Members Present: Tillotson (zoom), Krampits, Labrie, Roy Member Absent: Dobosz Also Present: Councilor Laflamme, Councilor Zygarowski, Councilor Pniak-Costello, Mike Pise (Chief of Staff), Benjamin Strepka (Interim Superintendent), Lee Pouliot (Director of Planning) The meeting was called to order at 6:30 PM by the Vice Chair. In compliance with the open meeting laws the Vice Chair asked if anyone in the audience was recording the meeting. Hearing none the meeting continued. Some of the audio is inaudible. Public Input Deborah Sutherland 129 Ludlow Road, Chicopee stated that stated she is a lifelong resident of Chicopee. Given the opportunity to take advantage of public input, to share our struggle on New Ludlow Road with as many elected officials and residents as possible. Marion Excavating has received two cease and desist orders by the Chicopee Law Department, one in June of 2021 and one end of October 2022. The only appreciable change in behavior of the business is now they feel free to work on Sundays. Marion Excavating is not a good steward of the planet. Indeed, the business model depends on scraping and selling of our earth. Marion Excavating is guilty of sound pollution polluting our air. It is my opinion; they have exercised careless behavior with our local environment and the people who share the air with them. In my gut, I'm dubious that Marion excavating follows the guidelines, cares about the impact that their very loud, very air polluting business rains down on the homes in close proximity to their sand and gravel pit. After a cease and desist, they now ask for a continuation and expansion of the sand and gravel pit blind to their quest, complaints, needs and quality of life for the neighbors. They scrape, sell and pollute everyday neighborhoods. They scrape, sell and pollute every day, including Sundays if they feel like it. Sand and gravel pits are very often located on the outskirts of town, not nestled in the crosscurrents of a neighborhood. Marion excavating to choose to use best practices in the industry, not working on Sundays, wetting down the mountainous piles of straight sand, dirt, concrete, best practices, a good faith effort that there are things more important than the bottom line when doing business in Chicopee. I want to believe 1 that the City of Chicopee values the environment and us, the residents. One of the most important aspects of government service is to keep their residents safe from all forms of public health concerns. I visited their website, a quarry in West Hampton, extensive list of services. Marion Excavating is a big company. Maybe they make millions. A Goliath. Well, all us Davids out here, we demand a good quality of life. No less noise, No or less air pollution. No big, heavy trucks using our narrow no exit road. While Goliath make, there may be millions of David's. All we want to do is hold tight to our assets, our homes. Tammy Roy 171 Ludlow Road stated that she lives across the street, directly across from Marion's excavating property and without repeating a lot of what was echoed, I do believe that there is the air pollution of dust particles pollutants. The diesel fumes from the construction vehicles have also affected the quality of life, as we no longer can open our front doors and windows many mornings to allow the cool fresh air to flow through, the fumes are just too much. Also, the continuous beeping engine running and banging of a dump truck back tailgate feels like a construction zone project that never ends. As far as that wildlife setting, I feel the need to express how the animals are also being squeezed out as they are quickly losing their safe habitats. My husband and I built our home 33 years ago and he grew up and was born two houses just down the road from us. I felt that that area was always the city's best kept secret, just a mile from the stores, yet living in our nature's twin tranquility. We felt very lucky to have that peaceful and shared nature walks with our daughters. Now much of that is gone with all the decimation of the trees and vegetation. My attention turns to the present issue of what's next. What are their expansion plans? Will it devastate more wildlife vegetation in their neighborhood? Does the expansion include a pass through to our very narrow road, which has more than enough traffic already with two longtime businesses at our dead end? Street speed and traffic volume is an issue already. Overweight vehicles and vibration will affect our road conditions, foundations and skeptics. Westover is loud, booming explosions already during maneuvers is enough in and of itself. Finally, as a neighborhood, I feel we have been quiet long enough, only to see our natural surroundings decimated. I don't think respectfully requesting to keep what is left of the area's habitat and quality of life is asking too much. Thank you for your time. I believe the other salaries or more significant increase based on raising the Council to the City Council's salary to get pay parity amongst the other associates. So that's really the reason for it. As you know, I've had to shift people around to do other duties and they, in my opinion, running a Law Department they should all be paid the same amount. I'm trying to rework the way the Law Department operates so that everyone carries a caseload that's fair and brings value to the department. That same raise is being given to the non-union employees under Chapter seven. Also there may be some step increases involved in this as well, but it's a standard 2% raise. The Occupational Safety Director position was deleted in the budget that you had passed, and it was inserted there Occupational Safety Manager. The assessment came in as a grade eight. It's being reported now to Human Resources as they handle safety matters and worker's compensation insurance. So it's made more sense to have that under H.R. and reporting to the H.R. Director. Also, the H.R. Business Partner was added by the City Council in their budget. That came in rated as a grade also. That's going to help us with our training and education of employees, hopefully professionalize their employee staff. So essentially, in conjunction with item ten on your agenda, we've moved that stipend into the Development Manager's salary to create the 40-hour position. Since that position is doing the work under the environmental stipend anyways, so with the update to the 40-hour work week for the development manager, this stipend is no longer needed. No person may park a motor vehicle in any municipal park when the park is closed except those vehicles specifically authorized to do so by the Superintendent of Parks who shall issue parking permits with the allowed dates and times stated on the parking permits which shall be displayed on the windshield of every vehicle so authorized. B. Posting. The Superintendent shall post this ordinance at the entrance and exit of all municipal parks. C. Violations and penalties. Any vehicle parked in violation of this ordinance, in addition to the monetary fine defined below, shall be towed and any expense incurred by the City shall be paid by the owner of said vehicle. The following fines shall be imposed: (1) First Office: Written Warning (2) Second Offense: Fine of $20.00 (3) Third Offense: Fine of $50.00 (4) Forth or subsequent offense: Fine of $100.00 Each day a vehicle is parked in violation of this ordinance shall be deemed a separate offense. D. Enforcement. The City of Chicopee Police Department or their designee shall enforce this Chapter. Amended version. CHAPTER 260, SECTION 30.3 - MUNICIPAL PARKS PARKING REGULATION AS FOLLOWS: D. The Park Commission voted to adopt this as one of their rules in their February meeting. However, to make it enforceable, we need to adopt it as an ordinance so that the Police can help enforce this. Part of the ordinance states that myself, as the superintendent can designate certain vehicles that can park overnight. If we were to have a trip and we have cars parked at Szot Park overnight, we'll give them parking passes or any vehicle that we deem necessary to be there overnight. Councilor Laflamme stated that this has to particularly do with a certain couple of parks that it is heavily being used by apartment renters, as well as people parking vehicles in there. So to be consistent with all of them for the Police Department, that's why they put in all the parks so that they don't have to guess which one is part of it in this chapter. I actually spoke with Ben, and we worked it out to make sure we put the ordinance, the violation and the tow right on the sign, not just “No Overnight Parking”. So I wanted to make sure that we put the chapter, the ordinances on that sign and the tow at owner's expense. We do have some vehicles right now that are constantly parking. They've been asked not to park there, and they constantly do it. So I'm glad to see this come forward because especially in the wintertime when they're trying to clean up the parks for different events or 4th of July when they want to clean up the parking lot, they couldn't because there are so many vehicles in there already. So I'm glad to see just come forward so the Police Department can just start the process. Councilor Labrie motion to close public input – Councilor Krampits 2nd the motion.
