Minutes of Meeting
June 7, 2017
Pursuant to Mass. General Law Ch. 131, Section 40 and the Chicopee Wetland Ordinance Ch. 272, the
Chicopee Conservation Commission held a public hearing on Wednesday, June 7, 2017 at 6:15 PM, City
Council Chambers, 4th Floor, City Hall.
James Reidy opened the meeting at 6:15 PM and announced that the meeting was being recorded.

Item 1: Enforcement Order – Clearview Heights – 200 Lambert Terrace – Original request was for a Certificate of
Compliance. Staff and Conservation Commission determined that compliance was not met. Since Order of
Conditions is expired the Commission has to issue the Enforcement Order for work to commence to make site
compliant. Since EO was issued, the Applicant’s opinion is that vegetation has established to a point of providing
adequate slope stabilization and requested the Commission reconsider the Certificate of Compliance.
Notes: Commission Members discussed the possibility of issuing a Certificate of Compliance and it was their
decision to continue the hearing on this issue to June 21, 2017 pending another visit to the site.
Motion to continue was made by Charles Payne and seconded by Celeste. Vote was 4-0 to continue to June 21,
2017.

Item 2: (Continued from February 1, February 15, March 15, April 5 and May 3, 2017) (Please refer to
information provided to you prior to the February 1, 2017 hearing)NOI for the placement of stone caps over
existing tar patches associated with an historic gas plant in Holyoke. Location: Connecticut River – Stanley
Berchulski Fisherman’s Access (Syrek St.) Applicant: Paul Boison, HWP Company, an Eversource Energy
Company, P.O. Box 270 Hartford, CT 06141
Notes: After several months of continuance to obtain necessary permitting form the State, the Applicant refreshed
the Commission on the project that was initially before them on February 1, 2017. The Commissioners discussed
the NOI and were satisfied with the proposed work and decided to impose additional special conditions under the
municipal ordinance.
Motion to approve the NOI with special conditions under the City Ordinance was made by Celeste Donovan and
seconded by Charles Payne. Vote was 4-0 to approve with special conditions.

Motion to approve was made by Charles Payne and seconded by Celeste Donovan. Vote was 4-0 to approve the
May 17, 2017 minutes.

Item 4: SIGN BILLS
Notes: Staff noted there were no bills to sign.
Item 5: Upcoming Project updates/Discussion
Enforcement Order – Colonial Circle – Since the Enforcement Order was issued, the Property Manager
met with Conservation Staff on May 30, 2017 and was made aware of the process that is required to
achieve compliance with the Conservation Commission. The Applicant has hired R. Levesque Associates
to do the necessary delineation and submittals. The Commission ratified a new EO with the correct
property manager information.
Enforcement Order – Possible EO for 104 Fuller Road. Staff received a call on May 30, 2017 that the
individual to whom the Commission sent a letter last fall has resumed dumping and pushing the debris back
into the ravine. Staff will do a drive by to determine if the allegation is true.

Pursuant to Mass. General Law Ch. 131, Section 40 and the Chicopee Wetland Ordinance Ch. 272, the
Chicopee Conservation Commission will hold a public hearing on Wednesday, June 7, 2017 at 6:15 PM, City
Council Chambers, 4th Floor, City Hall Annex to discuss the following:
Chairman please announce meeting is being recorded and inform public if they are recording the meeting
they must disclose they are recording and provide their name and address for the record.
Item 1: (Continued from April 5 and May 3, 2017) (Please refer to information provided to you for the April
5, 2017 hearing) Certificate of Compliance for 200 Lambert Terrace NOI file # 13-003 Order of Conditions issued
September 18, 2013.
At the May 3, 2017 meeting the Commission decided that the slope for which the Certificate of
Compliance was requested was not stabilized to their satisfaction and since the OOC is expired the Jessica
Dzwonkoski Commission will be issuing an Enforcement Order (EO). The Commission to ratify the EO.
Applicant has received the Enforcement Order and is requesting the Commission take another look at the
slope as it is his opinion that the vegetation has established enough to stabilize the slope.
