City Hall Annex, 274 Front Street, Chicopee, MA 01013. Members Present Brunetti, Demers, Laflamme, Krampits, Zygarowski (arrived 6:35) Also Present Kate Brown (Planning Director), Dan Garvey (Associate City Solicitor) The meeting was called to order at 6:30 PM. ITEM #1 Application for a Service Station License for Marroff Ahmad located at 1177 Granby Road. Applicant Marroff Ahmad 1177 Granby Road Chicopee, MA 01013 Applicant was present he stated that he’s here to apply for his service station license at 1177 Granby Road. Councilor Brunetti asked are you the owner of the property. Marroff Ahmad answered yes. Councilor Brunetti was concerned about the parking lines. Marroff Ahmad stated we will repaint the parking lines before we open on June 1st. Councilor Brunetti stated you will need a plot plan showing where you will have parking for employees and your customers. The following reports were read Planning 1  Subject property is zoned properly for service station and convenience stores.  Below find the requirements for site plans submitted for service station license. Current plan is not to the required 1:20 scale, zoning and land use for abutting property is not shown, details reading location of storage tanks and all associated equipment is not shown. I will leave it to Fire, Engineering, and the Committee to determine if sufficient information is provided for the purpose of approval.  Since Pride sold this property, the tree belt at this location has been poorly maintained. For and independent owner to compete at this location some attempt should be made to maintain a tidy entrance to the site. Chapter 188-20 Service and Self Service Station Licenses B. Applications (1) All applications for new licenses, transfers and any and all interior or exterior or alterations to the existing premises or licenses shall be accompanied by seven copies of a site plan, drawn to a scale of one to 20, showing the following: [Amended 3-16-1999 by Ord. No. 99-21D; 9-18-2003 by Ord. No. 03-31; 6-21-2005 by Ord. No. 05-154; 11-15-2005 by Ord. No. 05-175] (a) Existing and proposed lines of streets, ways, easements and public areas. (b) Lot lines with dimensions. (c) Ownership, zoning and use of abutting land. (d) Location of proposed and existing buildings, vehicle storage areas and other storage areas. (e) Location of existing and proposed lighting, signs and fences or hedges. (f) Location of existing or proposed underground or aboveground storage tanks and all associated equipment. Fire Department The applicant shall read, understand and adhere to ALL applicable Codes, Regulations, Ordinances and Standards including but not limited to: 1. The business shall comply with the following Board of Fire Prevention regulations: 527 CMR 5.00 Operation and Maintenance of Buildings or Other Structures Used as Garages, Service Stations, and the Related Storage, Keeping and Use of Gasoline or Other Motor Fuel; 527 CMR 9.00 Tanks and Containers; 527 CMR 10.00 Prevention of Fires in Buildings; 527 CMR 14.00 Storage of Flammable Liquids and Gases. 2. Applicant will be required to obtain all necessary permits. [527 CMR 1.04(8)]. 3. The storage, handling and mixing of flammable and combustible liquids shall meet the requirements of NFPA 30, Flammable and Combustible Liquids Code. [780 CMR 419.2.3]. 4. Applicant shall adhere to applicable sections of NFPA 30A. 5. No parking against the structure. 6. Maintain access for Emergency Vehicles. 7. Approved FIRE LANES shall be marked and maintained as required. 8. Fire extinguishers are required. All extinguishers must be rated at a minimum of 40 B:C. The number of extinguishers required will be determined at a later date. [527 CMR 5.09(8)]. 9. Proper address numbering per Code of City of C hicopee. 10. All permits, licenses and inspections shall be completed prior to conducting business. Engineering Plan is not 20 scale. Underground storage tanks are shown. Parking is not shown. 2  Contingent of plot plan and storage tank location Motion to approve – motion passed Committee vote 5 – 0 favorable. ITEM #2 Application for an Auto Repair License RC’s Auto & Marine located at 680 Prospect Street. Applicant Ronald J. Certer 1215 Grattan Street Chicopee, MA 01013 Councilor Brunetti stated I called the applicant this morning to see if he had a lease on this property and he made me aware that the owner of the property leased it out to a Landscaping Company. So he has asked for a leave to withdraw but, I didn’t receive a letter from him so we’re going to ask for a denial of this. Motion to deny – motion passed Committee vote 5–0 ITEM #3 Application for a Junk Dealer’s License at 601 Memorial Drive for Sayegh Jewelers. Applicant Adib (Eddy) J. Sayegh 601 Memorial Drive Chicopee, MA 01020 Councilor Brunetti stated when we did the License renewals we noticed you never had a Junk Dealers License and a license is required. This was an oversight by the City and now this meeting is for you to get a Junk Dealers License. Adib (Eddy) J. Sayegh stated I wasn’t aware that I needed one. Committee vote 5–0 ITEM #4 Application for a Junk Dealer’s License at 63 Cabot Street for Polgold Jewelers, LLC. Applicant Waclaw Plewa 15 Carriage Road Chicopee, Ma 01013 Councilor Brunetti stated this was also an oversight by the City and he is here to get his Junk Dealers License as well. 3 Committee vote 5–0 ITEM #5 Application for a Junk Dealer’s License at 649 Memorial Drive for Game Stop to buy and sell games and consoles. Applicant Christian Holguin 133 Crescent Drive Chicopee, MA 01013 Councilor Brunetti stated this was also an oversight by the City and he is here to get his Junk Dealers License as well. Committee vote 5–0 Minutes – March 25, 2013. Motion made to accept. Motion passed. Meeting adjourned at 7:02 PM. 4
