CHICOPEE CITY COUNCIL PUBLIC WORKS COMMITTEE APPROVED MEMBERS Fred Krampits Jean Croteau, Jr. Gerry Roy Dino Brunetti Frank Laflamme MINUTES July 3, 2012 The following are the minutes of a public hearing held Thursday, July 3, 2012 at 6:00 PM at City Hall, Council Chambers, 4th floor, City Hall Annex. Members Present Krampits, Roy, Laflamme Absent Croteau, Brunetti Also Present Councilor Tillotson (arrived 6:10 PM), Councilor McLellan, Steve Frederick (City Engineer), Daniel Garvey (Associate City Solicitor), Tom Hamel (Water Pollution Control Chief Operator) The meeting was called to order at 6:00 PM. ITEM #1 BE IT ORDERED THAT THE CITY OF CHICOPEE ACTING PURSUANT TO MASSACHUSETTS GENERAL LAWS AND OF ANY AND EVERY OTHER POWER AND AUTHORITY IT THEREUNTO ENABLING HEREBY ACCEPTS THE PARCEL IN SAID CITY DESCRIBED IN A DEED DATED JANUARY 29, 1993 AND RECORDED WITH THE HAMPDEN COUNTY REGISTRY OF DEEDS IN BOOK 8324, PAGE 177. THE PARCEL IS MORE PARTICULARLY BOUNDED AND DESCRIBED AS LOT #113A ON A PLAN ENTITLED “PLAN OF LAND IN CHICOPEE, MASSACHUSETTS, HAMPDEN COUNTY, OWNED BY A&B CUSTOM BUILDERS” DATED DECEMBER 14, 1992, DRAWN BY DOMINIC J. DINOIA AND RECORDED IN THE HAMPDEN COUNTY REGISTRY OF DEEDS IN BOOK OF PLANS 283, PAGE 105. THIS PARCEL IS ACCEPTED TO ALLOW THE CITY OF CHICOPEE TO MAINTAIN THE RETENTION SYSTEM CONTAINED WITHIN THIS PARCEL OF PROPERTY. LOCATION: LOT #113 NUTMEG CIRCLE, CHICOPEE, MASSACHUSETTS Councilor Krampits stated this came to us from the Mayors office through the City Solicitor. Tom Hamel stated I’ve been getting calls for thirty five years in regards to this situation. When it was built I don’t think there was any engineer or design outfit and it didn’t meet any particular codes; building, electrical and plumbing codes, it’s just a disaster the way it was built. We’ve referred all the calls to the owner five years ago or so. There is absolutely no activity at the site. The water goes into resident’s yards so we actually bought a new pump and put it in there. 1 Tom Hamel presented pictures of the property. Councilor Laflamme asked the City of Chicopee put a pump on someone’s property? Tom Hamel answered yes we did. Tom Hamel stated we can’t just take this property. We’ve hired an Engineering company to do a hydrologic study. Once we have a plan in hand we’re going out to bid just like we do any sewer project. We will do whatever we need to do to make it work correctly. Councilor Laflamme asked how many homes does this affect. Tom Hamel answered six or seven homes drain to this area. Steve Fredericks stated we may need construction easements along with this taking and permanent easements. Hire an engineering company to do a hydrology study – Awaiting results – Probably around December 2012. Motion to table – motion passed ITEM #2 Minutes – January 31, 2012. Motion made to accept. Motion passed. Meeting adjourned at 6:26 PM. 2
