Present: Denise Loustalot, Mayor Gina Fortino Dickson, Vice Mayor Russell Perdock, Councilmember Joyce Overton, Councilmember Bruno Sabatier, Councilmember Staff: Joan Phillipe, City Manager Craig Clausen, Chief of Police Melissa Swanson, City Clerk Chris Becnel, Director of Finance Ryan R. Jones, City Attorney INVOCATION/MOMENT OF SILENCE Vice Mayor Fortino Dickson led a moment of silence. AGENDA APPROVAL, ADDITIONS AND/OR DELETIONS ACTION: It was moved by Vice Mayor Fortino Dickson and seconded by Councilmember Sabatier to approve the agenda as amended. The motion passed with a unanimous roll call vote. PUBLIC COMMENT – 1. Presentation of a Proclamation Declaring October as Domestic Violence Awareness Month PUBLIC COMMENT – Bill Shields spoke about the Council’s ability to respond to public comment. Matt Nelson spoke about issues at the Youth Center and a business in town. He stated that Councilmember Overton needed to address those issues. Consent Items Recommended Action 2. Warrant Registers Receive and file 3. Minutes of the September 10 and September 24, Receive and file 2015 Meetings 4. Zoning Ordinance Amendment ZOA 2015-01 Conduct second reading of Ordinance No. 177-2015 and read it by title only: an Ordinance of the City Council of the City CCM 10-08-15 Page 2 of 3 of Clearlake adding Chapter 18.8 of Section 18 of the Clearlake Municipal Code Relating to the Regulation of Telecommunications Towers, Antennae and Related Systems ACTION: It was moved by Councilmember Perdock and seconded by Councilmember Sabatier to accept the Consent Calendar items as presented. The motion passed with a unanimous roll call vote. BUSINESS 5. Abatement Order Appeal Hearing: James Gilliland APN #038-142-270 Councilmember Sabatier entered photos he took of the property into the record (Exhibit A) The appellant spoke against the abatement order. The Mayor opened the public hearing at 6:20 p.m. Chuck Leonard spoke in favor of the abatement order. Janice Douglas spoke against the abatement order. Joey Luiz spoke against the abatement order. Kevin Angle stated the Council should consider making the address of the appellant confidential. The Mayor closed the public hearing at 6:44 p.m. ACTION: It was moved by Vice Mayor Fortino Dickson and seconded by Councilmember Perdock to adopt Resolution No. 2015-33, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CLEARLAKE DENYING THE APPEAL OF AN ABATEMENT ORDER AT REAL PROPERTY LOCATED AT 3067 13TH STREET IN ACCORDANCE WITH SECTIONS 10-7.040, 10-7.070, 10-7.080, 10-8.030, 10- 8.040, 10-8.060, 10-8.070, AND 10-8.080 OF THE CLEARLAKE MUNICIPAL CODE, with modifications to include the writ of mandamus procedures and to include the findings of the Code Enforcement Supervisor identifying the subject property, property owner(s), appellant(s), and evidence in the resolution, and read it by title only. The motion passed with a unanimous roll call vote.
