MINUTES CITY OF CLEARLAKE CITY COUNCIL & REDEVELOPMENT AGENCY SPECIAL/REGULAR MEETING APRIL 28, 2011 CALL TO ORDER SPECIAL JOINT CITY COUNCIL & REDEVELOPMENT AGENCY MEETING: 5:00 P.M. Special Meeting noticed April 22, 2011. Roll Call. Present: Joyce Overton, Mayor Joey Luiz, Vice Mayor Judy Thein, Councilmember Jeri Spittler, Councilmember Absent: Curt Giambruno, Councilmember Staff: Stephen Albright, City Administrator Melissa Swanson, City Clerk CLOSED SESSION 1. LIABILITY CLAIMS; Pursuant to Section 54956.95: Claimant: Szentkuti, S.; Agency claimed against: City of Clearlake. 2. CONFERENCE WITH LEGAL COUNSEL – EXISTING LITIGATION; Pursuant to Subdivision (a) of Government Code Section 54956.9: Name of Case: Sierra Club vs. Clearlake Redevelopment Agency, KK Raphel Properties, LLC, and Does 1 through 25, inclusive. 3. PUBLIC EMPLOYEE EVALUATION – Pursuant to Government Code Section 54957: Title: Redevelopment Agency Executive Director. The meeting was adjourned at 5:50 p.m. with Council giving direction to staff on item #1 and no reportable action on items #2 and #3. CALL TO ORDER REGULAR JOINT CITY COUNCIL & REDEVELOPMENT AGENCY MEETING: 6:00 P.M. A Moment of Silence and the Pledge of Allegiance were led by Mayor Overton. Roll Call. Present: Joyce Overton, Mayor Joey Luiz, Vice Mayor Judy Thein, Councilmember Jeri Spittler, Councilmember Absent: Curt Giambruno, Councilmember Staff: Stephen Albright, Interim City Administrator CCM 04-28-11 Page 1 of 3 Craig Clausen, Interim Chief of Police Melissa Swanson, City Clerk Adeline Brown, Deputy City Clerk Michael Vivrette, Interim Director of Finance AGENDA APPROVAL, ADDITIONS AND/OR DELETIONS There were no additions or deletions to the Agenda. PRESENTATION Mayor Overton presented a Proclamation Designating May 2011 as Homeless Youth Awareness Month. PUBLIC COMMENT – Bill Shields spoke regarding the Board of Supervisors. CONSENT CALENDAR 1. Warrant Registers – Ratification and Approval of Warrants and Expenditures Certified by the Director of Finance as Conforming with the Adopted Budget Pursuant to Government Code section 37208. 04/11/2011 Warrant Register $585.00 04/14/2011 Warrant Register 81,494.82 04/14/2011 Warrant Register 31,566.03 2. Consideration of Approval of City Council Minutes of April 13, 2011, April 14, 2011, and April 15, 2011. 3. Finance Department Monthly Report. Item #2 was pulled by Vice Mayor Luiz for discussion and separate action. ACTION: It was moved by Vice Mayor Luiz and seconded by Council Member Spittler to accept items #1 and #3 as presented with a voice vote of 4-0-1 in favor, with Council Member Giambruno absent. Item #1 was corrected to reflect the correct name for the second of the motion the April 14th minutes, Item #4 to read Vice Mayor Luiz, instead of Vice Mayor Spittler. ACTION: It was moved by Vice Mayor Luiz and seconded by Council Member Spittler to approve the Minutes as corrected. The motion passed with a voice vote of 4-0-1, with Council Member Giambruno absent. BUSINESS 4. Consideration of Acceptance of the Audit (Annual Financial Statements) for the City of Clearlake and the Redevelopment Agency for the Year Ended June 30, 2010. Staff report was given by Michael Vivrette and a presentation was given by Bryan Gruber of Lance Soll and Lunghard, LLP. ACTION: It was moved by Vice Mayor Luiz and seconded by Council Member Spittler to accept the Page 2 of 3 annual audit for 2009-10 for the City of Clearlake and the Clearlake Redevelopment Agency. The motion passed with a 4-0-1 voice vote, with Council Member Giambruno absent. 5. Consideration of Participation in the Lake County Marketing Program. Staff report was given by Stephen Albright. ACTION: It was moved by Vice Mayor Luiz and seconded by Council Member Spittler to contribute $2000 to the Lake County Marketing Program on behalf of the City. The motion passed with a 4-0-1 voice vote, with Council Member Giambruno absent. 6. Consideration of the Lakeshore Drive Shared Parking District. Council Member Spittler recused herself from the dais due to the fact that she owns property on Lakeshore Drive at 6:40 p.m. She sat in the audience and spoke as a member of the audience and citizen. ACTION: It was moved by Vice Mayor Luiz and seconded by Council Member Thein to file the report and give staff direction to move forward with establishing a Shared Parking District on Lakeshore Drive. The motion passed with a 3-02 voice vote, with Council Member Giambruno absent and Council Member Spittler abstaining. Council Member Spittler returned to the dais at 7:04 p.m. CITY ADMINISTRATOR’S REPORT COUNCIL MEMBERS CALENDAR, TRAVEL AND REPORTS ADJOURNMENT There being no further business to conduct, the meeting was adjourned at 7:20 P.M.
