City of Chicopee City Council License Committee APPROVED 3-29-2021 Members Stanley Walczak, Chair Fred Krampits, Vice Chair George Balakier Frank Laflamme Derek Dobosz MINUTES January 25, 2021 The following are the minutes of a public hearing held Monday, January 25, 2021 at 6:30 PM held in the Council Chambers, 4th floor, City Hall Annex, 274 Front Street, Chicopee, MA 01013 and via teleconference. Members Present Walczak, Krampits, Laflamme, Dobosz, Balakier Also Present Attorney Daniel Garvey The meeting was called to order at 6:30 PM In compliance with the Open Meeting Law the Chairman asked if anyone in the audience was recording the meeting. Hearing none the meeting continued. ITEM #1 2021 Murray Automotive, LLC Auto Repair License Renewal – Failure to submit required Business Certificate. Chairman Walczak stated that he was informed by the City Clerk that the required Business Certificate has been submitted to the City Clerk’s Office. Motion made by Councilor Laflamme and second by Councilor Walczak to extend the license until December 31, 2021 with restrictions. Committee vote 5 – 0 favorable. ITEM #2 Application for a Class II License for Nice Cars, LLC located at 451-455 Memorial Drive. Applicant Roseann Bergdoll 127 Cables Drive Brimfield, MA 01010 Roseann Bergdoll was present on teleconference. She stated that she posts her available vehicles online. Customers that want to see a vehicle make an appointment with her and she meets them onsite. She would like to sell between 6 and 15 vehicles from this property. Repairs to the vehicles will be handled by Monroe Muffler next door. 1 Councilor Laflamme stated that the lease provided does not contain a signature of the property owner. A signed lease will need to be provided prior to the City Council meeting. Committee vote 5 – 0 favorable. ITEM #3 Application for an Auto Detailing License for Nice Cars, LLC located at 451-455 Memorial Drive. Applicant Roseann Bergdoll 127 Cables Drive Brimfield, MA 01010 Roseann Bergdoll was present on teleconference. Committee vote 5 – 0 favorable. ITEM #4 Application for a Junk Dealers License to buy and sell new and used clothing at 131 Church Street. (Rubidia’s Sew & Consignment Shop). Applicant Rubidia Lopez 155 Oakland Street Springfield, MA 01108 2 Rubidia Lopez and Belinda Palafox were present at the meeting. Belinda translated for Rubidia. The applicant wishes to open a shop on Church Street where she will do alterations, and sell new and used clothing. Ms. Lopez provided the committee a copy of the lease agreement for the building. Ms. Lopez stated that she has a site plan for the property and she already has obtained the required Certificate of Occupancy. The committee requested that Ms. Lopez provide the committee copies of these two documents. RESTRICTIONS Hours of Operation Monday –Saturday 9 AM to 6 PM and Sunday 2 PM to 8 PM. Motion made by Councilor Laflamme and second by Councilor Walczak to approve with restrictions. Committee vote 5 – 0 favorable. ITEM #5 BE IT ORDERED THAT KLM Auto Repair, Inc., located at 606 Front Street, be called in before the License Committee to discuss the number of vehicles for sale on the property. Maria Kristy and Kevin Wright were on teleconference. Councilor Balakier stated that he has driven past this business many times and he feels that the business is not in compliance with the restrictions placed on the license. There are too many vehicles. Kevin Wright stated that this is a AAA shop. Many cars get towed into the shop and they have no control of that. They are currently experiencing staff shortage because of COVID and they are not able to repair as many vehicles as they would like because they don’t have full staff. The committee reviewed the plot plan that is on file for this business. Councilor Laflamme stated that the Council is now requiring all businesses to supply certified plot plans for their operations. He feels that once a new professional plot plan is drawn the number of vehicles will clearly be defined and there won’t be a discrepancy on how many and where vehicles will be allowed to park. The committee would like to receive the certified plot plan within 4 months. If the surveyor won’t have it ready in 4 months the license holder should notify the Council Office. Motion made by Councilor Laflamme and second by Councilor Walczak to place on file. Committee vote 5 – 0 favorable. ITEM #6 Minutes – November 30, 2020 Motion made by Councilor Laflamme and second by Councilor Walczak to approve. Motion passed. Meeting adjourned at 7:42 PM. 3
