MINUTES CITY OF CLEARLAKE CITY COUNCIL & REDEVELOPMENT SUCCESSOR AGENCY REGULAR MEETING SEPTEMBER 26, 2013 CALL TO ORDER REGULAR CITY COUNCIL MEETING: 6:00 P.M. Roll Call. Present: Joyce Overton, Mayor Denise Loustalot, Vice Mayor Gina Fortino Dickson, Councilmember Joey Luiz, Councilmember Absent: Jeri Spittler, Councilmember Staff: Joan Phillipe, City Manager Craig Clausen, Chief of Police Melissa Swanson, City Clerk Robert W. Galusha, City Engineer AGENDA APPROVAL, ADDITIONS AND/OR DELETIONS Amendment No. 1 to the agenda was posted on September 23rd as follows: 8. Consideration of Resolution No. 2013-16, A Resolution of the City Council of the City of Clearlake Approving a Temporary Street Closure for the Trunk ‘n’ Treat Event on Thursday, October 31, 2013 at Redbud Park Recommended Action: By motion, adopt resolution PUBLIC COMMENT – Mike Tabacchi spoke regarding Congressman Thompson visiting Middletown. He stated that members of Congress are visiting their constituents more often than in the past. Rick Mayo spoke regarding the development process. He stated that by not taking developments through the Planning Commission, staff was limiting public input. He asked that city staff allow for public comment on developments. Roy Simons spoke regarding Measure H. He stated consultants have been talking about Lakeshore Drive development plans since the 1990’s and that there is no proper maintenance on his street. Aqeela El-Amin Bakheit asked questions about the Measure H town hall which were answered by the Mayor. Bruno Sabatier spoke regarding the town hall meeting on Measure H. He stated it would be from 6:00 p.m. to 8:00 p.m. at the Youth Center on October 2nd. He stated it would discuss the text of the measure only and would be for educational purposes without debate. Bill Shields questioned the council having input on Measure H after the ordinance had been passed. CCM 09-26-13 Page 1 of 4 Terri Larsen stated the Board of Equalization will only have oversight on the money collected and not how the city spends it. She stated the No on Measure H committee has a Facebook page and invited the public to review it. Consent Items Recommended Action 1. Warrant Registers Receive and file 2. Second Reading of Ordinance No. 2013-163, Hold the second reading, waive further reading and An Ordinance of the City Council of the City of adopt Ordinance No. 2013-163 Clearlake Adding Section 12-28 of Chapter XII, Cable Communication Franchise of the Municipal Code of the City of Clearlake Enacting An Ordinance Relating to State Video Service Franchises 5. Consideration of an Agreement with CalPoly for Authorize the city manager to execute the the General Plan Environmental Impact Report agreement ACTION: It was moved by Councilmember Luiz and seconded by Vice Mayor Loustalot to approve the Consent Calendar as presented. The motion passed with a 4-0-1 voice vote, with Councilmember Spittler absent. PUBLIC HEARING 6. Public Hearing to Consider Whether to Designate Pomo Road as a One Way Street Between Lakeshore Drive and Arrowhead Road City Manager Phillipe gave the staff report. Mayor Overton opened the Public Hearing at 6:15 p.m. Aqeela El-Amin Bakheit asked questions about where the one-way road would be. Her question was answered by the City Engineer. Joanna McKinley spoke in favor of designation as a one-way. She added that speed bumps may help. She further stated school buses are still traveling on Pomo and going fast. Fred Riley stated traffic would be diverted to other side streets which would make them unsafe. Doug McKinley spoke in favor of designation as a one-way and was in favor of adding speed bumps. Cheryl Moore also spoke in favor and stated cars and buses speed down the road. Bruno Sabatier spoke in favor. Rick Brindle spoke against designation as a one-way. He was in favor of speed bumps but stated the alternate routes were not in good shape. Page 2 of 4 There being no further public comment, Mayor Overton closed the Public Hearing at 6:35 p.m. ACTION: It was the consensus of the Council to direct staff to contact the school district administration staff regarding having school buses and children take alternate routes, and to table the discussion until the mid-year budget discussion. BUSINESS 7. Second Reading of Ordinance No. 2013-161, An Ordinance of the City Council of the City of Clearlake Amending Chapter X of the Clearlake Municipal Code Adding Section 10-7 Prohibiting Commercial Medical Marijuana Cultivation and Cultivation on Vacant Properties and Limiting Cultivation Amounts in the City of Clearlake City Manager Phillipe gave the staff report. ACTION: It was moved by Councilmember Luiz and seconded by Vice Mayor Loustalot to hold the second reading, read it by title only and adopt Ordinance No. 2013-161, An Ordinance of the City Council of the City of Clearlake Amending Chapter X of the Clearlake Municipal Code Adding Section 10-7 Prohibiting Commercial Medical Marijuana Cultivation and Cultivation on Vacant Properties and Limiting Cultivation Amounts in the City of Clearlake. The motion passed with a 4-0-1 voice vote, with Councilmember Spittler absent. Mayor Overton recused herself from the discussion on Item #8 and remained at the dais. 8. Consideration of Resolution No. 2013-16, A Resolution of the City Council of the City of Clearlake Approving a Temporary Street Closure for the Trunk ‘n’ Treat Event on Thursday, October 31, 2013 at Austin Park City Manager Phillipe gave the staff report. ACTION: It was moved by Councilmember Luiz and seconded by Councilmember Fortino Dickson to adopt Resolution No. 2013-16, A Resolution of the City Council of the City of Clearlake Approving a Temporary Street Closure for the Trunk ‘n’ Treat Event on Thursday, October 31, 2013 at Redbud Park. The motion passed with a 3-0-2 voice vote, with Councilmember Spittler absent, and Mayor Overton abstaining. 9. Consideration of an Amendment to Ordinance No. 2013-161: An Urgency Ordinance of the City of Clearlake Making Findings and Declaring a Temporary Building Moratorium on Lakeshore Drive Between Olympic Drive and Old Highway 53 to Provide for a Three-Month Extension City Manager Phillipe gave the staff report. She stated the ordinance was not ready and would be brought to a future council meeting. ACTION: It was the consensus of the Council to table this item to a future Council meeting. CITY MANAGER AND COUNCILMEMBER REPORTS City Manager Phillipe asked for and received the consensus of the Council to continue moving forward with scheduling a mediator workshop for Council relations.
