ANNOUNCEMENT OF ACTION(S) FROM CLOSED SESSION There was no action taken by Council on the closed session items. PRESENTATION CCM 06-13-13 Page 1 of 3 1. Presentation of a Proclamation Declaring June 2013 as Lesbian, Gay, Bisexual, and Transgender Pride Month Councilmember Luiz presented the proclamation to the Lake County Stonewall Democratic Club, who in turn presented the city with a rainbow flag. PUBLIC COMMENT – Carl Webb spoke in support of placing another sales tax measure similar to Measure G on the November ballot. Bill Shield spoke regarding Save Our Seniors and the effort to collect signatures in support of a rent control initiative. Brenda Sanders spoke regarding indoor marijuana grows in her neighborhood. She was referred to staff. Consent Items Recommended Action 2. Consideration of Resolution No. 2013-10, A Motion to approve Resolution No. 2013-10 Resolution of the City Council of the City of Clearlake Authorizing Participation by the Clearlake Police Department in the GAP Grant Administered by the Department of Alcoholic Beverage Control, Approving Grant Funding 3. Acceptance of property located 3960 and 3970 Approve Acceptance of Property Mullen Ave. 4. Consideration of Denial of a Claim for Damages Motion to deny claim from Israel Sanchez 5. Minutes of the May 8, 2013 Lake County Receive and file Vector Control District ACTION: It was moved by Councilmember Luiz and seconded by Vice Mayor Loustalot to approve the Consent Calendar as presented. The motion passed with a 5-0 voice vote. BUSINESS 6. Presentation from Lake County Health Officer Dr. Karen Tait on the Community Assessment for Public Health Emergency Response (CASPER) Report and Report on Investigation of Geothermal Gases in the Burns Valley Neighborhood (Prepared by the California Department of Public Health) Dr. Tait provided a written report to the Council. There was no action taken by Council on this item. 7. Presentation by Ross and Associates on the Proposed Walker Ridge Wind Park Mr. Ross presented written material to the Council. Page 2 of 3 The Sierra Club provided written material to the Council with concerns against the project. There was no action taken by Council on this item. 8. Second Reading of Ordinance No. 2013-161, An Ordinance of the City Council of the City of Clearlake Amending Chapter X of the Clearlake Municipal Code Adding Section 10-7 Prohibiting Commercial Medical Marijuana Cultivation and Cultivation on Vacant Properties and Limiting Cultivation Amounts in the City of Clearlake City Manager Phillipe gave the staff report. Ron Green gave written comments to the Council with suggested changes. Pete Gascoigne spoke against the ordinance. He is against allowing any growing of marijuana. Jack Troyer had questions for staff. Mark Cooper spoke against removing “daycare” from the ordinance and spoke against the ordinance. He is against allowing any growing of marijuana. Ron Green spoke again regarding his proposed changes to the ordinance. Brenda Sanders spoke against allowing growing marijuana. Estelle Creel spoke against the ordinance and in favor of medical marijuana. ACTION: It was the consensus of the Council to review additional changes to the ordinance. The Council agreed to add “licensed daycare” to the definitions under Section 4. The Council agreed to consider indoor marijuana growing at a later time. The Council agreed to direct staff to review increasing the fines and penalties for non-compliance and to add a provision to fine violators of the ordinance “per plant.” The Council agreed to review the ordinance for effectiveness one year after adoption. The Council agreed to direct staff to review the authority to revoke violators’ ability to grow medical marijuana after repeated violations. City Manager Phillipe stated the proposed changes would constitute a substantial change to the ordinance and require another “first reading” to which the Council agreed. 9. Discussion on Mayor Spittler’s Review of the City’s 1980 Incorporation Documents There was no Council action on this item.
