FINANCE COMMITTEE MAY 23, 2019 MINUTES NON-PUBLIC MEETING City Attorney Lance Baker met in a non-public meeting with all members of the City of Clarksville Finance Committee on Thursday, May 23, 2019, at 3:00 p.m. in the City Hall Conference Room, 1 Public Square, Clarksville, Tennessee. Discussions were held regarding the Killingsworth claim (sewer backup), Moller claim (sewer backup), and the Miller v. Rilling and City case. PUBLIC MEETING CALL TO ORDER The public meeting was called to order by Chairman Jeff Burkhart at 3:27 p.m. ATTENDANCE PRESENT: Jeff Burkhart, Tim Chandler, Valerie Guzman, Jeff Henley, Stacey Streetman Mayor Joe Pitts was also present. SEWER BACKUP CLAIMS Upon the recommendation of the City Attorney regarding two damage claims submitted as a result of sewer backup, Councillady Streetman made a motion to authorize a settlement for the claim submitted by Stacy Killingsworth in the amount of $90,410.26 to be paid directly to the claimant, to authorize a settlement for the claim submitted by Rachel and Justin Moller in the amount of $9,550.18 to be paid directly to the claimant, and to authorize overages concerning both the Killingsworth and Miller claims, not to exceed ten percent of the total settlement amounts to be paid directly to the contractor(s). The motion was seconded by Councilman Henley. A voice vote was taken; the motion passed without objection. MILLER V. RILLING AND CITY Upon the recommendation of the City Attorney, Councilman Henley made a motion to authorize a settlement in the Miller v. Rilling and City case in the amount of $100,000.00. The motion was seconded by Councillady Guzman. A voice vote was taken; the motion passed without objection. ADJOURNMENT The meeting was adjourned at 3:32 p.m.
