Zygarowski Frank Laflamme Timothy McLellan MINUTES April 9, 2013 The following are the minutes of a public hearing held Tuesday, April 9, 2013 at 6:30 PM in the City Council Chambers, Fourth Floor, City Hall Annex, 274 Front Street, Chicopee, MA 01013. Members Present: Tillotson, Laflamme, Demers, Zygarowski Members Absent: McLellan Also Present: Daniel Garvey (Associate City Solicitor), Dino Brunetti (Ward 1), Thomas Charette (Police Chief) The meeting was called to order at 6:30 PM. ITEM #1 ORDERED THAT the City create an ordinance mandating vendors of ice cream trucks to be licensed by the City and a background check completed to ensure no criminal activity as according to MGL Chapter 256 Sections 119 & 122. An ordinance will be created to coincide with the state law requiring all ice cream truck vendors to be licensed by the City. Police Chief Charette stated that his department has already created an application and permit that will be utilized for this process. Dan Garvey stated that he will work on the language for this ordinance. Basically, the applicant will obtain an application for a Hawker’s and Peddlers License from the City Clerk’s Office. That application will be referred to the License Committee for review and recommendation to the City Council. The committee may place restrictions on the license. Once the Council has approved the Hawker’s and Peddlers License the applicant will then go to the Health Department and to the Police Department with a photo for the last step in the process. The Police Department will conduct the background check and issue the permit. Once issued the Police Department will notify the Clerk’s Office. The committee discussed fines for violations of this ordinance. The Police Chief suggested the following fines; 1st offense $100, 2nd offense $250, 3rd offense $500. An application fee of $50 will be assessed for these licenses. Proposed ordinance to follow. Committee vote 4 – 0 favorable. 1 ITEM #2 22 Percy Street Handicap Parking Frank Czepiel (Commission on Disabled) was also present. He stated that he would like additional time to review this request because the street is very congested and he would like to study it at different times during the day. Motion made to table.
