Minutes for October 19, 2017 meeting held in the City Council Chambers at 6:00 PM
In attendance: Commissioners Goulette, Tarnowski, Martin and Jez
Minutes for September are presented to the Board. Commissioner Jez makes a motion to approve.
Commissioner Martin seconds. Motion approved 4-0.
Hearing for Rollin’ Roc- In attendance: Richard Ferus and Det. Michael Dion. Det. Dion reads 2
reports. Commissioner Goulette states that the employee handled the situation correctly by not
serving a customer who was obviously intoxicated when he entered the establishment. She also
called the police when this customer started a disturbance. One of the issues presented was in a
follow up investigation by Det. Dion the employee on duty did not have his TIPs card on his person.
Also the server roster was not available for inspection. Mr. Ferus states the roster is posted on the
wall next to the licenses. The employee should have known this. He has also informed all employees
that they must have their cards on their person at all times. Commissioner questions exactly where
the roster is located. Mr. Ferus states right next to the mirror. Also if the roster is updated when new
employees are hired. Mr. Ferus states it is. He also has quarterly meeting with employees and goes
over any changes in policies. He also states that he is aware that he was not on duty at the time of
these incidents. He is in and out of the business at different times. The Commissioners express their
concerns about the manager not being there. They also suggest that he might want to look into some
new employees if the current ones cannot adhere to his policies. Also the Commissioners reiterate he
needs to be available by text or phone if he is not on the premise. Mr. Ferus states he is always
available by text or phone and his employees are aware of this. They also suggest he institute a set of
procedures for his employees to follow. Based on the facts, the Commission found the licensee in
violation of: Count 1- No Manager of Record on duty/scene; and Count 4-Chicopee Rules and
Regulations- 1.19 Service Training Required for All Liquor Licenses- 1.0 Purpose To require all liquor
license holders, managers and servers to complete an approved alcohol training program. All
employees must have TIP’S card on their person while working. C. Verification of Server Training All
establishments must maintain during operating hours, in an accessible place, a roster or certificate of
trained personnel, which shall be maintained for each employee and shall be available for inspection
by the licensing authority, or any authorized agent thereof, upon demand at all times. An updated
roster shall be submitted with the annual application for the renewal of the license. The roster shall
include: (1) employee name ;( 2) employee date of birth;(3) date of hire;(4) type of training;(5) training
certificate; and (6) date of expiration. The Chicopee License Commission in a 4-0 vote issued a 1 day
suspension to be held in abeyance for 6 months provided there are no further violations. This
concludes the hearing.
Hearing for Cabot Liquors: In attendance: Manish Patel. At this time Mr. Patel has spoken to his
attorney and they would like to reschedule the hearing when Mrs. Patel (manager of record) is
available.
Application for a Change of Manager for Liquors 44, 1461 Memorial Dr: In attendance: David Lively,
proposed new manager and Andrew Morrison. Mr. Lively has worked in this field for over 11 years. He
is TIPs certified and has been running this store for 6 years. Commissioner Jez makes a motion to
approve. Commissioner Martin seconds. Motion approved 4-0.
Application for a Special One Day Permit (Wine/Beer) for The Good Dog Spot, 35 C North Chicopee
St for the Holiday Yappy Hour to be held on Saturday December 2, 2017 from 9:00 AM until 10:00 PM
with Cory Staples as applicant
Commissioner Jez makes a motion to approve. Commissioner Martin seconds. Motion approved 4-0.
Application for a Special One Day Permit(Wine/Beer) for White Glove Catering for a Open
House/Networking Session at the Mercedes-Benz Dealership, 295 Burnett Rd to be held on
Wednesday November 8, 2017 from 4:00 PM until 8:00 PM with Mark Tansey as applicant
Commissioner Jez makes a motion to approve. Commissioner Martin seconds. Motion approved 4-0.
Application for a Special One Day Permit(Wine/Malt) for Aramark @ Elms, 291 Springfield St for a
MBA health Care Innovation Panel to be held on Thursday November 9, 2017 from 4:00 PM until 9:30
PM with Mark Marson as applicant
Commissioner Jez makes a motion to approve. Commissioner Martin seconds. Motion approved 4-0.
Filing fees are read into the record by Commissioner Tarnowski
Review of Police reports: Det. Dion submits a report concerning the 4-10 Lounge. A hearing will be
held in November. At this time the Commissioners ask Det. Dion about the issue of not having the
manager on scene. Det. Dion states that it can hinder the investigation if a serious incident has
occurred. Commissioners also question if the Emergency Contact form will be beneficial. It will be
another tool for the police or fire departments to use in case of any emergency. The idea of the form is
to give the departments all the information possible in any emergency.
