December 9, 2015
The following are the minutes of a public hearing held Tuesday, November 24, 2015 at 6:30 PM
in the City Council Chambers, Fourth Floor, City Hall Annex, 274 Front Street, Chicopee, MA
01013.
Members Present Vieau, Brooks, Laflamme, Tillotson, Roy, Krampits
Members Absent McLellan
Also Present Daniel Garvey (Associate City Solicitor), Michelle Santerre
Meeting called to order at 6:30 PM
In compliance with the Open Meeting Law the Chairman asked if anyone in the audience was
recording the meeting.
ITEM #1
Delete Chapter 275-16
And insert in place thereof
§275-16. Copy of Zoning Map on File.
The City Zoning Map shall be kept on file in the Planning Department, where it may be viewed
during normal business hours, or is also available for viewing on the City’s website. The
location and boundaries of the Zoning Districts are established as shown on the Zoning Map
together with all duly adopted amendments as maintained by the City Clerk’s Office which shall
hereby be declared as part of this ordinance.

All Zoning Districts shall be compiled by the City Planning Department and a permanent record
of all said districts shall be maintained and represented within the City of Chicopee Geographic
Information Systems (GIS) Spatial Database. All revisions, changes, and updates to said Zoning
Districts shall be the sole responsibility of the Planning Department. Where any such
uncertainty exists as to the boundary of any Zoning District, the Building Commissioner, upon
written application, shall determine the boundary location, giving due consideration to the
apparent indicated location, official records from the City Clerk, and the expressed purposes of
the Zoning Ordinance.
Michelle Santerre explained that the Planning Board voted to recommend approval at its
meeting. They did suggest one change and that was in the first paragraph change the
word “or” to “and”. The Committee felt that this was a good recommendation.
Motion made by Councilor Krampits and second by Councilor Vieau to approve with
change.
Committee vote 6 – 0 favorable.
ITEM #2
Ordinance Amendment Chapter 275-59 Business B Districts. Delete 275-59 (B) (22)
Warehousing and storage
Councilor Brooks explained that he would like to make this change in the ordinance to
give more control to the City on where these warehouses and storage facilities are
allowed in the city. He spoke of one example where someone was proposing a storage
facility in a residential area.
Motion made by Councilor Krampits and second by Councilor Vieau to approve.
Committee vote 6 – 0 favorable.
ITEM #3
Ordinance Amendment Chapter 275-59 Business B Districts. Add to 275-59 (C) Special Permits
– (10) Warehousing and storage.
Councilor Brooks stated that this proposed ordinance would require a special permit for
warehousing and storage in a Business B district.
Dan Garvey stated that the ordinance should read:

Motion made by Councilor Krampits and second by Councilor Vieau to approve with
change.
Committee vote 6 – 0 favorable.

ITEM #4
ORDERED THAT Chapters 275-58, 275-59, 275-60 of the city ordinances be referred to the
Ordinance and Zoning Committees for discussion.
Councilor Brooks stated that he wishes to review these sections of the code book and examine
right by use issues. He would like the city to look at more localized control through
the special permit process.
Michelle Santerre stated that the Planning Department will be reviewing these sections and will
forward its recommendations to the Planning Board.
Motion made by Councilor Krampits and second by Councilor Vieau to approve and send to the
Planning Department/Board for recommendations. Further review by City Council after
January 1, 2016.
Committee vote 6 - 0 favorable.
ITEM #5
Application for a Zone Change from Res A to Industrial for 3,774 SF of property located
at 5 Mill St. for the purpose Class III license. Applicant-Leonid Ingatyuk, 132 Maryland
Ave., Chicopee, MA 01020.
Mr. Ignatyuk was present at the meeting.
Councilor Roy stated that this zone change is required to create frontage for this parcel of land.
Mr. Ignatyuk comes in through the right of way not to disturb his neighbors on Gagne Street.
Motion made by Councilor Laflamme and second by Councilor Vieau to approve.
Committee vote 6 – 0 favorable.
