BUILDING & CODES DEPARTMENT Rtr,PORT.. David Srrith gave a brief overview of the department lepofi. Among his comments, he stated that single-family permit totals are up. He said they havc not added any new inspectors sincc 2018. If the permits continue or increase they will need to add a new employee in the budget. He said they are catching up with the grass cutting. So far they have cut around 80 different propefiies. I{e thanked evel'yone for supporting on the code adoption from last month. He stated he would answer any questions. Councilwoman Smith asked how many commercial permits were given out this year. Councilman Erb said it was 47 million worth of improvements. Councilwoman Smith asked David Smith, how we lelinquish on them not paying for grass cutting. Hc said that we bill them and put a lein on their propcrty taxes. Then they will pay when taxes are due. I-le said l,auri Matta in Finance could plobably answer better to that question. Councilwoman Smith asked the cost of cutting the yard. David Srnith said it depends on the sizc ofthe yard along with how many hours spent cutting. Hc stated the majority of leins are around one hundred and fifty dollars. David Smith said he will follow up with Lauri in Finance on the process and give the information to Councilwoman Smith. POLICE DEPARTMENT RRPORT.. Chief Clockarell presented the monthly repo( and asked fbr questions. He statcd that the District 3 precinct is rnoving along. He talked about the progress of the constluction for the building. He said CPD sent about 19 officers to help in the search for the little boy in Joelton. He stated thcy did locatc the little boy. CPD played a vital role in the search for him. He said in these types of instances sumounding counties need help that CPD can provide. FIe said the Sheriff callcd and requested assistance and in about twelve hours we were able to help. Councilwoman Smith thanked Chief Crockarcll for the hard work in helping find the child. ChiefCrockarell said they have hired seven more officels. 'fhey are waiting on background checks and should have them sworn in by next month. He said the Donelson Academy rnay be full so we might send them to Walter State in east Tennessee. He said we might not get these officers in the Academy until late January. He said this does not get us in the federal govemmcnt grant for nine officers yet. He said we can stalt that glant plogram when we get past the allocation whioh was 312 at the time the grant was apploved. Hc stated a few ollicer have left and he terminated ono. He said hiring seven will put us back at 310. He said we probably won't hile irom the grant until March. I{e stated due to Covid-19, applications alc down but they are doing ok. I1e stated he passed on hiring a female due to the interview. Hc said no Afiican Americans applied but we did hire a bilingual officer and Pacilic Islander frorn Hawaii. Ile said not as diverse as he liked it to havc been but they had a good yeat otherwise for diversity. IIe said this will be the last hiring gloup this year. Chief Crockarcll said they will step up patrol around the Mall & Wilma Rudolph area and also Walmart Fort Campbell Blvd & Quin Lane during the holidays coming up. He stated he would answer any questions. Councilman Erb said thele were over a thousand attempts to serve warrants on the report. He asked ChiefCrockarell what is the percentage on what you actually serve. Chief Crockarell said a good portion ofthem arc unsuccessful but we take a lot ofon view warants like a DUI. He stated for one pel'son it may take several attempts. Councilwoman Smith asked if the wanants are non criminal or drug wanants. Chief Crockarell said these are all criminal wanants, Councilwoman Smith thanked Chief Crockarell. Councilman Richmond said as a part of this year's Leadership Clarksville CIass, Chiel'Crockarell and the department did an outstanding demonstration. He said he was so thoroughly proud as a Public Safety Committee Member and Member of City Council. He said Leadcrship of Clarksville had a Public Safety Day at Wilma Rudolph Event Center. I'Ie said we have amazing men and women on the force. Ile said this also involvcd the county. He thankcd Chief Crockarell for representing the City of Clarksville very well. Chief Crockarell said traditionally that and the CPA progr"m are the two most important outreach programs to get involved in the community. Councihnan Richmond said the only thing he would add is to share with the community on this event. He said wc could address the concems of the community and continue to train and hire morc high caliber of officers. Chief Crockarell said it is always good lol Council Members with the Public Safcty Committee to be there. FIRE & RESCUE DtrPARTMEN REPORT; Chief Montgomery said there was an updated report given to replace the original one sent. IIe gave a review of the monthly repofts and ask wele thele any qucstion's. He said the Training Division Successfully passed the monthly audit. He said thirty three classes wcre hosted and two wcrc State Certification Events. Hc said a total of ninety seven attendees and threc hundred seventy three hours total of tlaining. Chief Montgomery said the ground breaking on the new maintenance building stafted. He said it should be about a six month build timc. He said there were no big changes to report. I{e said we have received a few things in from our grants. Councilwoman Smith had a concem to address with Chief Montgomery. She received a complete regarding one ofthe inspectors from Fire Prevention. She said the inspcctor was very disrespectful to the business owner. She said she instructed the person to calI either Chief Montgomcry or Mayor Pitts. Chief Montgornery said he had not received a call but asked for her to encourage the busincss owner to reach him. He said one is the Mutual Aid Agreement between Austin Peay campus Police and CPD. Ile said this has basically come up again because hc replaced Chief Ansley. He said that the signatures need to be updated. He said this is so they can help each other if needed. 'I'here were no questions. A motion to approve was made by Councilwoman Wanda Smith, seconded by Councilman Richmond, Approved by all and passed. It will now go to City Council. Chief Crockarell stated the next one was a budget item purchase an in the field finger print identification. He said this can be used to identify someone during a seatch wanant or a deceased person. He said it is a mobile device they can take in the field and it will run through the AFIS system with the TBI to check a finger print. He said if there is a hit on the finger print the pcrson can be identified. I-Ie said it was being purchased exclusively for the homicide division. Chief Clockalell asked were there any questions. Councilwoman Smitli asked if the device would be used only for homicides or would they also use it for regular deaths. Chief Crockarell said they would use it for that but there were some legality's around that. Hc said for some instances there might be a search warrant required or consent fi'om someone that is alive. He said for somconc alive they can consent to run their print but for someone deceased there would be legality's around that. I-Ie said they could use it for anything if the person gives consent. He said if they will not give consent then a search wamant will need to be retrieved. He said it's a good opportunity to expedite things faster. Councilwoman Smith asked if a citizens was pulled over would it be used on them. Chief Crockarell said it wouldn't be used every time someone was pulled over. He said this is something that the homicide division will use. He said with overdoses and homeless on the rise the devise will help to identiff people so families can be notified quickly. He said this device could help assist in identifying someone in the first forty eight hours. Councilwoman Srnith asked was thc device mainly for homicides and not to be used as traffic stops. Chief Crockarell said it is an investagating tool not for just regular traffic stops. Councilman Erb asked how many devices were going to be purchased. Chief Crockarell said we will be purchasing one. He said maybe there may be a need for two but for now only one would be purchasbd. Councilwoman Smith asked the cost of the device. Chief Crockarell was unsure of the cost but thought it might be under two thousand. He said he could look it up and email it to Councilwoman Smith. . Councilwornan Smith asked if there would be a policy put in place fol the device. Chief Crockarell said at this time there will be no policy but they would work around thc legalities for it. I:le said it will only be checked out by a few members of the depaftment. He said it will bc monitored on how it is used. Councilwoman Smith said she was concerned about a lot of law suits coming in for using the device. There wcre no further questions. A motion to applove was made by Councilman Richmond, seconded by Councilman Erb. Councilwoman Smith was undecided. Approved by two Committee Members and passed. APPROVAL OF ELECTRONIC MEETING: In order to comply with the technical aspects of the Governor's Executive Order regarding holding open meetings in aforum other than in the open and in public, the Public Sof"ty Committee determines that meeting electronically is necessary to protect the health, safety, and welfare of its citizens due to the COVID-19 outbreak. Councilman Erb made a motion to approve the electronic meeting. The motion was seconded by Councilman Richmond. The vote for the motion to conduct this meeting by electronic means was approved unanimously by the Committee. CITY COUNCIL ACTION REQUIRED: 1) Ordinance 49-2020-21 Amending the Official Code pertaining to authority of City Security Officers Will Wyatt/Wes Golden Wes Golden, Health and Safety Manager, presented the committee with a copy of the Authority of Security Officers ordinance for the members and department heads to review. Mr. Golden stated this ordinance authorizes City Security Officers to issue citations for violations on City Property. He said the Security Officer are already doing the work. He said the Security Officers are doing health and safety inspections on 355 structures. Mr. Golden said they would be working with the Clarksville Police Department to insure they work together on this issue. He said once this Ordinance is approved they will be writing a policy on how and when to write a citation. He gave examples of what the citations include. Mr. Golden asked were there any questions. Councilman Erb asked Mr. Golden if the policy was being written after approval from City Council. Mr. Golden replied yes. Councilman Erb stated the importance of the jurisdiction should be precise of the Security Officer and CPD. Mr. Golden said yes sir. He stated they will also be working in conjunction with the court system and police department in developing the policy and training. Councilman Erb asked if the Security Officers will maintain insurance or will the city have to provide in covering them in an incident like the city police carry. City Attorney Lance Baker said this was not discussed or looked at on drafting this ordinance. He said Heather Fleming will have more knowledge of that. Mr. Baker said any City employee include the security officers can purchase personal liability insurance themselves. He stated the City has an umbrella policy that would cover the City for any incidents. He said the Security Officer would have the same protections as CPD under the Government Tort Liability Act and the Umbrella Act would kick in once the reserve is met. Councilman Erb said he was looking out to protect the Security Officers and didn't want them in a situation outside of their training. Mr. Baker said City Police Officers get sued fairly regularly, this does not mean the lawsuit has merit. He said when this happens there is a specific state statute that allows cities to both defend and indemnify there employees. He stated that defend means the city will provide expense for a lawyer. He said typically when it involves police or any city employees they want us to represent them because we deal with government issues all the time. He said they do have the option of hiring their own lawyer or ask to have a lawyer of their own and have the city to pay for it as long as it is reasonable. He said if a judgement is rendered against them the city will pay for it even if they are sued at a personal or individual capacity. He said we don't the employees second guessing their selves when they are on the job making split second decisions. He said the security officers work for the city so they will have the same protections as CPD. Councilman Erb stated his concern about the training for the security officer on knowing certain policy's when they would need to call for CPD for certain situations. Mr. Golden said the procedures and training already exist for the security officers. He said all the officers go through that type of training and are licensed through the State of Tennessee. He said part of that training covers the specific training and laws on what they can do. Councilman Erb said that was good as long as the employee and city was covered. Councilman Henley stated the Executive Session may want Chief Crockarell's input on this. Councilman Henley asked Mr. Golden if everything was ran by Chief Crockarell and was he ok with it. Mr. Golden stated yes he was and added they wanted to get on the same radio system as CPD.  Chief Crockarell said it is a unique approach but our growth and demand of the city parks and this will be supportive of what we do on a daily bases. Chief Crockarell said Mr. Golden and his staff of security have helped a lot already. Chief Crockarell said this is something we can grow it to. He said that last week they discussed to get them on the same radio system. He thinks they resolved that. Chief Crockarell said with respect for Councilman Erb's concerns, if they need back up then they will receive it. He said they want to make sure the security officer have access to the radio system. Chief Crockarell Said they will be working together. He said with training they will know when to call on CPD for help in a situation. He said it is a good program to grow with but it is in its new infancy. He said based on the ordinances that are being looked at to be enforced and the training they have already received plus working together as a team to make sure they have calms to remain safe. Chief Crockarell asked were there any more questions. Councilman Travis asked about the law regarding alcohol at city parks if it was the same as State parks. Mr. Golden said there are ordinances in place regrading no alcohol in city parks. He said there are special events and the gold course that would allow it. Mr. Baker said there is a City Code in place that covers alcohol can or can't be done in City Parks. o After the general discussion, a motion to send this ordinance to the full City Council with a recommendation of approval was made by Councilman Erb; 2"0 by Councilman Travis. The vote for the motion was unanimous.
