AGENDA APPROVAL, ADDITIONS AND/OR DELETIONS CCM 04-23-15 Page 1 of 4 City Manager Phillipe asked the Council to delete Item #5, Consideration of a Request from the South Shore Little League to Amend the Use Agreement of Redbud Ballfields to Provide for Year-Round Use. ACTION: It was moved by Councilmember Sabatier and seconded by Councilmember Overton to approve the agenda as amended. The motion passed with a 4-0-1 voice vote, with Mayor Loustalot absent. PUBLIC COMMENT – Keith Ahart, Executive Director of Golden State Water, spoke regarding ways to save water during the drought. Pete Shrive spoke regarding Austin Beach improvement ideas and tule replantation. Lisa Wilson spoke regarding the San Francisco Chronicle insert about Lake County and the lack of representation by Clearlake businesses. Estelle Creel spoke regarding a parking ticket she received and the lack of due process. Consent Items Recommended Action 1. Warrant Registers Receive and file 2. Receipt of Department of Housing and Receive and file Community Development Letter Regarding the Adopted Housing Element ACTION: It was moved by Councilmember Overton and seconded by Councilmember Perdock to accept the Consent Calendar as presented. The motion passed with a 4-0-1 voice vote, with Mayor Loustalot absent. PUBLIC HEARING 4. Confirm Assessment(s) for Administrative Penalties for Failure to Abate Public Nuisance(s) in Accordance with C.M.C. section(s) 1-5, 1-9, 10-1.6, 10-1.7, 10-1.9, 10-1.12, 10-2.2(b), 10-2.4, 10-2.5, 10-2.6, 10-2.7, 10-2.8, 10-3.1, 10-3.3, 10-5; Resolution No. 2015-09, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CLEARLAKE CONFIRMING SPECIAL ASSESSMENTS CONSISTING OF ADMINISTRATIVE PENALTIES FOR FAILURE TO ABATE PUBLIC NUISANCE AND APPROVING LIEN AGAINST REAL PROPERTY IN ACCORDANCE WITH SECTIONS 1-5, 1-9, 10-1.6, 10-1.7, 10-1.9, 10-1.12, 10-2.2(b), 10-2.4, 10-2.5, 10-2.6, 10-2.7, 10-2.8, 10-3.1, 10-3.3, AND 10-5 OF THE CLEARLAKE MUNICIPAL CODE Building Inspector Lambert gave the staff report. ACTION: It was moved by Councilmember Overton and seconded by Councilmember Perdock to open the Public Hearing. The motion was passed with a 4-0-1 voice vote, with Mayor Loustalot absent. Carolyn Hudson, owner of 16267 17th Avenue, spoke against the assessment. Carole Sterrett, resident of 3576 Mountain View Street, spoke against the assessment. Estelle Creel asked questions of staff. ACTION: It was moved by Councilmember Overton and seconded by Councilmember Sabatier to close the Public Hearing. The motion was passed with a 4-0-1 voice vote, with Mayor Loustalot absent. ACTION: It was moved by Councilmember Perdock and seconded by Councilmember Sabatier to adopt Resolution No. 2015-09, A Resolution of the City Council of the City of Clearlake Confirming Special Assessments Consisting of Administrative Penalties for Failure to Abate Public Nuisance and Approving Lien Against Real Property in Accordance with Sections 1-5, 1-9, 10-1.6, 10-1.7, 10- 1.9, 10-1.12, 10-2.2(b), 10-2.4, 10-2.5, 10-2.6, 10-2.7, 10-2.8, 10-3.1, 10-3.3, and 10-5 of the Clearlake Municipal Code, and read it by title only. The motion was passed with a 4-0-1 voice vote, with Mayor Loustalot absent. Vice Mayor Fortino Dickson called for a ten minute break. BUSINESS 5. Consideration of a Request from the South Shore Little League to Amend the Use Agreement of Redbud Ballfields to Provide for Year-Round Use This item was deleted from the agenda. 6. Presentation by Jill Ruzicka, Senior Analyst, County of Lake Administrative Office, Giving an Update on the Lake County Marketing Program There was no action taken by the Council on this item. 7. Presentation by Susan Jen and Wally Holbrook on the Way to Wellville, Its Status, and How the City Fits In There was no action taken by Council on this item. 8. Presentation by Chief Clausen on the Effects of Realignment and Prop 47 on the City There was no action taken by Council on this item. 9. Consideration of Resolution No. 2015-02: A Resolution of the City Council of the City of Clearlake Approving Associate Membership by the City in the California Enterprise Development Authority; Authoring and Directing the Execution of an Associate Membership Agreement Relating to Associate Membership of the City in the Authority; Authorizing the City to Join the Figtree Program Pace Program; Authorizing the California Enterprise Development Authority to Conduct Contractual Assessment Proceedings and Levy Contractual Assessments within the Territory of the City of Clearlake and Authorizing Related Actions CCM 04-23-15 Page 3 of 4 City Manager Phillipe gave the staff report. CITY MANAGER AND COUNCILMEMBER REPORTS Councilmember Sabatier asked for and received Council consensus to direct staff to refer reviewing the rental rates for the Senior Community Center to the Parks and Recreation Committee. Councilmember Sabatier also asked for and received Council consensus to bring a discussion on marketing the city and the creation of a marketing committee to a future agenda. ACTION: The Council adjourned to Closed Session at 9:14 p.m. There was no reportable action on the Closed Session items.
