Members Present Brooks, Krampits, Laflamme, Roy, Tillotson, Zaskey Not Present McLellan Also Present Councilor Courchesne, Christine Pikula (Assoc. City Solicitor) The meeting was called to order at 6:30 PM In compliance with the Open Meeting Law the Vice Chairman asked if anyone in the audience was recording the meeting. Hearing none the meeting continued. ITEM #1 Special Permit application under 275-23 for the purpose of reconstruction of a single family home that was damaged by fire ability to rebuild a single family home on this lot located at 34 Myrtle St. Applicant Christopher LaBonte 82 Rochford Cr Springfield, MA 01128 Applicant was not present. Councilor Krampits motion to postpone until the end of the meeting – Councilor Brooks 2nd the motion – motion passed. Councilor Brooks stated to send the applicant a correspondence stating that he cannot proceed with rebuilding the home until he gets a Special Permit and that he needs to appear at the next Zoning Committee meeting which is scheduled in December. He did get approval from the Zoning Board of Appeals last night and I think there is some confusion. 1 Councilor Tillotson motion to postpone to the call of the chair – Councilor Brooks 2nd the motion – motion passed. ITEM #2 Special Permit application under 275-50 for the purpose of to change the applicant listed on the special permit, originally granted on May 5, 2015, for the 2 product LED gas price sign located at 2012 Memorial Dr. Applicant CH Realty VII/CG MACT Bird, LLC 3819 Maple Ave Dallas TX 75219. Janis Lee, 15 Cashmere Street, Westfield, MA, District Manager for NEC OPCO I, Inc. was present. Fire Department No Concerns Engineering Department Attached plan does not meet scale requirements Due to signs’ proximity of traffic signal, sign shall feature static display (no flashing, scrolling, etc.) Planning Department Planning and Conservation reviewed and recommended approval for the previous Special Permit. As this is just an ownership change – we recommend approval. Motion to approve with existing restrictions – motion passed Restrictions Permit to run with land With existing restrictions Committee vote 6 – 0 favorable ITEM #3 Ordinance Amendment Chapter 275-30 (A) Storage of Trucks and Other Equipment; delete “two weeks” and insert thereof “twenty-four hours”. Full text available in the Office of the City Council, City Hall Annex, 274 Front St. Applicant-Councilor William Courchesne, Ward 7. 2 Councilor Courchesne stated that after talking with Attorney Garvey I was told the chapters were different and they have nothing to do with each other. My recommendation is to defeat this. If there is confusion with the language we could bring this up again. Councilor Tillotson stated that they were confusing this with Chapter 262 regarding trucks. Councilor Tillotson motion to defeat – Councilor Brooks 2nd the motion – motion passed Committee vote 6 – 0 favorable ITEM #4 Minutes – October 20, 2-016 -Councilor Laflamme motion to approve - Councilor Brooks 2nd the motion – motion passed Meeting adjourned at 6:45 PM 3
