City of Chicopee City Council Ordinance Committee Members James Tillotson, Chair Fred Krampits, Vice Chair Derek Dobosz APPROVED 10-10-2023 Gary Labrie Jerry Roy MINUTES September 12, 2023 The following are the minutes of a public hearing held Tuesday, September 12, 2023 at 6:30 PM in the City Council Chambers, 4th Floor, City Hall, 274 Front Street, Chicopee, MA 01013. Members Present: Tillotson (zoom), Labrie, Dobosz Member Absent: Krampits, Roy Also Present: Councilor Laflamme, Councilor Pniak-Costello, Tim Reilly (Associate City Solicitor), Doug Ellis (City Engineer), Councilor Zygarowski, Councilor Courchesne The meeting was called to order at 6:30 PM by Councilor Labrie. In compliance with the open meeting laws the Vice Chair asked if anyone in the audience was recording the meeting. Hearing none, the meeting continued. Motion made by Councilor Dobosz and seconded by Councilor Labrie to take Item #16 out of order. Item #2 BE IT ORDERED THAT the DPW install a no truck sign for Ludlow Road and be referred to the Ordinance Committee for a public hearing. Councilor Yes No Absent Abstaine Out of d Chair Tillotson x (zoom) Krampits x Dobosz x Labrie x Roy x Motion passed. 3 Doug Ellis offered the following comments: Any request for a truck exclusion, or Heavy Commercial Vehicle Exclusion (HCVE), must be sent to the MassDOT for review and approval after a traffic study has been performed. “No Through Trucks” signs cannot be installed without an approved HCVE, and would not be enforceable. Councilor Pniak-Costello stated that a gentleman on Ludlow Road is requesting either the truck exclusion or a no thru truck sign because the street is a dead end. There is a business at the end of the street and this business has truck deliveries and the street is narrow. Councilor Laflamme stated he is not sure what power the City has without DOT. The City has an ordinance that states that a person cannot park trucks for a period of time in a residential neighborhood. Councilor Laflamme stated that he would like to postpone this order until we receive a ruling from Engineering and look into the requirements of that tractor trailer being parked at the end of the street. Councilor Pniak-Costello stated that there is a concern about trucks driving in the area except for deliveries. Doug Ellis stated that this is a unique situation and he would like to speak with MassDOT to determine what measures they take when it’s one truck. To him it seems like an enforcement issue. Councilor Dobosz motion to postpone to the call of the chair – Councilor Labrie 2nd the motion. Item #3 BE IT ORDERED THAT DPW replace the current 30 mph speed limit signs with 25 mph as per city ordinance on Irene Street.
