City of Chicopee, Massachusetts License Commission City Hall – 274 Front Street – Chicopee, MA 01013 Tel: (413) 594-1530 Fax: (413) 594-1531 Minutes for November 20, 2014 In attendance: Chairman Pagel, Commissioners Goulette, Martin, Tarnowski and Atty. Rooke Minutes for October are presented to the Board. Commissioner Goulette makes a motion to approve. Commissioner Martin seconds. Motion approved 4-0. Hearing for Princesa Deli for violations of Count 1- City of Chicopee Code Chapter 109 Alcoholic Beverages and Amusement Devices Article II: Automatic Amusement Devices § and Count 2- M.G.L. C 140 LICENSES In attendance: Det. Michael Dion and Santo Alcantara and Nadia Alcantara. Det. Dion reads his report to the Commissioners. Mr. Alcantara states he doesn’t speak English very well so his niece will help him translate. Atty. Rooke asks if he admits to the violations. Mr. Alcantara admits to the violations.Commissiners ask if he has Lottery products and he does not. Commissioner Goulette makes a motion that Count 1 is founded and a $50.00 per machine fine imposed for each machine (2) and to suspend the Common Victualer license for 1 day per offense for a total of 2 days. The fine must be paid by December 1, 2014. Commissioner Martin seconds. Motion approved 4-0. The suspension will be served on December 1 and December 2, 2014. Hearing for Fairview American Legion for Violations of Failure to submit an application for a Change of Manager and Officers/Directors. In attendance: John Wellman. Mr. Wellman explains to the Board that the former manager left and the president also left. This has thrown everything into turmoil. He is working on trying to straighten things out. He submits the paperwork. He is waiting on the Certificate of Good Standing from the DOR. There were some unpaid taxes that he was unaware of and has since paid those and submits copies of the checks. Commissioner Tarnowski informs Mr. Wellman that he has received complaints of tampering with the bottles. Mr. Wellman states that they have been visited by ABCC and city officials and there have not been any violations found. Commissioner Tarnowski also states he has been in the establishment and asked for the Server Training Roster and the bartender on duty could not find them. Rita did find it eventually. Also he has noted that customers order soda and walk to their cars and then come back in again. Det. Dion states he has not done an inspection there. Also he states that according to the law you may not ever add anything to a bottle of alcohol. Customers should not be leaving the premise with any type of drink. Chairman Pagel cautions that the parking lot is also their responsibility. Mr. Wellman states he understands this. If there is a legitimate complaint then it will be acted on. Commissioner Martin states that this Commission is here to help. He would like to know the steps they will take to stop this from happening. Mr. Wellman states that if necessary they will hire police details. They have had inspections from the Health department and the Lottery Commission and no issues were found. Commissioner Goulette makes a motion to table this matter until December 18, 2014 in order to receive all the paperwork. Commissioner Martin seconds. Motion approved 4-0. Application for a Change of Manager, Transfer/Issuance of Stock and Change of Directors/Officers for the Castle of Knights, 1599 Memorial Dr. In attendance: Paul Phaneuf and Ron Belair. Mr. Belair informs the Board that the past year has brought many changes to their Board and every time he thinks he has the paperwork completed there is another change. He apologizes for the lengthy delay. Mr. Phaneuf is the manager of record for the Fairview Knights of Columbus also. Commissioner Goulette makes a motion to approve. Commissioner Tarnowski seconds. Motion approved 4-0 Application for a Change of Manager for Applebee’s, 597 Memorial Dr. In attendance: Michael Haluch. Mr. Haluch informs the Board that he has previously held a liquor license and for the past 3 years has been a manager at Applebee’s. He will recertify in TIPs training on December 10, 2014. Commissioner Goulette makes a motion to approve. Commissioner Tarnowski seconds. Motion approved 4-0. Application for a Change of Officers/Directors for Tiger’s, 14 Montgomery St. Commissioner Martin makes a motion to approve. Commissioner Goulette seconds. Motion approved 4-0. Application for a Change of Officers/Directors for Moose Lodge #1849, 244 Fuller Rd. Commissioner Goulette makes a motion to approve. Commissioner Martin seconds. Motion approved 4-0. Application for a Special One Day Permit(Wine/Beer) for The Good Dog Spot, 35 C North Chicopee St for the Holiday Yappy Hour to be held on Saturday December 6, 2014 from 4:00 PM until 9:00 PM with Cory Staples as applicant. Commissioner Goulette makes a motion to approve. Commissioner Martin seconds. Motion approved 4-0 Application for a Special One-Day Permit (Wine/Beer) for Aramark @ Elms , 291 Springfield St for a Religious Studies Advent Dinner to be held on December 11,2014 from 5:00 PM until 10:00 PM with Mark Marson as applicant. Commissioner Goulette makes a motion to approve. Commissioner Tarnowski seconds. Motion approved 4-0 Application for a Special One-Day Permit (Wine/Beer) for Aramark @ Elms , 291 Springfield St for a Elms College Christmas Party to be held on December 12,2014 from 3:00 PM until 10:00 PM with Mark Marson as applicant. Commissioner Goulette makes a motion to approve. Commissioner Tarnowski seconds. Motion approved 4-0 Application for a Special One-Day Permit (Wine/Beer) for Aramark @ Elms , 291 Springfield St for the Holyoke Catholic High Christmas Party to be held on December 19,2014 from 11:00 AM until 3:00 PM with Mark Marson as applicant. Motion approved 4-0 Filing fees are read by Commissioner Goulette Review of Police reports- none at this time Correspondence- Several Commissioners have received complaints and concerns about the location of the alcohol at BJ’s. They would like to discuss this with the manager and will hold a hearing December 18, 2014
