Zygarowski Frank Laflamme Timothy McLellan MINUTES May 14, 2013 The following are the minutes of a public hearing held Tuesday, May 14, 2013 at 6:30 PM in the City Council Chambers, Fourth Floor, City Hall Annex, 274 Front Street, Chicopee, MA 01013. Members Present: Tillotson, Laflamme, Demers, Zygarowski, McLellan Also Present: Daniel Garvey (Associate City Solicitor), Dino Brunetti (Ward 1) The meeting was called to order at 6:30 PM. ITEM #1 BE IT ORDAINED by the City Council that the Code of the City of Chicopee for the Year 1991, as amended be and hereby is further amended as follows: ADD Hawkers and Peddlers Licenses § 188-17(D) Upon the granting of a license, the Council may impose restrictions and conditions as to the operation of the business concerning hours of operation and/or other restrictions and conditions which the Council decides are necessary to protect the Citizens of the City of Chicopee. An applicant seeking a license to operate an ice cream truck within the City of Chicopee shall be required to comply with the requirements of M.G.L. 270 § 25, and 520 CMR 15.00 including, but not limited to, providing the City with permission to obtain a CORI information from the Board of Probation as detailed in M.G.L. c. 6, §172B½. Failure to comply with the requirements of M.G.L. 270 § 25, and 520 CMR 15.00 may result in a fine of $150.00 for a first offense; $250.00 for a second offense and $500.00 for a third or subsequent offense. Councilor McLellan stated that he was told by Stan Walczak that the ice cream trucks are staying for hours in the City parks selling ice cream and then the city is left to pick up the trash left behind. Councilor Tillotson suggested that restrictions could be placed on the licenses to limit the time spent in parks. Councilor Laflamme stated that perhaps a fee should be implemented if ice cream trucks want to sell to people in the park. 1 Councilor Brunetti questioned how the time limit could be enforced and who would enforce it. Committee vote 5 – 0 favorable. ITEM #2 BE IT ORDAINED by the City Council that the Code of the City of Chicopee for the Year 1991, as amended be and hereby is further amended as follows: Chapter 144-1 Definitions Add “Service Animals” before “Snake” Service animals are defined as dogs that are individually trained to do work or perform tasks for people with disabilities. Committee vote 5 – 0 favorable. ITEM #3 BE IT ORDAINED by the City Council that the Code of the City of Chicopee for the Year 1991, as amended be and hereby is further amended as follows: Chapter 144-20 Licensing of Dogs Delete from E “seeing-eye dogs” And insert in place thereof “service animals” To read: (E) License fees shall not be required for service animals or governmental police dogs. Committee vote 5 -0 favorable. ITEM #4 Handicap Parking 22 Percy Street The following memo was read from Frank Czepiel, Commission on Disabled: After performing an on-site survey of this location for the following reasons: 1. The opposite side of the street posted as “No Parking”, limiting available parking spaces. 2. This location is in close proximity to a school and a church which puts a strain on available parking. 3. The limited spaces at this location caused by there being two and three family dwellings on both sides of the street. 4. The address has multi-car driveway which the requestor should explore the use of. It is therefore recommended that the HP Parking Only sign request be DENIED. Motion made to deny. Committee vote 5-0 favorable to deny. 2 ITEM #5 Handicap Parking 57 Call Street No reports have been yet received. Motion made to table. Motion passed. ITEM #6 Minutes – April 9, 2013.
