City of Chicopee City Council License Committee Approved 3-27-2017 Members William Zaskey, Chair Fred Krampits, Vice Chair Frank Laflamme Shane Brooks Stan Walczak MINUTES February 27, 2017 The following are the minutes of a public hearing held Monday, February 27, 2017 at 6:30 PM in the City Council Chambers, Fourth Floor, City Hall Annex, 274 Front Street, Chicopee, MA 01013. Members Present Krampits, Laflamme, Walczak Members Absent Zaskey, Brooks Also Present Dan Garvey (Associate City Solicitor), Councilor Zygarowski, The meeting was called to order at 6:30 PM In compliance with the Open Meeting Law the Chairman asked if anyone in the audience was recording the meeting. Hearing none the meeting continued. ITEM #1 Application for an amendment of a Class III and Junk Dealers License to add a D/B/A to the corporation name listed. Current name: Krunali, Inc., at 2 Mill Street to Krunali, Inc., D/B/A Chicopee Scrap Metal & Auto Recycling. Applicant Henry Patel 134 South Street Belchertown, MA 01007 Mr. Patel was present at the meeting. He is requesting that a D/B/A be added to the business name. Motion made by Councilor Laflamme and second by Councilor Walczak to approve. Committee vote 3 – 0 favorable. ITEM #2 Application for an amendment to an underground fuel storage to correct the gallons listed. There was an increase of 10,000 gallons (from 30,000 to 40,000 gallons) granted previously for plans that were abandoned for 2012 Memorial Drive. License to now read 30,000 gallons. 1 Applicant Nouria Energy Janice Lea 15 Casmir St. #2 Westfield, MA 01085 Ms. Lea was present at the meeting. She stated that when F.L. Roberts owned the business they requested 10,000 gallons of diesel fuel. Nouria Energy does not intend to sell diesel and therefore does not need the 10,000 gallons listed on the license. Councilor Walczak stated that drivers cutting through create a potential hazard. He recommended that signage may be a good idea. Ms. Lea stated that she will speak with her boss about adding signage but in the meantime suggested that cones be added. Reports read from the following departments: Engineering: No engineering comments Planning: Property is zoned Business A; use is permitted. Existing use, just reducing total volume of fuel that could be stored on site. Recommend approval. Fire: No issues, no concerns, no objections. Motion made by Councilor Laflamme and second by Councilor Walczak to approve. Committee vote: 3 – 0 favorable. ITEM #3 Application for an Auto Repair License for Economy Auto Service located at 957 Meadow Street. Applicant Ariel Ortiz 32 Lawn Street South Hadley, MA 01075 Mr. Ortiz was present at the meeting. Reports read from the following departments: Fire: Applicant is expected to read, understand, and abide by all applicable codes and regulations. 1. The business shall comply with Massachusetts Board of Fire Prevention Regulations: 527 CMR 5.00 Operation and Maintenance of Buildings Used for Garages; 527 CMR 9.00 Tanks and Containers (Waste Oil Storage); 527 CMR 10.00 Prevention of fires in Buildings and 527 CMR 14.00 Storage of Flammable Liquids and Gases (Only Approved Flammable Storage Cabinets) 2. Applicant will be required to obtain all necessary permits. [527 CMR 1.04(8)] 3. The storage, handling and mixing of flammable and combustible liquids shall meet the requirements of NFPA 30, Flammable and Combustible Liquids Code. [780 CMR 419.2.3] 4. Applicant shall adhere to applicable sections of NFPA 30A. 5. Maintain FIRE LANES around building. No Vehicle Storage Against Building. 6. Maintain access for emergency vehicles at all times. 7. Storage of junk vehicles shall be orderly 8. Fire extinguishers are required. All extinguishers must be rated at a minimum of 40 B.C. The number of extinguishers required will be determined at a later date. [527 CMR 5.08(8)] 9. Spray operations shall not be conducted without proper spray booth. 2 10. A permit for the storage of waste oil may be required. The storage must comply with the Board of Fire Prevention Regulations. [527 CMR 9.06] 11. Proper address numbering as required in Code of the City of Chicopee 12. Dumpsters shall be located at least 25’ away from building. Engineering: Attached 1995 plan does not show current condition. Building has expanded to the south. Any site work proposed? Parking spaces should be striped, including handicap space. Handicap space requires an access aisle (striped) and a sign. Does business exist on lots 2 and 3 on the attached plan? Planning: Property is split zoned; Industrial and Business A – Auto repair is permitted in both zones. Base plan is a previously approved ANR plan with hand noted details that are not professionally drawn. Plan was not reviewed and stamped by the Planning Department prior to submission. Recommend denial until the plan is professionally drawn and stamped by the Planning Department. The committee informed Mr. Ortiz that a professionally drawn plan approved by Planning is a requirement. Mr. Ortiz stated that he tried to meet with the Planning Director but was told that he was on vacation. The committee further stated that professional plans are now required of everyone even those businesses that have been operating for many years. The committee gave Mr. Ortiz copies of the department reviews. They provided him with contact information for the both the Planning and Engineering departments. Once his plan has been approved by the Planning Department the committee will hear the application. Motion made by Councilor Laflamme and second by Councilor Walczak to postpone to the call of the chair. Motion passed. ITEM #4 Minutes – January 30, 2017 Motion made by Councilor Laflamme and second by Councilor Walczak to approve. Motion passed. Motion made by Councilor Laflamme to adjourn at 7:00 PM. 3
