Zygarowski Frank Laflamme Timothy McLellan MINUTES November 12, 2013 The following are the minutes of a public hearing held Tuesday, November 12, 2013 at 6:30 PM in the City Council Chambers, Fourth Floor, City Hall Annex, 274 Front Street, Chicopee, MA 01013. Members Present: Tillotson, Laflamme, Demers, Zygarowski, McLellan Also Present: Councilor Roy, Councilor Krampits, Daniel Garvey (Associate City Solicitor) The meeting was called to order at 6:30 PM. ITEM #1 BE IT ORDAINED by the City Council that the Code of the City of Chicopee for the Year 1991, as amended be and hereby is further amended as follows: Chapter 109 Alcoholic Beverages and Amusement Devices Chapter 109-5 Delete $90 And insert in place thereof $100 Donald Derosia, Chairman, License Commission and Laurie Taillefer, License Commission Clerk were present. It was stated by Mr. Derosia that this fee has not been increased since 2008. It is comparable to other communities. Councilor Roy stated that he is opposed to this increase because it just another way to tax businesses who already have to pay property tax, personal property tax, etc. He questioned what the business holder gets for this $100 fee. Laurie stated that they get a sticker to place on the machine and the License Commission has control over and keep a count of how many amusement devices an establishment has. 1 Motion made to move the question. Committee vote 5 – 0 favorable. ITEM #2 BE IT ORDAINED by the City Council that the Code of the City of Chicopee for the Year 1991, as amended be and hereby is further amended as follows: Add to Chapter 275-62 Industrial Districts (B) Special Permits – the following: (26) Medical Marijuana Facilities – see Chicopee City Code Chapter 275-70 Medical Marijuana Facilities. Motion made to approve. Committee vote 5 – 0 favorable. ITEM #3 Parking Regulations Silvin Road From Silvin Road to Dale Street on the southeast side from driveway to Dale Street Parking Prohibited Committee vote 5 – 0 favorable. ITEM #4 Handicap Parking 23 St. Jacques Avenue Handicap Parking Letter from Commission on Disabled was read: Gentlemen; Having surveyed the site it is not recommended a HP sign be placed at that location. The reason for this discussion: 1. No application for required information 2. Property abuts 100+ feet of unrestricted curb space 3. The distance the curb to the building entrance is less than 20 feet. 4. The only vehicles parked on the entire length of the street where at the other end. 5. During site survey residents from the building occupant parked the vehicle at least 3 car lengths from the building entrance. (Apparently to park vehicle in the shade). Councilor Roy stated that he is not in favor of this ordinance if the Commission for the Disabled is opposed to it. 2 Committee vote 5 – 0 unfavorable. ITEM #5 Parking Regulations Cabot Street East side – 30 feet from Exchange Street in a southerly direction Time Limit Parking – 30 Minute Parking Committee vote 5 – 0 favorable. ITEM #6 Isolated Stop Sign Dunn Street Southeast corner at intersection of Dunn Street and Fletcher Circle Isolated Stop Sign Committee vote 5 – 0 favorable. ITEM #7 Isolated Stop Sign Dunn Street Northwest corner at intersection of Dunn Street and Fletcher Circle Isolated Stop Sign Committee vote 5 – 0 favorable. ITEM #8 Parking Regulations Huntington Street West side – At the end of driveway in front of 2 Huntington Street Parking Prohibited ITEM #9 Parking Regulations Striking From Front Parking Lot All spaces, except 8 closest to the annex in the northeasterly area Time Limit Parking – 1 hour; 8 AM – 5 PM /Monday-Friday, holidays excluded Committee vote 5 – 0 favorable. ITEM #10 Parking Regulations 3 Front Street City Hall Parking Lot 6 spaces located at the easterly end of the parking lot Time Limit Parking – 1 hour; 8 AM – 5 PM Monday – Friday Committee vote 5 – 0 favorable. ITEM #11 Parking Regulations Front Street From the Front Street City Hall Parking lot easterly to the crosswalk in front of #279 Parking Prohibited Committee vote 5 – 0 favorable. ITEM #12 Parking Regulations Moore Street In front of 23 Moore Street for a distance of 50 feet from the property line to property line Parking Prohibited Committee vote 5 – 0 favorable. ITEM #13 Minutes – August 28, 2013. Motion made to approve. Motion passed. Meeting adjourned at 7:00 PM. 4
