FINANCE COMMITTEE JUNE 6, 2019 MINUTES CLOSED MEETING City Attorney Lance Baker met with all members of the City of Clarksville Finance Committee in a non-public session on Thursday, June 6, 2019, at 6:15 p.m. in the City Hall Conference Room, 1 Public Square, Clarksville, Tennessee, regarding the Nichol v. City case, and the Robinson, et al, v. City case. PUBLIC MEETING CALL TO ORDER The public meeting was called to order by Chairman Jeff Burkhart at 6:34 p.m. ATTENDANCE PRESENT: Jeff Burkhart, Tim Chandler, Valerie Guzman, Jeff Henley, Stacey Streetman Mayor Joe Pitts, CFO Laurie Matta, and Interim Gas-Water-Sewer General Manager Mark Riggins were also present. NICHOL V. CITY Upon the recommendation of the City Attorney, Councillady Guzman made a motion to approve a settlement agreement in the Nichol v. City case authorizing a payment of $45,000.00 in damages to the plaintiff and the Gas & Water Department replacing any pipe that had not been replaced in the past during two previous breaks in the line that runs along or on the plaintiff’s property. The motion was seconded by Councilman Henley. A voice vote was taken; the motion passed without objection. ROBINSON, ET AL, V. CITY Mr. Baker said the Formal Offer of Judgement in the Robinson, et al, v. City case mirrored the City’s previous settlement proposal with the exception of the grease trap release or the third party adjacent property owner release, but it did contain recovery of attorney fees for any party found to be in breach of the proposed settlement agreement. Councilman Chandler made a motion to reject the Formal Offer of Judgement. The motion was seconded by Councilman Henley. A voice vote was taken; the motion passed without objection. ADJOURNMENT The meeting was adjourned at 6:40 p.m.
