CHICOPEE CITY COUNCIL ZONING COMMITTEE APPROVED 7-28-15 ZONING COMMITTEE MEMBERS John Vieau, Chairman Shane Brooks, Vice Chairman Timothy McLellan James Tillotson Frank Laflamme Gerry Roy Fred Krampits MINUTES June 30, 2015 The following are the minutes of a public hearing held Tuesday, June 30, 2015 at 6:30 PM in the City Council Chambers, Fourth Floor, City Hall Annex, 274 Front Street, Chicopee, MA 01013. Members Present Vieau, Brooks, Tillotson, Laflamme, Krampits, McLellan Members Absent Roy Also Present Daniel Garvey (Associate City Solicitor), Councilor Lamontagne, Lee Pouliot (Planning Director), Councilor Zygarowski, Councilor Roy (At-Large), Councilor Zaskey, Councilor Krampits, Councilor Moreau, Mayor Kos, Councilor Labrie, Carolyn Porter (Superintendent Parks Dept.), Sharon Riley (Auditor), Barbara Pininski (Budget Analyst) Meeting called to order at 6:33 PM In compliance with the Open Meeting Law the Chairman asked if anyone in the audience was recording the meeting. Dennis from the Chicopee Register stated he was recording the meeting. ITEM #1 BE IT ORDAINED by the City Council that the Code of the City of Chicopee for the year 1991, as amended, be and is hereby further amended as follows: Chapter 275-58 Business A Districts Add to 275-58 D (3) or residential uses 1 Councilor Krampits stated that this will make it consistent through the other portions of the chapter for setbacks. It’s just adding a word to make it both residential zone and residential use so setbacks apply to somebody that lives on a business A property but, owns a house and wants to have the same setbacks if another zone is going to turn into an actual business. Motion to approve - motion passed Committee vote 6 – 0 favorable. ITEM #2 BE IT ORDAINED by the City Council that the Code of the City of Chicopee for the Year 1991, as amended be and is hereby further amended as follows: Chapter 275-66 A (1) Burnett Road Delete April 6, 2014 Insert in place thereof April 6, 2015 Delete April 6, 2015 Insert in place thereof April 6, 2016 To read: (1) No further business, commercial or industrial development shall occur on Burnett Road and any appurtenant street for a period of one year commencing on April 6, 2016, except by special permit. Councilor McLellan stated this is to make sure we maintain control especially with the casino coming in; we have a lot of residents here that are zoned business. Motion to approve – motion passed Committee vote 5 – 0 favorable ITEM #3 BE IT ORDAINED by the City Council that the Code of the City of Chicopee for the Year 1991, as amended, be and is hereby further amended as follows: Delete Chapter 275-30 Storage of trucks and other equipment in its entirety And insert in place thereof 275-30 Storage of trucks and other equipment 2 A. No truck, truck body, truck-towed trailer, tractor-towed trailer or other equipment manufactured for use for hauling or carrying materials over the highways shall be used for storage of any materials of any kind, whether or not said truck, truck body, truck- towed trailer, tractor-towed trailer or said other equipment is registered in accordance with MGL c. 90 or in accordance with the laws of any other state; nor shall the aforesaid be parked or stored in any place in any district for any time in excess of two weeks, unless said place is used as a truck terminal or a parking area for equipment rented to members of the general public for use on the highways. Excluded are those vehicles or tandem trailers or wheel boxes that are utilized for the construction of buildings and are placed in a construction site temporarily and trailers which are utilized for temporary offices or sanitation stations. B. The City Council may, however, authorize by special permit the use of the above- mentioned equipment for storage by nonprofit organizations, charitable institutions or for other such activities as the City Council deems appropriate. Said special permit shall govern the particular use of said container(s) and shall detail such other provisions and restrictions as the City Council deems necessary and appropriate. Councilor Roy stated that the ultimate destination for this is to try to get a permit for the Chicopee Falls Moose Club so they can put a storage unit alongside their building. Councilor Tillotson stated that anyone who has a trailer will have to come in and get a special permit. Councilor Roy stated we are planning on putting a stockade fence around it. Lee Pouliot stated the Planning Board did recommend approval on this but they did ask the Council to give more specifics on the language, other, equipment and activities. Motion to approve with recommendations – motion 2nd – motion passed.  Recommendation to Grandfather existing trailers used for storage. Committee vote 6 – 0 favorable ITEM #4 Communication from the Zoning Board of Appeals requesting an increase in the Variance Application fee from $200 to $300. Lee Pouliot stated the filing fee hasn’t been review or updated in over three years. The average cost to run a legal add is about $295.00. Our fees are exceptionally low compared to other cities. Motion to approve – motion 2nd – motion passed. Committee vote 6 – 0 favorable 3 ITEM #5 Motion to approve the April 28, 2015 Minutes – motion passed Meeting adjourned at 6:55 PM. 4
