TOWN COUNCIL MEETING MINUTES
Tuesday, July 5, 2016
At 7:00 PM
Call To Order: President Brett Foster called the meeting to order. Mr. Foster led the Pledge of
Allegiance and said the prayer. Mr. Foster called for the roll call and the members of the Town Council
were present or absent as follows:

Mr. Foster declared a quorum present.
Others Present: Jan Unger, Clerk Treasurer
Pat Comer, Street & Utilities Director
David Hildebrand, Police Chief
Lance Overholser, Fire Chief
Paul Munoz, Cicero/Jackson Township Plan Commission Director
Aaron Culp, Town Attorney
Approval of Agenda:
Ms. Unger removed the Traffic Ordinance item under Old Business. Mr. Amos made a motion to
approve the agenda as amended. Mr. Miller seconded, motion passed.
Public Hearing on Additional appropriations for the LOIT Special Distribution Fund and Rainy
Day Fund
Mr. Amos made a motion to open the Public Hearing on the Additional Appropriation for the
LOIT Special Distribution Fund and Rainy Day Fund. Mr. Lutz seconded, motion passed. Ms.
Unger reviewed the Ordinance stating that it was to appropriate the additional money received
from the state for paving in the amount of $365,397 and the for the Rainy Fund for $121,799 for
Miscellaneous. Mr. Foster inquired if the public had any questions and there were none. Mr.
Amos made a motion to close the Public Hearing. Mr. Lutz seconded, motion passed.
Approval of Prior Minutes:
Town Council Department Head Meeting Memorandum, June 16, 2016, Town Council
Special Meeting, June 21, 2016, 6:00 PM, Town Council Meeting Minutes, June 21, 2016,
7:00 PM, Town Council Budget Meeting Minutes, June 27, 2016, 7:00 PM Approval of
Claims: Mr. Penwell made a motion to approve all four meeting minutes and memorandum as
presented. Mr. Miller seconded, motion passed.
Petitions by Citizens:
There were none.
President’s Report:
1. President Foster stated that all he heard was positive feedback from the Light Over Morse Lake
event over the weekend. He commended Greg and Kathie Bowman for their efforts chairing the
committee. President Foster also thanked the staff for their work during the event. President
Foster also informed the Council that Mr. Bowman was responsible for the flyover prior to the
fireworks.

Council Committee Reports:
1. Events Committee – Police Chief Hildebrand stated that they had no problems over the 4th of July
weekend.
Legal Counsel Report- Aaron Culp:
Mr. Culp stated that he had nothing.
Cicero/Jackson Township Plan Commission Report-Mr. Strong:
1. Mr. Strong stated that he had nothing and turned it over to Mr. Munoz.
1. Mr. Munoz asked Council to consider filing suit against 829 S Washington Street for zoning and
nuisance property violations. He stated that this is an ongoing issue. They were notified in 2014,
2015, and currently that they needed to clean up the vehicles, brush, and trash around their
property. Mr. Amos made a motion to approve Mr. Culp moving forward with filing a suit
against the property owners for the specified violations. Mr. Lutz seconded, motion passed.
Town Engineer Report-Mr. Keith Bryant:
Mr. Bryant was not available. Mr. Comer reported on the following:
1. IDEM Wastewater issues – Mr. Comer informed the Council that they still have not heard
back from IDEM on the agreed order.
2. With regard to SR 19, Dorsey should be in this week to start work.
3. Mr. Lutz inquired about the dumpster on N. Byron Street and Mr. Comer stated that he has
talked to the owner and he is having it moved either tonight or in the moring.
4. Mr. Foster inquired about striping parking spaces on SR 19. Mr. Amos stated that he tried to
get this accomplished. Mr. Foster said that he talked with Representative Tony Cook and
Rep. Cook said he would help if needed. There was a discussion as to if the Town wanted the
striping or not. Most were in favor; Chief Hildebrand stated that he was somewhat opposed.
There was a discussion on traffic calming effect it might have along SR 19. Mr. Amos will
contact Rep. Cook again.
Old Business:
Council To Approve Ordinance 07-05-2016-1 Additional Appropriations For LOIT Special
Distribution And Rainy Day.
Mr. Amos made a motion to approve Ordinance 07-05-2016-7 Additional Appropriation for the
LOIT Special Distribution Fund in the amount of $365,397 and the Rainy Fund for $121,799.
Mr. Miller seconded, motion passed.
Council To Approve And Sign Contract With Grady Brothers, Inc. for the 2016 Resurface Project.
There was a discussion and Mr. Culp reviewed the contract he had prepared. Mr. Amos made a
motion to approve the contract and allowing Mr. Foster to sign. Mr. Penwell seconded, motion
passed.
New Business
Miscellaneous
1. Mr. Lutz stated that he met with Mr. Derrick Arrowood, Hamilton Heights School
Superintendent, and that Mr. Arrowood informed him that he would be willing to come and
speak with the Council about what is happening with the schools. The Council thought this
was a good idea. There will be a presentation at Walnut Grove Community Building on July
21st to discuss the Grade Reconfiguration at 5:30 pm. The Hamilton Heights website has
more information at http://www.hhschuskies.org.
2. There was a lengthy discussion regarding what days and times were available and what
business needed to be discussed.

a. Asked if Dr. Arrowood would be available on July 14th at 6:00 pm
b. Move Staff Meeting to July 14th at 6:30 pm
c. Discuss Budget issues at the end of the staff meeting.
d. Council hold Executive Session on July 14th at 8:00 pm for the purpose of IC 5-14-
1.5-6.1(b)(8) to discuss a job performance evaluation of individual employees.
e. Cancel Town Council Meeting on July 27th is cancelled
f. July 28th the Council will hold a meeting to pay claims at 6:00 pm
g. July 28th the Council will meet in executive session at 6:30 pm according to IC 5-14-
1.5-6.1(b)(8) to discuss a job performance evaluation of individual employees at
h. August 2nd will be alternative date for Dr. Arrowood.
