TOWN OF CICERO TOWN COUNCIL SPECIAL MEETING MINUTES THURSDAY, FEBRUARY 1, 2024 at 6:15 PM Call to Order: President Lutz called the meeting to order. Present: Christopher Lutz Absent: Joseph Cox Eric Hayden Dennis Johnson Emily Pearson Declare a Quorum Present: President Lutz declared a quorum with all members present. Others Present: Rhonda Gary, Clerk Treasurer Dan Strong, Project Coordinator Terry Cooper, Utilities Director Aaron Culp, Town Attorney Miscellaneous: Wastewater Treatment Plant: a. Dinsmore Letter of Engagement – After a brief conversation concerning the point of contact Mr. Cox made a motion to allow President Lutz to sign the Letter of Engagement dated 1/22/24. Ms. Pearson seconded, motion carried. b. Dinsmore Letter of Engagement – Mr. Cox made a motion to allow President Lutz to sign the Letter of Engagement dated 1/31/24. Mr. Johnson seconded, motion carried. c. Baker Tilly Letter of Engagement – Mr. Johnson made a motion to allow President Lutz to sign the letter of engagement related to services from Baker Tilly. Ms. Pearson seconded, motion carried. Motion to Adjourn: Mr. Cox made a motion to adjourn. Mr. Johnson seconded, motion carried. Signatures on Official Documents! TOWN OF CICERO TOWN COUNCIL EXECUTIVE SESSION AGENDA THURSDAY, FEBRUARY 1, 2024 at 6:30 PM Call to Order: Present: Christopher Lutz Absent: Joe Cox Eric Hayden Dennis Johnson Emily Pearson Others Present: Rhonda Gary, Clerk Treasurer Dan Strong, Project Coordinator On February 1, 2024, Cicero Town Council will hold an Executive Session at 6:30 at Cicero Town Hall, 70 N Byron Street, Cicero, IN according to Indiana Code 5-14-1.5-6.1(b)(2)(D) A real property transaction including: (i) a purchase; (ii) a lease as lessor; (iii) a lease as lessee; (iv) a transfer; (v) an exchange; or (vi) a sale; by the governing body up to the time a contract or option is executed by the parties. This clause does not affect a political subdivision's duty to comply with any other statute that governs the conduct of the real property transaction, including IC 36-1-10 or IC 36-1-11. Also, for discussion on February 1, 2024, according to Indiana Code IC 5-14-1.5-6.1(b)(2) (B) Initiation of litigation or litigation that is either pending or has been threatened specifically in writing. As used in this clause, "litigation" includes any judicial action or administrative law proceeding under federal or state law. Motion to Adjourn: 1
