City of Chicopee City Council License Committee Members Stanley Walczak, Chair Fred Krampits, Vice Chair Shane Brooks APPROVED 12-17-18 Frank Laflamme Derek Dobosz MINUTES November 26, 2018 The following are the minutes of a public hearing held Monday, November 26, 2018 at 6:30 PM in the City Council Chambers, Fourth Floor, City Hall Annex, 274 Front Street, Chicopee, MA 01013. Members Present Walczak, Krampits, Brooks, Laflamme, Dobosz Also Present Attorney Daniel Garvey (Associate City Solicitor), Councilor Courchesne, Councilor Balkier The meeting was called to order at 6:33 PM In compliance with the Open Meeting Law the Chairman asked if anyone in the audience was recording the meeting. Hearing none the meeting continued. Motion made by Councilor Laflamme to take item #4 out of order. Motion passed. ITEM #4 ORDERED THAT Top Dog Auto Service, 238 Meadow Street, be called before the City of Chicopee License Committee and City Council to discuss the license (s) currently held by Top Dog Auto Service including compliance with restrictions imposed upon any licenses held by Top Dog Auto Service. The Council may modify, suspend, fine, or revoke any license held by Top Dog Auto Service. George Bruso was present at the meeting. He stated that in July he received a call from the City Clerk’s office to bring in his license. He told the Clerk’s office to keep it because he isn’t using it. Chairman Walczak asked if he has that in writing. Mr. Bruso replied that the phone doesn’t write. He stated that he’s retired and he doesn’t care. Councilor Courchesne stated that he doesn’t know how to proceed because there is someone running a business out of 238 Meadow Street. Mr. Bruso stated that he told the person that he needs to apply for a license. Attorney Garvey suggested that the committee make a motion to accept the tender of the license from the current license holder. He further stated that he knows that the Building Inspector has been to this property a number of times and has left notices on the door to contact the Building Commissioner. Attorney Garvey stated that the issue that we have is that the City doesn’t know what type of business is being operated so it can’t be 1 determined if a license is needed. Mr. Bruso stated that he’s not operating a business out of this address. He’s not opened to the public. He has another address. He’s parking in the fenced in yard. Motion made by Councilor Laflamme and second by Councilor Krampits to accept the tender of the license from the current license holder and be sent to the City Clerk. Committee vote 5 – 0 favorable. ITEM #1 Application for a Fuel Storage License at 7 Rivermills Drive for 4,200 gallons of aboveground storage of propane. Applicant Osterman Propane Stephen Symonds 339 Amherst Rd Sunderland, MA 01375 Stephen Symonds was present at the meeting. He stated that the request is for 4,200 gallons to temporarily heat the construction of the building. The following reports were read: Planning: Property is zoned Industrial and is included in the City’s Mill Conversion and Commercial Center Overlay District. License request is for temporary propane to facilitate construction of the Assisted Living Center. Recommend approval with any conditions requested by the Fire Department. Fire: Plan has been reviewed and inspection will be made upon installation. Engineering: No Engineering comments Motion made by Councilor Laflamme and second by Councilor Krampits to approve with restrictions and final approval and inspection by Fire Department. Committee vote 5 – 0 favorable. ITEM #2 Application to drive a taxi cab in the City of Chicopee for Yellow Cab. Applicant Melvin Colon 6 Woodcliff St Springfield, MA 01109 Melvin Colon was present at the meeting. He stated that he is currently licensed to drive in Springfield, Holyoke and Westfield. Motion made by Councilor Laflamme and second by Councilor Krampits to approve. Committee vote 5 – 0 favorable. 2 ITEM #3 ORDERED THAT Honeyland Farms, 206 Newbury Street, be called before the City of Chicopee License Committee and City Council to discuss the status of the requested site plan for the business. Mr. Ghulam Bari was present at the meeting. He presented the committee a site plan for the business. The handicap parking issue has been addressed. Massachusetts Fire Technologies, Inc., has been hired for the suppression system. The rear of the building is clean. Councilor Balakier stated that he is satisfied at this point. Councilor Laflamme stated that once the suppression system is complete Mr. Bari will need to apply for a Service Station License. Motion made by Councilor Laflamme and second by Councilor Krampits to accept and approve the site plan. Committee vote 5 – 0 favorable. ITEM #5 Application for a Class II License for Economy Auto Service located at 957 Meadow Street. Applicant Ariel Ortiz 32 Lawn Street South Hadley, MA 01075 Mr. Ortiz was not present at the meeting. The applicant has not been present at the last couple of meetings. Motion made by Councilor Krampits and second by Councilor Laflamme to deny the Class II license. Committee vote 5 – 0 favorable to deny ITEM #6 Minutes – October 29, 2018 Motion made by Councilor Laflamme and second by Councilor Krampits to approve. Motion passed. Meeting adjourned at 6:55 PM. 3
