4 TOWN OF CICERO TOWN COUNCIL MEETING MINUTES August 5, 2014 At 7:00 PM Call To Order: President Dennis Schrumpf called the meeting to order and led the Pledge of Allegiance and gave the prayer. President Schrumpf called for the roll call and the members of the Town Council were present or absent as follows: Present: Dennis Schrumpf Absent: Jerry Cook Brett Foster Kay Hartley Eric Hayden President Schrumpf declared a quorum present. Others Present: Jan Unger, Clerk Treasurer Charlie Cambre, Park Superintendent Pat Comer, Street & Utilities Director Dave Hildebrand, Police Chief Steve Peachey, Fire Chief Aaron Culp, Town Attorney Kelleigh Fagan, Attorney Paul Utterback, President Storm Water Management Board Brett Morrow, President EDC Approval of Agenda: Mr. Schrumpf removed two Ordinances: Ordinance 08-05-2014-6 An Ordinance Establishing A Fund For Excess Liability Trust For The Town’s Underground Storage Tanks and Ordinance 08-05-2014-7 An Ordinance Transferring $35,000 From The Rainy Day Fund To The Excess Liability Trust Fund. Mr. Schrumpf stated that these ordinances were not ready yet. Mr. Foster made a motion to approve the Agenda as amended. Mr. Hayden seconded, motion passed. Approval of Prior Minutes: Town Council Meeting Minutes, July 15, 2014, 7:00 PM– Mr. Cook made a motion to approve the July 15, 2014 Town Council Meeting Minutes as presented. Ms. Hartley seconded, motion passed. Approval of Claims: Ms Unger asked to add a claim for $550 from Clear View for work completed on the utility office as it was overlooked. Mr. Hayden made a motion to approve the claims with the Clear View claim. Mr. Foster seconded, motion passed. Petitions by Citizens: There were none. 1 President’s Report: President Schrumpf stated the Town received a thank you from Light’s Over Morse Lake and a request for funding for 2015. There were a couple of questions concerning the donation. In 2014 the Town donated $500. Mr. Foster made a motion to pledge $500 for 2015 Lights Over Morse Lake. Mr. Hayden seconded, motion passed. Mr. Hayden stated that this year’s Lights Over Morse Lake events and fireworks were excellent. Ms. Unger stated that they would probably also request funding for the programs from the Festival Fund. Council Committee Reports: There were none. Legal Counsel Report-Aaron Culp: Mr. Culp stated that he had nothing at this time. Cicero/Jackson Township Plan Commission Report There was no report. Town Engineer Report-Mr. Keith Bryant – Mr. Bryant addressed the following: 1. Jackson Street Pedestrian Walkway – Mr. Bryant stated that the Walkway was open and being used. Mr. Bryant stated that he would be presenting some change orders on the Walkway project, possibly at the next Town Council Meeting, that would mostly address adjustment that were made. Mr. Hayden inquired about the chain link fence on the west end. Mr. Bryant stated that they are waiting on that piece of the railing to come in and it is just temporary. Mr. Cambre inquired about when they would be moving the trailer from Red Bridge Park. Mr. Bryant stated he would check with the contractor. Mr. Cambre also inquired about the electric bills from the trailer. The contractor prepaid $1,500 but it will go over that if the trailer remains. Mr. Bryant said the bills should be given to the contractor. 2. I & I Project – Mr. Bryant stated that the contractor was finishing the restoration on the south end of SR 19 and then they would be leaving for a few weeks and come back in September. The final section is between the Abbey building alley on Pearl Street and then west to Main Street in the alley. United is reviewing bills and they will talk to C.A.T Excavating about a timeline for completion. Mr. Bryant stated that Monoform completed the restoration on the manhole at Brinton and Main Streets and he has that invoice. The invoice is $8,500 plus they had to add cement to the bottom of the manhole for $420. This manhole is now repaired and waterproofed. This invoice can come out of the bond funds. 3. Mr. Bryant stated that he checked the Lakeview Gardens and CVS projects. They are both working on the punch list and have made some headway. 4. Mr. Comer stated that there are two properties between Spring and Neal Streets that were not connected to the sanitary sewer line. One has been corrected but the one at 371 S. Peru will need to be corrected when anything is done with the property. The contractor did run the lateral. Currently that property is abandoned. Mr. Comer stated that he has asked Mr. Munoz to send the owner of record a letter regarding the issue. Old Business: There was none. 2 New Business Council To Introduce Ordinance 08-05-2014-1 Water Rate And Set For Public Hearing. Mr. Schrumpf introduced Ordinance 08-05-2014-1 Water Rate Ordinance by Ordinance number and title. Mr. Schrumpf set the Ordinance for Public Hearing on September 16th, 2014. Council To Introduce Ordinance 08-05-2014-2 Wastewater Rate Ordinance And Set For Public Hearing Mr. Schrumpf introduced Ordinance 08-05-2014-2 Wastewater Rate Ordinance by Ordinance number and title. Mr. Schrumpf set the Ordinance for Public Hearing on September 16th, 2014. Council To Consider Resolution 08-05-2014-3 A Resolution Adopting The Hamilton County Pre-disaster Multi-hazard Mitigation Plan For The Town Of Cicero In Hamilton County, Indiana. Fire Chief Peachey stated that the Town had signed a similar Resolution six years ago and that we now needed to update. This Resolution will allow the Town to apply for emergency funding and recoup money for the snow removal this year. Ms. Hartley made a motion to approve Resolution 08-05-2014-3 A Resolution Adopting The Hamilton County Pre-disaster Multi-hazard Mitigation Plan For The Town Of Cicero In Hamilton County, Indiana. Mr. Cook seconded, motion passed. Council To Introduce Ordinance 08-05-2014-4 Trash Rate Ordinance And Set For Public Hearing. Mr. Schrumpf introduced Ordinance 08-05-2014-4 Trash Rate Ordinance by Ordinance number and title. Mr. Schrumpf set the Ordinance for Public Hearing on September 16th, 2014. Council To Consider Resolution 08-05-2014-5 Transfer of Funds For Plan Commission. There was a question regarding the training Mr. Munoz was transferring money to. Ms. Unger said she wasn’t sure exactly what it was but she thought he was applying for a grant and if he received it he would not use this appropriation. Miscellaneous Comments from the Public 1. Mr. Bruce Freeman inquired about the increases in the rates for water and wastewater. Ms. Unger gave him a copy of the Ordinances. Signatures on Official Documents!
